420 with CNW – Massachusetts Cannabis Dispensary Claims Regulatory Delays Cost Them Millions

A cannabis dispensary based in Massachusetts is claiming that the state’s inability to act on its application for over eight months has cost it millions of dollars. On September 14, Northeast Alternatives filed a lawsuit in the Suffolk Superior Court asking the court to instruct the Cannabis Control Commission to act on its application for a cultivation facility. In its complaint, the company stated that it submitted an application to the state in June 2019 for a second cultivation facility in Lakeville to supplement its cultivation, manufacturing, and dispensary operations in Fall River.

The dispensary says that it received five follow-ups from the commission asking for additional information, with the commission stating on January 26 that the application was complete. On February 20, the state received certification from the town of Lakeville stating that the Northeast Alternatives had signed the required contract with the municipality to operate in the town. Although state statutes require the commission to either issue or reject the application within 90 days, the dispensary has been waiting for over eight months.

The dispensary claims that it reached out to the commission in late March for an update and was told that its license would be reviewed during a commission meeting in May. However, May passed without any action and when the dispensary threatened to involve the courts in June, the commission requested more time. As July rolled by, the commission requested more information on several occasions, which the dispensary provided, but two months later, an update still wasn’t forthcoming.

“With each day that passes without the statutorily required action from the commission, NEA incurs additional costs related to the application, including rent on the property intended for the proposed marijuana establishment,” the complaint said, highlighting the fact that the dispensary has been paying $200,000 a month in rent all year. “Specifically, NEA has paid over $1.2 million in rent on the Lakeville location since its application was deemed complete.”

A spokeswoman for the agency said the commission would not comment on pending litigation. “The agency continues to conduct all possible due diligence to ensure marijuana establishments maintain suitability for licensure and has enforcement tools at its disposal if a licensee is found to be in violation of Massachusetts law or regulations.”

This isn’t the first time the Cannabis Control Commission has been criticized by applicants for dragging its feet. Back in December, applicant Leah Daniels interrupted a commission meeting in protest of the then 610-day wait on her pending application.

Analysts say sector players like Pure Extract Technologies Inc. are always saddened when stories of regulators unnecessarily delaying to approve cannabis business applications emerge because companies go through all sorts of hoops to satisfy a long list of requirements.

420 with CNW – House Vote to Federally Legalize Marijuana Postponed

A congressional vote on a measure to legalize marijuana that was to be carried out in this week will no longer take place.

This comes a fortnight after Majority Leader Steny Hoyer said that the vote was being planned for the week of September 21. Hoyer stated that the MORE Act remained an important part of the House Democrats’ plan that advanced criminal justice reform and addresses systemic racism. He added that they are committed to making sure the House votes on the bill before the year’s end.

However, at this time, the House is focused on addressing the coronavirus pandemic and securing agreement to avoid a detrimental government shutdown. Though no scheduled date has been confirmed, the House will, in the autumn, pass the MORE Act, which is a key step forward in making the U.S. justice system fair for all Americans.

It seems the decision to postpone the vote was greatly influenced by certain Democrats who expressed the concern that voting on a marijuana reform bill when coronavirus relief legislation has still not been resolved would hurt their re-election campaigns. Earlier last Tuesday, Hoyer stated that their priorities were a COVID-19 relief bill and approving a continuing resolution, but seemed to be on the fence about the MORE Act advancement to the House.

The speculation has now been confirmed though, the House will not be voting on the MORE Act this week.

Rep. Barbara Jean Lee (D-CA), the Congressional Cannabis Caucus co-chair said earlier on Wednesday that she was okay with delaying the MORE Act vote if that meant that more members would sign onto the bill. However, she recently said in an interview that lawmakers would do everything necessary in the coming week to build more support and ensure that the vote happened sooner, rather than later.

In a joint statement released on Thursday, Rep. Earl Francis Blumenauer and Rep. Barbara Lee stated that they had worked to build support for this historic bill and looked forward to a vote in the coming week.

The MORE Act would expunge the records of individuals who have prior cannabis convictions as well as federally deschedule marijuana. It would also open up alternative channels for the resentencing of individuals who have been jailed for cannabis offenses and defend immigrants from being denied citizenship over marijuana while also preventing federal agencies from denying security clearances or public benefits due to cannabis use.

Additionally, the MORE Act would impose a 5% state tax on marijuana sales and the revenue would be reinvested in the communities that were most affected by the drug war.

With more than two-thirds of Americans leaning in favor of legalizing marijuana, the House Vote on the bill is bound to pass with a majority, despite the delay.

This postponement of the widely anticipated vote is likely to be a disappointment to sector players like Pac Roots Cannabis Corp. (CSE: PACR) who have been longing for marijuana policy changes at the federal level.

420 with CNW – First-of-a-Kind Cannabis Microbusiness Cleared to Open in Michigan

Months after recreational cannabis sales started in Michigan, sales are booming with the Marijuana Business Factbook estimating the state’s 2020 adult-use sales will total between $400 million – $475 million, growing to $1.9 billion – $2.4 billion by 2024. Michigan offers a variety of license types for the adult-use market depending on the size of the business and until very recently, the state hadn’t yet awarded a cannabis microbusiness license.

This is a type of license that allows a single business to grow its own supply of up to 150 plants, process, package, and sell the final product to customers. This week, Michigan’s first cannabis microbusiness license was awarded Sticky Bush Farm, a company based in Presque Isle County’s Onway. The license is usually meant for small businesses that aren’t allowed to interact with the rest of the licensed cannabis market. This means they can’t acquire marijuana or marijuana products from outside growers, processors, or retailers, and may not sell any products to other marijuana retailers or dispensaries.

“This is a complex license type incorporating the functions of three other license types,” says Marijuana Regulatory Agency spokesman David Harns. “The license type also presents a challenge to municipalities as to zoning because of the diversity of the function occurring in a single location.” According to Onway City Manager Kelli Stockwell, the road to processing and awarding the license to Sticky Bush Farm was long. There were two microbusiness licenses up for grabs and while the owners of Sticky Bush Farm approached the city last year, no one has submitted a request for the second license.

As of early August this year, the Marijuana Regulatory Agency had received only one complete application for a microbusiness license. “Here’s this license type that was put out for small-business owners, minority applicants, and social equity applicants and you’ve had zero applications,” said Dan Russell, a consultant working on behalf of Tranquility Fields at the time. This can be attributed to Michigan’s existing marijuana licensee rules which applied a permit’s plant limit to those that are mature, which is defined as rooted plants 8 inches or longer, regardless of whether the plant is flowering or not.

According to Russell, this means that eventual microbusiness licensees may not get an opportunity to operate a truly viable business. “If it’s defined as 150 ‘mature’ plants, it now means a microbusiness could have 75 in flower and 75 in a vegetative state, which really doesn’t create a viable business for any small business owner.”

It is believed that larger cannabis companies like Sugarmade, Inc. (OTCQB: SGMD) will be observing to see how the microbusiness model pans out in the long-term.

420 with CNW – Illinois Breaks Yet Another Monthly Cannabis Sales Record

According to a Department of Financial and Professional Regulation report from the state of Illinois, cannabis sales in the state this past month of August have yet again broken another monthly record.

The report which was released on Tuesday showed how marijuana sales in the state had been increasing each month, despite the ongoing coronavirus pandemic. Last month, consumers bought more than 1.3 million cannabis products whose value was calculated to be about $64 million. Out-of-state sales (to visitors) were recorded to be roughly $17 million. The previous sales record was $61 million, which was recorded in July.

The data collected seems to support the idea that the state’s cannabis market is not only pandemic-proof but also recession-proof.

Officials from the state have stated that despite the upward trend in cannabis sales, their primary focus at the moment lies in using the tax revenue generated to reinvest in neighborhoods and communities that have been the most affected by the drug war.

The state had announced in August that since marijuana retail sales began in January, it had recorded $52 million in tax revenue within the first six months of the year. 25% of this revenue will be directed to a social equity program.

A senior cannabis advisor to Gov. Jay Robert Pritzker, Toi Hutchinson, stated that the main aim of the state was not to make money but to help people, supporting the communities that had been most affected by the drug war.

Earlier in May, the state had reported that it was availing $31.5 million in marijuana tax revenue for restorative justice grants.

All things considered, making sure the market is equitable has not been a smooth ride. Dozens of individuals who had applied for social equity licenses recently sued regulators. They were denied the opportunity to take part in a licensing lottery as they reportedly had issues with their applications. Despite the state saying that they would approve 75 applicants, only 21 individuals qualified. Some critics protest that the resources one requires in order to turn in an acceptable application only bars those who actually need these special licenses from accessing them.

On the other hand, data of out-of-state sales supports the Governor’s prediction that marijuana tourism would reinforce the state’s reserves. Before its implementation, the State had pardoned about 11,000 individuals who had marijuana convictions.

In the State of Oregon, officials have also noticed a similar upward trend in the rise of sales amid the coronavirus pandemic. Data that was released earlier this year show that adult-use marijuana product sales had risen by 60%.

420 with CNW – Activists to Halt Legal Challenge to Utah’s Cannabis Legalization Initiative

Back in 2018, Utah’s legislature passed a bill to legalize medical marijuana in the state and the move was met with quite the resistance from legalization advocates. Although voters in the state had voted to legalize medical marijuana via Proposition 2, state legislators supplanted it with the Utah Medical Cannabis Act, a more tightly controlled plan for providing marijuana-based treatment. According to Gov. Gary Herbert, the legislation acted as a bridge between opponents of Proposition 2 such as The Church of Jesus Christ of Latter-Day Saints and those who supported the initiative.

However, groups like Together for Responsible Use and Cannabis Education (“TRUCE”) and the Epilepsy Association of Utah were not comfortable with the medical cannabis initiative and filed a lawsuit against the legislature. Two years and countless court battles later, a spokeswoman for TRUCE has announced that the group will file in state court to withdraw the lawsuit. The case is being pulled due to the group’s inability to keep paying legal costs over the two year legal battle, explains TRUCE founder, brain tumor survivor and longtime cannabis activist Christine Stenquist.

“While this lawsuit is coming to an end, the fight for a real medical cannabis system for the state of Utah, which will meet all patient needs, continues,” she says. On the bright side, the lawsuit eventually forced Utah legislators to remove key portions of the medical marijuana bill, portions supporters of the voter-backed initiative claim were designed to curtail cannabis distribution in Utah against the public’s will. “We did get a big win out of that,” she says. “We absolutely crushed it.”

Although the group would have liked to continue wrangling over the larger issue of the limits of the Utah Legislature’s power when it comes to legitimate citizen initiatives, “the money is just not there,” Stenquist says. Instead, she urges a “broad coalition” of other interest groups in Utah to unite and pursue the legal cause. “Two years is a long time to push on a lawsuit and not get as far as we had wanted, but they have the means to push back on anything they want,” she says, referring to the state government’s near infinite supply of funds sourced from taxes.

According to Ross “Rocky” Anderson, a Salt Lake City lawyer representing the group, the case has been dismissed “without prejudice,” meaning it can be refiled at any point in the future. However, he notes that this isn’t the first time successful citizen initiatives have been altered by lawmakers. “The Legislature acts so contemptuously towards the right of the people. We believe it is high time that we get an answer from the Utah Supreme Court as to whether there is really any meaningful right of initiative legislation under Utah’s constitution.”

It isn’t clear whether cannabis companies like Pure Extract Technologies Inc. see the legal battle in Utah as failing in its objectives, or the changes to the law made make the effort worthwhile even if it was pursued to the end.

  • Hemp is a Renewable Resource

Hemp is a highly renewable paper source. This does not mean trees aren’t renewable, they are. Replacing a tree that has been cut down takes between 20-80 years while hemp plants can be planted and harvested in 4 months. Switching to hemp paper produces more paper for the amount of land being used to grow the hemp plants and also saves our forests from more deforestation.

  • Hemp Helps Purify the Soil

Hemp improves the soil it grows in. It does this through pulling the toxic materials out of the soil using its roots, a process referred to as phytoremediation.

Hemp is so good at this that it has been used around Chernobyl to help clean up radioactive contaminants, remnants of the famous nuclear explosion. The plant has also been used to remove dioxins in the soil in Italy, which is ironic since dioxins are the toxic chemicals that are used to bleach wood in order to make paper.

When making paper using wood, dioxins and chlorine is used to whiten the paper. These chemicals are poisonous and can pollute waterways.

On the other hand, hemp is whitened using hydrogen peroxide, which does not poison waterways like dioxins, making it the more environmentally-friendly option.

  • Hemp is Both Stronger and Longer Lasting

Hemp creates paper that is more durable and much stronger in comparison to paper from wood. Paper from wood also yellows and decomposes quickly while hemp, which is one of the strongest natural fibers in the world, does not yellow or decompose with age.

  • Hemp can be Recycled More Times than Wood Paper

Recycling makes a huge difference in everything. While paper from wood can only be recycled 3 times before it becomes unusable, hemp paper can be recycled up to 8 times.

Despite these advantages, legal restrictions and having only 23 paper mills globally that can make hemp paper makes hemp paper expensive and also difficult to find.
