420 with CNW – Michigan Sees 29% Sales Growth for Recreational Marijuana in January

A statistical report on marijuana is published every month, and Michigan has released its report for the month of January. The report shows that in the month of January, adult-use marijuana sales in the state continued to grow at a steady pace.

In January, adult-use sales rose to $9.8 million while previously in the month of December, the sales were $7 million. Michigan launched recreational sales of marijuana on December 1.

For the month of January, the state will collect approximately $1.63 million in adult-use marijuana tax proceeds. Excise tax, which is 10%, accounts for $980,000 and $646,800 in sales tax.

The first $20 million earned in the first two years after the launch of adult-use marijuana sales would be used to fund research into cannabis use in the health care industry. Fifteen percent of the remaining amount from tax revenue would be allotted to cities, towns, or villages that allow the sale of marijuana within their jurisdiction. The proportions would be based on the number of micro-businesses and retailers operating in the regions. Another fifteen percent would also be allotted to counties based on the number of marijuana small businesses and retailers operating in the area. Thirty-five percent would be allocated to the School Aid Fund for K-12 education, and the remaining 35% would be assigned to the Transportation Fund for road and bridge repair within Michigan.

There was a slight increase in medical marijuana sales in the month of January ($25.2 million) up from $24.9 million in December.

It was also noted that the average cost of retail adult-use marijuana dropped from $516 per ounce in December to $512 per ounce in January, while the average price of medical marijuana increased to $276 per ounce in January from $267 per ounce in December.

In January, the Marijuana Regulatory Agency approved 24 new permits for adult-use marijuana licenses, which was less than the 32 permits approved in December. The agency also approved 53 medical marijuana dispensary licenses in January, which was an increase from 29 medical cannabis permits issued in December.

The agency also rejected three medical marijuana and nineteen adult-use marijuana applications.

Although the state experienced about 30% increase in recreational marijuana sales in January, the cost of administering licensing and registration of programs increased by 20%.

In January, Michigan spent $766,910 on medical licensing, which was an increase from $655,109 in December. While recreational marijuana licensing cost the state $556,892 in January, an increase from $444,720 in December. And, $280,389 went to the patient-caregiver registry in December but this increased to $412,419 in January.

The overall cost for Marijuana Regulatory Agency programs increased to $1.74 million in January from $356,000 in December, and about $1.16 million was used to pay salaries and benefits to the employees.

These costs are expected to level off while product sales and tax collections increase, so the future outlook is a positive one. Marijuana consumers are considering their wallets when purchasing weed, and all they want is cheap marijuana with high THC content.

In the past few years, several marijuana companies have developed high-quality, premium products, and these products are displayed on dispensary shelves. The companies believed that marijuana consumers would prefer luxurious marijuana products, just like the way beer consumers gravitate toward craft beer and aged whiskey in the spirits industry. The older generation and newbies are most likely to buy top-of-the-line marijuana to ease their concerns about the new world of cannabis, the companies thought.

Some of the marijuana companies thought that consumers would purchase a gram of weed at $100, but this is not happening. After Canada launched its marijuana market, marijuana consumers have shifted towards cheaper marijuana products, and mid-to-high quality products have lost their market share.

On a conference call last week, the CFO of Aurora Cannabis Glen Ibbott said that last summer, the Canadian marijuana market had only 2% of cheap weed in their supply. The number has now increased to 17% with cheap pot going for even less than C$9, which is equivalent to $6.79 in U.S. dollars. At the same time, the high-quality marijuana market share has dropped to 17% from the previous mid-30s.

The drop in the premium products market share has affected Aurora Cannabis very severely since the company’s primary focus is selling premium quality products.  In the past twelve months, Aurora Cannabis posted $1 billion quarterly losses, and its pot stock prices dropped by 80%. The CEO of Aurora Cannabis Terry Booth announced that he would be resigning and that the company would also implement a cost-cutting plan. Last week Aurora Cannabis announced the launch of a cheaper marijuana product known as The Daily Special.

Marijuana consumers are speaking with their wallets, and all they want is cheap marijuana that has a high THC concentration, meaning consumers want big highs at low cost. Speaking with MarketWatch, PI Financial Analyst Jason Zanderberg said that he expected that the demand for affordable marijuana would eventually arise and that many executives and insiders were caught unawares because it happened earlier than they had expected.

Zanderberg further said that although the production of marijuana is more than its demand in the market today, he did not expect the price of weed to drop this soon with just over one year since Canada legalized recreational cannabis.

420 with CNW – Kentucky House Passes Medical Cannabis Legalization Bill

On Thursday, the Kentucky House of Representatives passed legislation legalizing medical marijuana within the state.

This comes after the Judiciary Committee voted in the bill last week in a vote of 65-30. The Legislation now proceeds to the state Senate.

If the legislation is enacted into law, patients will be in a position to access medical marijuana from licensed dispensaries, but only after the patients have been certified as suffering from a condition found on the list of qualifying conditions. The legislation would also establish a body to develop rules to govern the program and determine the various medical conditions that individuals would be suffering from to access cannabis.

The legislation would also prohibit smoking of weed and would leave the regulators to decide if they should permit the use of marijuana edibles. A minimum of 25 dispensaries will be allowed to sell medical marijuana, according to the current form of the bill.

The legislation was sponsored by Rep. Jason Nemes (R). In his opening remarks, Nemes said that he is proud to have been involved in the drafting of the tightest medical cannabis bill in the industry. However, he was disappointed by the smoking ban because he believes that smoking is the quickest means of delivery and can be useful for specific ailments.

The legislation has a provision subjecting the gross receipts of marijuana sales from a farmer to processor to dispensary to a 9% tax. Eighty percent of the tax proceeds would be assigned to a general state medical marijuana trust fund, and the remaining 20% would be distributed to regions where marijuana businesses are allowed to operate.

Before approving the legislation, the lawmakers passed several floor amendments, and they include;

  • That the list of qualifying conditions must consist of at least chronic pain, epilepsy, multiple sclerosis and nausea or vomiting.
  • Families to return the remaining medical marijuana products to the dispensaries within ten days if the patient has died.
  • An amendment prohibiting the advertisement of medical marijuana businesses.
  • Allowing law enforcement to access marijuana sales data from licensed dispensaries
  • Banning the sale of marijuana vaping products to people under the age of 21.
  • Prohibiting dentists, podiatrists, and optometrists from prescribing or recommending medical marijuana.
  • Hospitals to report instances where medical marijuana patients are diagnosed with cannabinoid hyperemesis syndrome.
  • Prohibiting the sale of medical marijuana to minors and action would be taken against dispensaries that do so.

The chamber rejected a provision that would have increased the penalties for people selling marijuana purchased from the dispensary.

Matt Simon said that patients within Kentucky were relieved after the House approved the bill, but they are aware the legislation will face a considerable amount of challenges in the Senate.

Although a medical marijuana legalization bill was approved by the Judiciary Committee in 2019, it did not receive any floor action. It is uncertain how the current proposal will fare in the Senate, but the Senate President, Robert Strivers (R), agreed that 2020 might be different.

Strivers said that although there is a chance of the bill being approved in the Senate, it is minimal.

Kentucky Governor Andy Beshear (D) is in favor of medical marijuana legalization as it would help fight the opioid crisis.

A poll released last month showed that out of 10 residents of Kentucky, nine were in favor of medical marijuana legalization.

Industry watchers believe that cannabis companies like Willow Biosciences Inc. (TSX: WLLW) (OTCQB: CANSF) will be hoping that the lawmakers consider the needs of patients and pass this bill so that another treatment option is available to those who need it.

420 with CNW – New NFL Collective Agreement Could End Player Bans Due to Failed Marijuana Tests

On Thursday, NFL team owners approved a proposed collective bargaining agreement, which ensures that National Football League players would no longer be suspended from games for testing positive for marijuana. The agreement was then circulated to the players.

The new measure being floated for approval by the NFL Players Association would also reduce the number of players being subjected to marijuana testing. It also reduces marijuana and other drugs testing periods. The drug tests can be administered over a period of two weeks at the start of training camp instead of the current two months.

The three-page summary of the policy’s key terms includes an increase in the limit for positive THC metabolite tests from 35 to 150 nanograms.

Darren Heitner was the first to post the policy document on Twitter when he sent all the players a fact sheet covering the highlights of the current proposal for a new collective agreement.

Earlier this month, the details of the reduced penalties for NFL players who test positive for marijuana started in press reports. NBC Sports ProFootballTalk reported that suspensions would only be possible in the event of extreme and recurrent disregard of the policy or violations of the law on possession and consumption of marijuana.

If the NFL Players Association approves the agreement, the NFL would be the latest major sports league to loosen their restrictions on marijuana since the number of states in the U.S. legalizing marijuana is increasing.

In December of 2019, Major League Baseball announced that it would be removing marijuana from the list of banned substances and that it would treat cannabis consumption as alcohol.

In interviews, Jerry Jones, the owner of the Dallas Cowboys, and the New England Patriots quarterback Tom Brady, said that there is a likelihood that the NFL would amend its approach to marijuana on its players after the MLB change was announced.

The terms of the agreements were approved on Thursday by NFL team owners, while player representatives are scheduled to consider it on Friday.

The players association has been holding meetings in the past few weeks to decide if they should proceed with the agreement; however, if they do not make a decision very soon, it will be another year in which the players will be subjected to stringent marijuana policies within the NFL. Two-thirds of the association must approve the measure before March 18 for the policies to be valid for 2020-2021. The new league year begins on March 18.

420 with CNW – Undercover Investigators Lead to Administrative Complaints Against Florida Medical Cannabis Doctors

Two medical marijuana doctors are under investigation after Florida health officials filed a complained against them based on information obtained by undercover investigators posing as patients. A lawyer representing one of the doctors termed it as a trap.

The Department of Health in Florida filed both complaints on the same day in 2019, and are waiting for administrative law judges to take action. This is the first significant action taken by Florida against doctors prescribing marijuana to patients.

Tallahassee doctor, Joseph Dorn is one of the doctors being investigated.

The complaint stated that Dorn was the chief medical officer of Medical Marijuana Treatment Clinics of Florida between Feb. 2017 and Jan. 2018. During this period, Dorn issued 3,292 patients with medical marijuana, and each new patient had to pay $299 for the appointment.

Dorn is being accused of failing to conduct physical examinations of ‘Patient O.G’ and ‘Patient B.D,’ which violates medical marijuana laws.

According to the complaint, Dorn failed to do the following;

  • Did not assess the patients’ medical histories,
  • Did not diagnose the men with at least one qualifying medical condition
  • Failed to determine if the use of medical marijuana by the patients would outweigh the potential health risks, and
  • Did not review the patients’ controlled-drug prescription histories in the state’s database

Dorn is accused of making untrue and fraudulent representations in or related to medicine by recording false details in the men’s’ files to justify entering physician certifications for medical marijuana.

In November of 2017, Patient B.D saw Dorn and complained of muscle spasms and anxiety, but Dorn diagnosed him with post-traumatic stress disorder. Dorn asked the patient if he had been in any car accident, and the patient said he had eight years before the appointment but did not provide details about the severity of the accident. However, in his records, Don wrote that Patient B.D was suffering from PTSD because of trauma from the accident.

Patient O.G reported the second complaint against dorn, and his record shows that he was diagnosed with PTSD. Dorn went on to record a list of symptoms the patient was experiencing, but Patient O.G did not say that he had any symptoms.

Speaking to The News Service of Florida, Dorn’s Lawyer, Robert Beasley, said that the veterans’ group contacted him and stated that Florida health officials were going after doctors who used a PTSD diagnosis when prescribing medical marijuana. Many military veterans have PTSD.

Justin Davis, a Gainesville area doctor, was accused of violating state law by operating his office near the medical marijuana operator Trulieve’s office in Lady Lake. He was also accused of referring patients to Trulieve, as well as failing to determine if Patient K.G was pregnant. Patient K.G  was also an undercover agent.

Industry watchers believe that these compliants in Florida are going to be followed closely by the entire marijuana industry, including SinglePoint Inc. (OTCQB: SING), because it may have far-reaching repurcussions on the willingness of doctors to recommend medical marijuana to patients that can be helped.
