420 with CNW — California Governor Enacts Bill Regulating Medical Cannabis Use in Hospitals

Last week, Gov. Gavin Newsom signed a legislation that would require hospitals to allow some patients to use medical cannabis. The governor of California signed the bill, having revealed that his concerns about an initial version of the bill that he had vetoed had been resolved.

The sponsor of the legislation, Sen. Ben Hueso, has been advocating for the measure to allow marijuana use in health facilities for patients with terminal illnesses over multiple sessions. Recently, Hueso sent a letter to the head of U.S. Department of Health and Human Services asking for clarification on whether the change in policy would threaten federal funding for medical facilities that allowed for the plant’s use.

Confusion about the potential implications for allowing for the consumption of cannabis in medical facilities was what prompted Newsom’s veto decision in 2019. Representatives from the governor’s office as well as the Department of Health and Human Services reached out to the senator asserting that they were looking into the matter.

The senator also received a letter from the Centers for Medicare and Medicaid Services, which stated that there were no federal regulations that addressed this particular issue, noting that the agency was not aware of any cases where funds had been pulled because a medical facility permitted its patients to use medical marijuana. In a press release, Hueso stated that he was confident that medical facilities had the authority to implement the legislation’s provisions while ensuring the safety of other employees, guests and patients of the medical facility as they were in compliance state laws and had received confirmation from the safeguards in the law as well as the Centers for Medicare and Medicaid Services.

However, there are a few restrictions that are included in the new law. For instance, vaping and smoking cannabis will be prohibited, and patients who receive treatment for emergency care will not be covered. The law also stipulates that health facilities will not be mandated to dispense or provide marijuana.

Newsom did not release a statement about the hospital legislation, which the governor’s office revealed that he’d signed, along with other unrelated bills. The governor has yet to sign legislation that would establish a regulatory framework for CBD sales derived from hemp. The legislation would also lift the ban on smokable hemp products.

In other news, activists in California have received clearance to start gathering signatures for a ballot measure for 2022 that would legalize psilocybin mushrooms in the state.

420 with CNW — State Departments of Agriculture Demand Expansion of Federal Hemp Cultivation Grants

More than six years after hemp pilot programs were launched by the 2014 Farm Bill, the nascent sector is still plagued by patchwork state legislations and little if any federal regulation. As more farmers dip their toes into the hemp space and it becomes more lucrative, industry players and  lawmakers alike have consistently urged the U.S. Department of Agriculture (“USDA”) to craft standardized hemp rules. Now, the National Association of State Departments of Agriculture (“NASDA”) is asking the USDA to expand hemp farmers’ access to federal grants by allowing for two different classifications based on its intended use.

This comes a week after members of the NASDA, which represents agriculture departments in all 50 states and four U.S. territories, agreed during an annual meeting to change the organization’s policy regarding USDA’s Specialty Crop Block Program. The organization is now requesting that the USDA allow hemp farmers to designate their crops as either an agronomic commodity or a specialty crop. If the USDA agrees to this request, it would help farmers across the country have expanded access to federal grants, providing them with the valuable resources they need to prosper in the evolving hemp space, stakeholders say.

NASDA’s new policy states that the organization supports dual designation for hemp as a specialty crop based on the way and the purpose for which it is grown as well as expanding eligibility to funding from Specialty Crop Block Grant Program to include farmers who grow hemp for horticultural purposes. According to Jonathan Miller, general counsel for the U.S. Hemp Roundtable, the group is encouraged by NASDA’s commitment to working with the hemp industry and identifying solutions that support hemp farmers. The move also has the potential to open the door to the finding and support that hemp farmers “desperately need,” especially as the country struggles to recover from the coronavirus pandemic.

In a press release, NASDA CEO Barb Glenn said allowing hemp to be designated as both a specialty crop and agronomic commodity acknowledges the plant’s “up and coming nature” and assures new farmers that they will be supported if regardless of which route they choose —  growing hemp for fiber, food or horticultural use. Herrick Fox, the co-chair of the National Industrial Hemp Council’s government relations committee, posits that the only reason hemp wasn’t granted dual designation by the USDA before is because federal agencies are still getting used to the idea of hemp being legal after nearly a century of prohibition.

Fortunately, the USDA is now working to create a regulatory structure for hemp. The agency passed a Final Rule on hemp earlier this year, and the agency is about to run a large-scale survey to gain a deeper understanding of the hemp sector.

If the federal grant program is expanded for hemp farmers, the additional sources of hemp biomass for manufacturing entities such as Golden Triangle Ventures Inc. (OTC: GTVH) could significantly expand since farmers would be able to grow the plant on larger tracts of land.

Cannabis has become popular in the last few years, as more states across the country legalize it for both recreational and medical use. The plant has more than 100 compounds, with roughly 80 of them being classified as cannabinoids. Golden Triangle Ventures (OTC: GTVH) released the successful results of preliminary testing of its proprietary HyGrO hydrogen water technology and is looking forward to pursuing larger-scale studies. The company will work with commercial-scale flower products to further evaluate the efficacy of GTVH’s new process. The preliminary research, which lasted 21 days, was designed to assess whether hydrogen-infused water via the HyFrontier Technologies HyGrO system would increase the longevity of cut flowers, including stock roses, carnations and gladiolas. “Two vases were filled, one with regular tap water and one with HyGrO water. The water was never changed, and pictures were taken to document the results,” explains a recent article. “From the results, photos and observations made in this study, the company concluded that water produced using HyGrO’s patent-pending technology could increase the shelf life of cut flowers, reduce the bloom rate and potentially reduce waste in the floral industry. Plans are already underway to confirm the results through a larger study.”
