420 with CNW – Cannabis Giant Unveils Plans to Promote Responsible Marijuana Marketing

Despite being federally prohibited, the state-legal U.S. cannabis industry is already worth millions of dollars in sales and experts project immense growth over the next decade. However, before that happens, the industry still has a lot of kinks to work out, especially cannabis marketing. Cannabis’s status as a controlled substance coupled with the fact that it lacks a comprehensive regulatory structure has resulted in dishonest, unreliable marketing that sometimes even seems to target underage consumers.

As the state-legal industry continues to grow, Cresco Labs, a vertically integrated, publicly-traded company that operates in nine states, is planning on pushing new advertising standards that would completely change how cannabis products are advertised. On October 6, the vertically integrated cannabis company released a proposal to convince other competitors in the cannabis space to adopt the same, or similar rules for homogeneity.

For instance, the proposal pledges to never show when marketing a cannabis product a “consumer lacking physical or mental control over their behavior, movement, or speech as a result of consuming cannabis,” as it seems to encourage overconsumption of cannabis products, “We will never suggest over-consumption is in any way acceptable, fun or desirable,” the proposal states.

Additionally, the rules also ban using a “symbol, image or language that is of primary appeal to those under the legal age, with Cresco putting guardrails on its media buys and experiential activities and taking “every reasonable measure to avoid contact with those under the legal age of consumption.”

In establishing such rules and putting forth high advertising standards for cannabis companies to adhere to, Cresco is hoping to open up more media inventory to run their ads. Since cannabis is still considered illegal at the federal level, publicly traded companies such as Facebook and Twitter do not accept paid cannabis ads, forcing cannabis businesses to rely on privately held media brands.

Cresco, for instance, has been able to buy ads with privately held media brands controlled by Condé Nast, Penske Media, and Vice Media, according to Cory Rothschild, senior VP of marketing for Cresco Labs. By advancing these advertising rules, he says, Cresco hopes to grow that list to media brands like Pandora and Sports Illustrated.

“It’s understandable why publishers would be cautious to move into this space. What we hope to demonstrate is that there are standards and values that we share, that the entire industry shares, that we can all commit to.”

Experts that this initiative is likely to be welcomed by established marijuana firms like Pac Roots Cannabis Corp. (CSE: PACR).

420 with CNW – Vermont Governor Allows Marijuana Bill to be Operational Without His Signature

Cannabis legalization activists in Vermont can finally breathe a sigh of relief after the governor announced that he will allow legal marijuana sales to take place in the state without his signature. Although the state legalized personal possession of up to one ounce and cultivation of two plants in 2018, retail sales have been prohibited. Governor Phil Scott’s decision to allow legal sales will finally create a tax-and-regulate system for the industry. On top of that, he also signed separate legislation to automate expungements for prior cannabis convictions.

Before being reconciled in a bicameral conference committee last month, different versions of the marijuana sales proposal passed each chamber. After the finalized proposal was sent by the legislature to the governor, he was non-committal about his plans for the legislation up to the day before the signature deadline. Although he hinted that he was considering vetoing the bill, he ultimately decided to let the legislation pass.

Most of Gov. Scott’s issues with the proposal had to do with impaired driving, taxes, and local control. Before the finalized proposal was presented to him, the governor stated that while he appreciated the legislative process the bill had gone through, certain racial justice groups had raised concerns with his office about how the proposal addressed social equity in the cannabis industry for communities that had been most affected by prohibition.

Last Tuesday, he stated that lawmakers “did move forward in a lot of areas that I had concerns about, but it isn’t exactly what I’d like to see and there are some shortcomings.” But when the time came, he stood out of the way and let the legislation pass. “However, there is still more work to be done to ensure the health and safety of our kids and the safety of our roadways – we should heed the public health and safety lessons of tobacco,” Gov. Scott wrote in a letter to lawmakers announcing his decision.

“Further, I believe we are at a pivotal moment in our nation’s history which requires us to address systemic racism in our governmental institutions. We must take additional steps to ensure equity is a fundamental principle in a new market. The concerns with this bill of the communities historically most affected by cannabis enforcement were not meaningfully incorporated into this bill,” he says.

He argued that lawmakers should consider creating a social equity applicant category for cannabis licenses as well as a 50% licensing waiver for those applicants and additional technical and financial assistance. Despite the bill’s apparent shortcomings, it has been celebrated by cannabis reform activists.

“It’s a great relief to learn that Vermont will finally move forward with plans to replace prohibition with sensible regulation,” says Matt Simon, New England Political Director for the Marijuana Policy Project. “Legislators bent over backward to address Gov. Scott’s concerns throughout this process, and it’s now clear that these difficult compromises weren’t made in vain.”

420 with CNW – Mexican Senate Leader Says Cannabis Legalization is Due This October

The Majority Leader of the Mexican Senate has revealed that his chamber is most likely to pass a marijuana legalization bill by the end of this month.

Ever since the country’s Supreme Court declared back in 2018 that it was unconstitutional to outlaw the personal possession and use of marijuana by adults in the country, activists have been restless as they await an appropriate law to operationalize the ruling of the top court in the land.

Nevertheless, some of the activists are unhappy with the current bill before Senate because they feel that it doesn’t go far enough to ensure equitable access to the industry once legalization takes place.

Despite the Supreme Court giving the government a deadline extension until mid-December, Ricardo Monreal of the ruling MORENA party, who also happens to be the majority leader, says that a floor vote is likely to take place within the next two weeks.

Currently, it isn’t clear how the bill will be handled in the Senate. Some people speculate that the shortage of time will compel the legislators to send the draft bill straight to the floor of the upper chamber instead of taking it through the committee process as is the norm.

Once the Senate approves the marijuana legalization bill, it will be sent to the other legislative chamber called the Chamber of Deputies.

Earlier this year, the legalization bill was considered and passed by several committees of the Senate. However, progress in passing the law ground to a halt when the COVID-19 outbreak made it impossible for further negotiations on the proposed law to take place.

Under the bill, adults who are at least 18 years old could cultivate and possess marijuana for their personal use. Individuals would also be allowed to grow up to 20 marijuana plants, on condition that the total annual harvest from those plants doesn’t exceed 480grams. Patients registered to use medical marijuana will however be allowed to apply for permission to cultivate more than the 20 plants allowed for recreational users.

The bill suggests that marijuana sales would attract a 12 percent tax and some of the revenue generated will be allocated to a treatment plan for substance abuse.

People will also be allowed to consume marijuana in public, with the exception of zones which are deemed to require 100% freedom from smoking, such as school and hospital premises. The bill also stipulates that CBD and hemp wouldn’t be governed by the laws which apply to THC products.

With a group of activists camped just outside the Senate premises having a massive collection of marijuana plants from which they allow passersby to light up a joint in solidarity with their cause, it is only a matter of time before the legislature passes the long-awaited law. It remains to be seen what cannabis entities like Sugarmade, Inc. (OTCQB: SGMD) make of the regional implications of the legalization of pot in Mexico.

420 with CNW – Arizona Eases Rules on Past Cannabis Use by Police Recruits

The state of Arizona has revised a cannabis policy that prevented individuals who had consumed marijuana in the past from becoming police officers. Described by officials as a modernization of existing policy as laws and societal views on the drug continue to evolve, the move relaxes limits of past marijuana use for people who would like to join law enforcement. Presently, current rules disqualify applicants who have used marijuana during the three years prior to their application.

Additionally, applicants who have used cannabis more than 20 times in their lifetime or more than four times after the age of 21 are automatically rejected. Thus good, honorable people who would like to serve are turned down because they smoked a joint once or ate a cannabis-infused brownie years ago when they were younger. However, under the new rules, applicants will be subject to less stringent cannabis use limits.

Proposed by the Arizona Peace Officer Standards and Training Board (AZPOST) and approved unanimously by the Governor’s Regulatory Review Council, the new rules will only disqualify applicants if they’ve consumed marijuana during the past two years. Under the new rules, it won’t matter how many times an applicant has used cannabis nor what form they used it in.

Coupled with AZPOST’s announcement last year that officers could use CBD without fear of losing their jobs, this change marks the most significant shift in Arizona’s marijuana standards for law enforcement in almost 30 years. “As you can imagine, society has changed. Society’s view on the use of illegal drugs has changed, so we thought it was really important to take a look at that and make some changes,” says AZPOST Director Matt Giordano.

According to Giordano, pot standards haven’t been significantly updated since the early 1990s so it was time for an update, especially after receiving feedback from community members and hiring managers worried that the outdated rules had departments passing up good candidates. Approved this week by Republican Doug Ducye’s administration, the new rules won’t take effect until April 2021.

Although local law enforcement agencies will still be able to use more stringent pre-employment drug standards, Giordano argues that the new rules are meant to modernize hiring practices, not weaken them.  “People would argue that we are lowering standards to become a peace officer. I would argue with that. We are modernizing the standards to meet the needs of the community in the State of Arizona.”

This change in policy is likely to win the applause of cannabis sector players like Pure Extract Technologies Inc. since the changes end one aspect of discrimination targeting people who have ever used marijuana.

420 with CNW – Mississippi Governor Enacts Bill Allowing FDA-Approved Cannabis Medicines

Barely weeks before voters in Mississippi decide which of the competing medical marijuana initiatives before them will pass, the state governor has signed a bill that will allow FDA-approved medical cannabis products, such as Epidiolex, to be available to qualifying patients in the state.

By enacting this new law, Gov. Tate Reeves (R) has complicated the subject of medical marijuana legalization a little more.

For starters, the governor has been opposed to any plan to legalize medical marijuana in the state. To him, such a step would make marijuana a mainstream product, and that is a possibility he is unwilling to see happen under his watch.

Additionally, Initiative 65 sponsored by Mississippians for Compassionate Care met all the requirements to be included on the November ballot, and campaigns are underway to mobilize voters to cast their ballots in favor of this measure.

Under Initiative 65, patients with one of the proposed 22 qualifying conditions, such as cancer, chronic pain and seizures would be allowed to get a prescription from a doctor and possess up to 2.5 ounces of medical marijuana within a two-week window.

However, another competing measure will also be on the November ballot. This second measure was drafted by the legislature and it is seen as a more strict legalization law which doesn’t have a lot of the provisions in Initiative 65.

There are fears that voters could be confused by these two conflicting medical marijuana legalization measures, and that confusion could disadvantage Initiative 65. This fear gets more credence when you consider the fact that the American Medical Association, alongside the Mississippi State Medical Association, have widely circulated a sample ballot paper which gives voters directions on how to reject Initiative 65.

Observers say the governor may have had less than noble intentions when he signed the bill removing FDA-approved cannabis-based medicines from the state’s controlled substances law. It is believed that the intention of that law is to mislead voters into thinking that the state has already legalized medical marijuana, so there is no urgent need for them to support Initiative 65.

The team behind Initiative 65 therefore has a lot of work to do before success can be theirs, but they can at least count on the opinion polls which indicate that the population of voters in Mississippi overwhelmingly supports their legalization initiative. For example, a recent survey gives the measure 81% voter support.

Entities like Pac Roots Cannabis Corp. (CSE: PACR) probably think that the outcome of the voting may be too close to call given the different factors surrounding what is at stake.

420 with CNW – The US Government Now Supports Globally Rescheduling Marijuana

According to news coming in from last Thursday’s Vienna meeting of the UN Commission on Narcotic Drugs, the U.S. federal government supports a recommendation by the World Health Organization to remove marijuana from category IV, the strictest category, of globally controlled substances.

Patt Prugh, an attorney advisor at the United States State Department, spoke on behalf of the U.S. government during that meeting. While supporting marijuana rescheduling, she spoke vehemently against a proposal to remove cannabidiol from international substance control treaties. She argued that making those proposed reforms would create legal loopholes and ambiguities which could potentially compromise the effective control of drugs globally.

This strong opposition is hard to comprehend because the proposal by WHO suggests that the UN body declares that any CBD whose THC content is less than 0.2% isn’t regarded as a controlled substance in international drug control treaties.

However, Prugh seemed to contradict herself during her testimony before the narcotics body. She said that keeping marijuana in the most restrictive category of controlled substances undermines new science which proves that the substance has medicinal value. This is contradictory because while she is advocating for rescheduling at the international level, she is in support of keeping marijuana in Schedule 1 of the Controlled Substances Act back home in the U.S. Schedule 1 is the most restrictive of all the categories of substances listed under that Act.

The support for global cannabis rescheduling is in stark contrast to an earlier position indicated in a government document in which the federal government stated that putting marijuana in a less restrictive category internationally would make drug reform advocates think that the way has been opened for marijuana to be legalized in different jurisdictions around the world.

Even as the ambassador revealed that the U.S. position on marijuana had changed, she was still adamant that similar concessions shouldn’t be made for CBD. According to her, the issue was “outside the scope of the substance scheduling process.”

Marijuana policy reform advocates say that the U.S. appears to be caught in the middle of forces that want change (such as the increasing legalization of marijuana at state-level across the U.S.) and the prohibitionist voices which want the status quo to be maintained.

Nevertheless, reform advocates are confident that either way, the people seeking progressive policies on marijuana will win. For example, when the UN narcotics body votes to keep CBD as a controlled substance, the reform movement will be further energized to go all out and break the wall of prohibition once and for all. If, on the other hand, the recommended reforms are passed, that in itself will be a victory for the reform movement and they will channel their energies to other changes that need to be made globally.

It remains be seen what cannabis sector actors like Sugarmade, Inc. (OTCQB: SGMD) think about the politicking going on at the UN.
