420 with CNW – LA Moves to Dismiss 66,000 Pot Convictions

State officials in Los Angeles say the people who are slated to benefit from the dismissal of approximately 66,000 past pot convictions include Latinos (45%), African American (32%), 20% are whites, and 3% consist of others racial groups.

The cases that were dismissed include 62,000 marijuana felony convictions that go back several decades, and 4,000 misdemeanor charges for possession, Los Angeles County District Attorney, Jackie Lacey said.

When California voters legalized adult-use marijuana after they approved Proposition 64 in November 2016, they passed the dismissal of simple marijuana crimes. The law also included provisions providing for the expungement of past convictions and the reduction of felonies to misdemeanors. In 2018, the state legislators approved another measure AB1793, which required the Justice Department to go through prior convictions in California and pinpoint marijuana convictions that are eligible for dismissal, expungement, or reduction to misdemeanors.

People of color are the ones that have mostly felt the impact of the fight against drugs, and the move to dismiss the convictions brings much-needed relief to the communities.

Pinpointing an estimated number of 200,000 cases within the state was not an easy task. For the records to be amended, the convicts were supposed to file their petitions as well as hire the services of a lawyer to help and speed up the process.

Code for America has offered all the 50 state district attorneys with their technology, Clear My Record.

The officials said that the Code for America technology would help in dismissing more than 85,000 cannabis convictions in five counties within LA, and they include San Francisco, Sacramento, San Joaquin, and Costa Rica.

In a statement, Code for America senior program director of criminal justice Evonne Silva said that it is possible to automate record clearance at scale, which would help right the wrongs of failed prohibition.

The computer technology, Clear My Record, identifies the qualified cases and automatically fills out the documents to file with the courts. The technology can also analyze more than 10,000 marijuana convictions at a time when checking for eligibility, instead of having county employees go through individual records.

The decision on whether to dismiss the sentences or oppose a reduction in convictions, is due in July, and the district attorneys are expected to present their decision.

Prosecutors in other cities such as Baltimore, Seattle, Chicago and other cities said they would also clear simple marijuana convictions.

This move to use technology to speed up the process of expunging past convinctions is likely to be welcomed by the entire cannabis industry, including companies like MCTC Holdings Inc. (OTC: MCTC), who see thes justice reforms as long overdue.

420 with CNW – Alabama Senate Bill Seeks to Legalize Medical Marijuana

Southeast and Midwest states in the U.S. are historically conservative, and they are opposed to the legalization of marijuana in any form, but in recent years, several states such as Florida and Louisiana have been adopting marijuana reform for legalizing medical marijuana. And Alabama is among the 17 states where medical marijuana is still illegal. But new legislation which was introduced last Tuesday in the state Senate by Senator Tim Melson is seeking to authorize medical marijuana.

The legislation SB 165, which would establish the Compassion Act, would allow the state of Alabama to legalize certain forms of medical cannabis, create cultivation programs, and administer and tax the sales of marijuana products. However, even if the bill is approved, people are not expected to smoke or vape weed legally within the state.

The bill was introduced last week following an intensive study by a commission composed of doctors, legislators, and lawyers. The study commission was chaired by Senator Melson.

The bill states that people with specific ailments or conditions such as anxiety, cancer, and other chronic conditions would be allowed to get a medical marijuana card. However, the legislation prohibits any form of marijuana smoking, vaping, or edibles within the state. The type of marijuana products patients’ are allowed to consume include pills, gelatinous cubes or lozenges, topicals ( creams or oils), suppositories, transdermal patches, nebulizers, and inhalers.

Patients who do not suffer from any of the conditions listed on the list of qualifying conditions within the state could appeal to the board for special considerations.

Once the legislation is approved, Alabama would be the 34th state to legalize medical marijuana in the U.S. while adult-use cannabis is legal in 11 states, including Washington D.C.

Alabama is not the only state in the U.S. joining the rest of the country; earlier this month, Kentucky advanced a bill seeking to legalize medical marijuana.

The Alabama legislation would enact stringent controls on the people cultivating and selling medical marijuana.  They would employ the use of electronic trackers to keep tabs on the inventory as well as the card holders. Medical marijuana products would also be subjected to a sales tax of 9%, and some of the tax revenue would be used to fund the operation of the medical marijuana program within the state.  The state would also create a unique account for the Medical Marijuana Research Fund.

If the bill is approved and the governor signs it, it would immediately become law. 420 with CNW – Research Shows Marijuana Edibles THC Labels Need to Be Improved

A new study has found that the majority of young adults do not comprehend the levels of tetrahydrocannabinol (THC) in the advertised marijuana edibles. However, researchers have suggested a new manner of communicating the concentration of THC as well as other information on the product labels.

The new study tested the efficacy of THC labeling on marijuana edibles. Between 2015 and 2016, research shows that in the United States, about ten percent of the adult population and approximately twenty-four percent of the youths had consumed marijuana within the past year.

And since then, marijuana consumption has been on the rise. A study conducted on teens in the state of California showed that thirty-three percent of teens in grades 9-12 had consumed marijuana at one point in their lives and that the majority of them had consumed edibles.

Edibles include products such as cookies, brownies, and candies that are infused with marijuana. Over the last couple of years, marijuana edibles have gained immense popularity. This has raised concerns because their marketing is almost similar to that of ordinary sweets; thus, attracting underage consumers. Most often, consumers underestimate the effect of marijuana edibles because they may not be aware of the THC concentration therein. THC is the psychoactive compound of marijuana.

The new research sought to shed light on the ways to determine the level of THC in edibles as displayed in the labels as well as how different labeling systems communicate the information to young adults.

The final and corresponding author of the study, is a professor at the University of Waterloo School of Public Health and Health Systems in Canada, Prof. David Hammond. The research findings can be found in the Journal of Drug and Alcohol Dependence.

The motivation to study and examine the levels of THC in edible marijuana product labeling is because using the THC number to express the product potency has little meaning to young consumers in Canada, Prof. Hammond explained.

He further said that for years people have struggled to understand the details on food packages. And, it is more challenging for marijuana consumers to understand the THC numbers indicating the potency of the marijuana product listed on the product labels.

Prof. Hammond and his team of researchers conducted two experiments to examine how well various labels transmit information about marijuana potency.

They conducted an online survey where they used 870 respondents between the age of 16 -30 in Canada.

In the first experiment, the researchers used three labeling conditions, no label, a label that explained the THC content in milligrams, or a label that used ‘doses’ of THC per package, and assigned the respondents randomly.

In the second experiment, the researchers used the traffic light system to indicate potency. Green was low and red high potency. During this experiment, they also tested the effectiveness of no labels, labels with percentages, and those with THC in milligrams.

The researchers found that labeling in doses per package elicited the best understanding of a serving of THC, with over 54% of the respondents attesting to it.

The traffic light system also enabled the respondents to identify the THC concentration, whereby 85% of the participants accurately identified products with low THC levels, and 86% identified products with high levels of THC.

In conclusion, Prof. Hammond and his team of researchers said that few consumers could understand and apply quantitative THC labeling.

The study findings further suggest that other products such as oils, concentrates, and buds will need more straightforward THC labeling.

420 with CNW – Proposed Law Seeks to Protect Privacy of Maine Marijuana Companies

The lawmakers in the state of Maine are considering approving a proposal that provides a cloak of secrecy about the imminent adult-use marijuana sector.

The legislation L.D. 2091, which was written by the legislators within the state of Maine, would exclude trade secrets, security, and operating protocols provided to the state by marijuana businesses from public records law.

The state of Maine claims that the proposal would enclose in protections for cannabis business proprietary information, such as recipes for marijuana edibles.

The spokesperson for the Office of Marijuana Policy in Maine, which drafted the legislation L.D.2091, David Heidrich said that it would be the responsibility of the legislature to determine if the benefits of an exclusion outpace the need for public review.

Speaking to Portland Press Herald, Heidrich said that the Office of Marijuana Policy believes that the proposal outweighs the inability of public review.

The legislation aims to modify the Freedom of Access Act to remove application materials provided to the Office of Marijuana Policy relating to trade secrets, security, and standard operating protocols from the definition of ‘public record.’

Public records advocates and journalists have openly criticized the bill. The association that represents all the state’s daily papers within the state, The Maine Press Association, is also opposing the bill.  A lawyer in the state of Maine, Matt Warner, said that the Freedom of Access Act has been acting as a weapon between competitors in the state’s legal marijuana marketplace. Warner said that the Freedom of Access Act is an essential fundamental public right.

Voters approved the legalization of adult-use marijuana within the state in 2016. Marijuana businesses are expected to launch and start serving customers in the spring of 2020.

The state started accepting permit applications for recreational marijuana sales as well as license applications for growing and manufacturing cannabis in December 2019. Recreational marijuana was approved by voters back in 2016, and the delay in launching adult-use marijuana law on cultivation, manufacturing, and sales has been due to the legislation blockage imposed by the state’s Governor Paul LePage.

The governor opposed the bill in 2017, hence the law couldn’t be passed.

In his veto letter, the governor said that the dangers of legalizing cannabis and normalizing its consumption in the society should not be understated. He further noted that the state is dealing with a severe drug epidemic that causes the death of more than one person a day through opiate overdoses. LePage also said that legalizing marijuana would be telling the young adults in the state that some drugs are legal within Maine, and this could result in unintended and grave consequences.

The election of a new governor, Janet Mills, helped speed up marijuana reform by signing legislation that established regulations governing the sale of adult-use marijuana in June of 2018.

It remains to be seen what pot companies like Lexaria Bioscience Corp. (CSE: LXX) (OTCQX: LXRP) think about this move to exclude sensitive proprietary marijuana business information from the ambit of the Freedom of Access Act in Maine.
