420 with CNW — House Committee Backs Using Drones for Identifying Illicit Marijuana Grows

More than a decade after launching a state-legal cannabis industry, America’s illicit cannabis market is still going strong. One of the objectives of legalizing marijuana was to draw clientele away from the black market and deprive the criminal organizations behind it of revenue from cannabis sales, but most states have failed to do major damage to illicit cannabis sales. To add insult to injury, a large percentage of illegal marijuana is grown on public land, and since cannabis is a water-intensive plant, these illegal grows tend to steal a lot of water as well.

In a bid to curb the use of public land to grow illicit cannabis, an influential House committee has backed the use of drones by law enforcement in California to spot these illicit grows. Attached to a spending bill for the state’s Department of the Interior and Environmental Efforts, a report by the House Appropriations Committee talks about illegal cannabis cultivation on public land owned by the federal government. Last year’s report also addressed illicit marijuana grows, but this is the first time the report has contained language about leveraging drone technology to deal with the issue.

The report stated that these illicit grows negatively impact the state’s public, water, soil and wildlife. Furthermore, it said that the committee supported efforts by the U.S. National Forest Service to develop tools that would assist in detecting and getting rid of these illegal grow sites. On drones, the committee wrote that it supported their use by the Department of the Interior, stating that it was firmly behind using drones to identify these sites and provide estimates for how much it would cost to reclaim them.

However, the report said that the department would first have to deal with concerns about domestic production, cybersecurity and technology. While it doesn’t expand on concerns about cybersecurity and technology, hundreds of Chinese-made drones were recently grounded by the federal government, partly because of cybersecurity risks. Regarding domestic production, the committee most likely wants to avoid cases of drones accidentally surveilling state-legal marijuana grows that happen to border public lands, such as the ones in Humboldt County.

The last month has seen several spending bills touching on wide-ranging, cannabis-related legislative issues advance including benefits for veterans working in the state-legal cannabis sector, regulations for CBD and hemp, and immigration eligibility for individuals who use or have used cannabis in the past.

420 with CNW — House Committee Witness Urges Legislators to Make Bipartisan Visits to Cannabis Businesses

The legalization of cannabis has become popular in America, with 18 states having legalized the recreational use of the herb and another 13 decriminalizing its use. However, while Congress is still in disagreement about the herb, a recent visit from an investigative reporter may help move things along.

Amanda Ripley, the witness who graced a House Committee hearing, suggested visits to cannabis businesses by ideologically opposed legislators. Similar visits have happened in Canada, when MP Garnett Genius and Nathaniel Erskine-Smith visited a major producer of cannabis in 2017. This came right before the country legalized the herb for recreational use in 2018. Ripley explained that these visits, which would be one-on-one, would help encourage productive conversations between legislators and bridge political divides.

This approach may be useful in Congress, with the latest polls finding that a bipartisan majority of Americans were in favor of putting an end to cannabis prohibition. However, when the bill for legalization was advanced to the House and put to a vote, the partisan breakdown didn’t reflect the voters’ will, with half a dozen Democrats voting against the legislation and five Republican members voting for it.

Ripley pointed out that the marijuana episode on the “Political Blind Date” show provides examples of the various constructive conversations that could occur if elected officials in the United States engaged with each other on issues they didn’t agree on, while stepping out of their comfort zones. In that episode, MP Nathaniel Erskine-Smith, a member of the Liberal Party who not only backed an extensive drug decriminalization measure but also supports the legalization of marijuana talks with MP Garnett Genius, a member of the Conservative Party, on various topics including THC potency and tax revenue generated from legal cannabis sales.

In spite of their political differences, the two MPs agreed that marijuana did have medicinal value for a part of the population. Before their meeting, only medical marijuana was legal in Canada. Now Canada has legalized cannabis nationally.

And Canada isn’t the only country legalizing the substance. In Mexico, the Supreme Court annulled the prohibition of cannabis in a general declaration of unconstitutionality last week. It seems the United States still has a long way to go in order to get to where these countries are with regard to cannabis.

There is hope though, with Sen. Cory Booker, Chairman Ron Wyden of the Senate Finance Committee and Senate Majority Leader Chuck Schumer having recently revealed that they’re drafting a legalization bill that may soon be introduced to the floor. Furthermore, Chairman Jerrold Nadler of the House Judiciary Committee has also refiled his cannabis legalization measure dubbed the MORE ACT (Marijuana Opportunity, Reinvestment and Expungement Act).

America’s state-legal cannabis industry has achieved quite a lot in a little over a decade. Generating billions of dollars in revenue, it has created hundreds of thousands of new job opportunities and provided states with millions in tax revenue. The industry is projected to grow even larger as it matures and more states join; one group of people who are poised to benefit from the cannabis legalization boom are military veterans.

Cannabis’ federal classification as a Schedule I regulated substance has prevented banks and credit card processors from working with businesses in the cannabis space. This has forced these companies to require cash-only payments, meaning they usually have large amounts of money on hand. Additionally, cannabis itself is a valuable commodity with near-constant demand, and offloading it in the black market is fairly easy for those who know their way around. As such, cannabis retailers and dispensaries have become prime targets for burglars and robbers.

Armed guards are quickly becoming a necessity for any cannabis business with reasonable turnover, and veterans with firearms training are taking up the mantle. Paul Ballenger, a Marine veteran and an Army reservist, is the chief executive officer of Invicta Solutions, which has approximately 400 armed guards stationed in five states. His company provides guards for shopping malls, religious institutions and cannabis companies, among others. With the wave of cannabis reform steadily sweeping across the country, Ballenger’s goal is to have guards stationed in New York, New Jersey and Florida by the end of the year as these key states launch their markets.

In Fresno, California, Operational Security Solutions (“OSS”) hires about 100 armed guards, a lot of them veterans, for cannabis-related businesses. Ryan Hale, the company’s chief sales officer, says OSS has a strict no-drugs policy, stating that marijuana and guns should not mix. Since cannabis businesses are such prime targets, often with lots of cash on site and plenty of cannabis with high resale value on the black market, the guards need to be vigilant and “100% cognizant.”

Veterans often have a hard time finding work after coming back home, with more than half of them finding it difficult to utilize their military skills in a civilian setting. With the cannabis industry poised to see major growth, especially after weathering the coronavirus pandemic like a champ, plenty of vets may finally be able to land employment. Even if lawmakers finally pass cannabis banking legislation allowing financial institutions to work with cannabis businesses, the precious product they sell will need protection.

420 with CNW — Congress Gears Up to Consider Spending Bills Touching on Marijuana, CBD and Hemp

Just a day after the House Appropriations Committee released a report urging federal agencies to reconsider firing employees for past cannabis use, several cannabis and hemp-related spending bills have advanced in Congress. As the 2022 midterms approach, Democrats have limited time to advance cannabis legislation before the Republican Party challenges their tenuous hold on Congress. If these bills are successful, they could have far-reaching effects on the cannabis and hemp industries.

For starters, the House Appropriations Committee approved a bill with an attached report acknowledging clarification from the U.S. Department of Veterans Affairs (“VA”) that veterans who work in the state-legal cannabis industry are eligible for home loan benefits. The report notes that despite its acknowledgment, VA still hasn’t communicated this policy to borrowers and lenders. As such, the VA is to facilitate that communication and report back to Congress within 180 days of the legislation’s enactment.

Also, a spending bill that will provide the Department of Homeland Security’s funding for fiscal year 2022 includes a provision that prevents component agencies from using past cannabis use of low-level offenses as a pretext for denying immigration benefits or protections. The bill also protects them from being penalized in an application.

A standalone bill has been introduced this session to prevent U.S. Citizenship and Immigration Services. The bill, which considers anyone who has consumed even state-legal cannabis as “morally unfit” for citizenship and denies qualifying individuals citizenship based on past cannabis use, has not been acted on yet.

Another spending bill for the U.S. Department of Agriculture (“USDA”) the Food and Drug Administration (“FDA”) cover hemps and its derivatives such as CBD. Lawmakers argue that the 0.3% THC cap for legal hemp products, which was introduced by the 2018 Farm Bill, is arbitrary and may not be supported by science. The report directs the USDA to work with the Drug Enforcement Administration (“DEA”) and the U.S. Department of Health and Human Services (“HHS”) to study whether there is any credible scientific basis to the THC cap.

Additionally, lawmakers pointed out that language that forbids individuals with felony drug convictions from taking part in the hemp industry for 10 years after being released may act as a barrier to entry for communities that were disproportionately affected by the war on drugs. Consequently, the USDA is to analyze these and other barriers that keep impacted communities from joining the industry and report recommendations on how to make sure the sector is equitable.

If this growing awareness by Congress of the need to make cannabis reforms galvanizes into the enactment of enabling federal laws, it has potential to greatly reduce the contradictions that companies such as Sonoma Biologics Corp. have to navigate as they try to adhere to both federal and state marijuana laws.

420 with CNW — Study Finds That Marijuana Possesses Strain-Specific Effect on Driving Performance

A recent study has found that drivers who consume marijuana may not perform or feel impaired. The study found that, instead, drivers who used marijuana would sometimes experience a positive effect on their driving.

This comes at a time when policy makers are working to decide whether driving while under the influence of marijuana warrants similar penalties to driving while under the influence of alcohol in various states across the country. Under the law, impairment is defined as a state of diminished or weakened function.

In many states, the legal limit for blood–alcohol content is 0.08. It is known that a driver who has been awake for more than 20 hours drives with the same impairment level as an individual with the aforementioned blood-alcohol content. However, the stance on marijuana impairment keeps shifting because while it is known that the plant does cause impairment, establishing an acceptable limit seems to be a challenge.

The fact that marijuana metabolites also remain in the human saliva or blood long after the plant’s effects have worn off is also a challenge as it makes it harder for cannabis breathalyzer tests to conclusively measure the impairment level of a driver who’s been using cannabis.

Despite this, some states, including Colorado, have still imposed limits on the level of THC metabolites that can be found in a driver’s blood.

The study, which was conducted by University of Iowa researchers, found that marijuana compounds that give rise to other effects, apart from being high, could probably help individuals drive a bit better. The study, which was reported in the “Traffic Injury Prevention” journal, involved 10 drivers who were each evaluated on their road abilities two hours after they had  consumed marijuana.

Each driver was asked to rate their perceived level of impairment before they performed some simulated tasks. Prior research had discovered that drivers who were stoned took fewer risks and were more aware of their impairment when compared to drivers who were inebriated and took more risks.

The authors of the study explained that with regard to longitudinal and lateral control, a growing perception of stimulation gave rise to a positive effect on the drivers’ performance. They added that the study results offered a better understanding of how various strains of marijuana, which gave rise to different experiences for users, could affect driving safety.

The researchers also noted that drug effects that produced more high or stoned feelings resulted in a greater negative impact on driving while those that caused more stimulation had a lesser effect on driving. This isn’t to mean that driving after consuming marijuana is safe, it just means that the level of impairment may not be as pronounced, depending on the marijuana strain consumed.
