420 with CNW – Democrats in Congress Cede to Senate’s Position on Veteran-Related Marijuana Provisions

Democrats in Congress have abandoned two marijuana proposals that were veteran-based and previously approved by Congress as part of their large-scale defense bill.

The House approved its version of the National Defense Authorization Act (NDAA) this summer. The legislation had several changes that would prevent the United States Department of Veteran Affairs from denying the veterans’ home loans applications due to their employment status in the legal marijuana sector.

The bill had another policy that would have allowed the military branches to reenlist service members convicted of single simple marijuana offenses.

However, the Senate did not have similar proposals in their legislation, but the leaders from the two bodies agreed to scrap some of the additional policies during the negotiations.

The Democrats did not cede on all the amendments that were not similar to the House legislation; but, both parties made compromises on the amendment proposals where the House withdrew about 630 provisions while the Senate ceded approximately 600.

The House conference negotiators did not view the marijuana measure as a priority. However, according to the sponsors of the bill, marijuana policies were to be prioritized as they represented urgent needs for the veterans and service members.

The home loan amendment provisions were made by Rep. Katherine Clark (D-MA). In May, Clark circulated a sign-on letter addressed to Veteran Affairs. The letter raised the issue and noted that a veteran in her district was denied home loan benefits because he was working in the marijuana industry.

The reenlistment waiver proposal was sponsored by Rep. Ruben Gallego (D-AZ). During a committee hearing in June, Gallego stressed that the country needs to think about military enlistment policies regarding marijuana felonies, especially looking at the recruitment crisis.

Gallego further said that the country’s views on marijuana consumption are changing, and the military has adjusted its recruitment process. He also noted that where necessary, the military can grant waivers to former simple marijuana convicts who want to serve their country.

According to a summary of the legislation, the House conference negotiators agreed on a bill funding “drug interdiction and counter-drug activities” by giving them $1 billion. The bill also calls for an assessment of the impact of any planned border wall construction would have on the quantity of narcotics entering the U.S. The bill includes the Fentanyl Sanctions Act, which puts in place several economic and financial sanctions to cease the operation of international opioid traffickers.

It is uncertain if the House Democrats will fight for the marijuana reform language in the appropriations negotiations. The current temporary spending legislation expires on December 20, and their goal is to finalize the full 2020 Fiscal Year appropriation before the expiration date.

In June, Rep. Earl Blumenauer (D-OR) withdrew a policy that would have permitted Veteran Affairs to prescribe medical marijuana to military veterans during the House consideration of the VA appending bill.

Analysts believe that cannabis industry actors, such as HTC Extraction Systems (TSX.V: HTC) (OTCQB: HTPRF) and Lexaria Bioscience Corp. (CSE: LXX) (OTCQX: LXRP), may not be too pleased that veterans will continue to be victimized for their involvement in state-legal marijuana programs.

420 with CNW – Poll Finds Most Kansas Residents in Favor of Marijuana Legalization

A new survey carried out by Fort Hays State University in Kansas shows that the majority of the state’s residents are in favor of recreational marijuana, and they are in support of the industry’s taxation.

The Annual Kansas Speaks survey used opinions of Kansas residents on a myriad of public policy issues such as Medicaid expansion and weapons control. The report, which was released last week, revealed that more than 63% of the participants are in support of legalizing and taxing adult-use marijuana.

About 26% of the respondents are opposed to marijuana legalization efforts, while 11% of the participants were neutral on marijuana law reform.

Although support for marijuana legalization is backed by the majority of the state’s electorate, marijuana remains illegal even for medical use. However, marijuana may be legalized in the state of Kansas in the near future.

Lawmakers in Kansas took the first steps in advancing the marijuana reform in October. Ohio’s medical marijuana program limits the patients to a 90-day supply and also bans smoking of weed. The Special Committee on Federal and State Affairs requested the legislature to benchmark Ohio’s medical marijuana program. They also included the prohibition of vaping medical marijuana in the legalization proposal.

Senator Oletha Faust-Goudea (D) said that the legislation is bound to pass, and it is their responsibility to sit at the negotiation table and perfect the law to serve the people better.

Governor Laura Kelly (D) also said that she is in favor of medical marijuana.

Local towns and cities in Kansas are also moving forward with marijuana reform. Lawrence City Commission, for example, suggested a decrease in the criminal charges for possessing small amounts of weed to a fine of $1 and $63 in court costs. The motion garnered 4-1 votes in favor of the ordinance, which applies to first and second convictions. Third level offenses are felonies, and they cannot be processed in municipal court.

Lawrence Mayor, Lisa Larsen, said that the move by the city’s leaders was initiated to keep unwarranted charges off the city’s residents’ legal records.

She further said that her motive is to bring some reasonable and equitable justice to the people of Lawrence City.

According to a news release, the Kansas Speaks survey was conducted through phone interviews, whereby the researchers interviewed 352 residents from the month of August 26 to October 14, 2019. The study is the state’s only yearly research of Kansas residents’ views on issues relating to public affairs. The survey margin of error was 5.2%, with a 95% accuracy level.

420 with CNW – Top Vermont Health Official Endorses Recreational Cannabis Legalization in the State

During a radio interview on Monday, Cynthia Seivwright, the director of the Department of Health’s Alcohol and Drug Abuse Program in Vermont, said that compared to the current policy, public health would be better protected by regulating marijuana commerce in the state.

She made the remarks on WDEV’s Dave Gram Show while discussing the relationship between cannabis-related health issues and Vermont’s failure to regulate marijuana. Vermont goes down in the U.S. history books as the first to legalize marijuana by an act of lawmakers. The bill was then signed into law by Governor Phil Scott. The legislation permits low-level possession and household cultivation of marijuana but prohibits the sale of weed.

When asked if a regulatory model similar to that of alcohol would apply for marijuana, Seivwright said that without proper regulation, it would be impossible to know what it contains, nor would they be able to control the potency. She further added they would not be able to control accessibility.

Seivwright further said that marijuana should be tested in an independent lab. The packaging should not be appealing to kids and should be fitted with childproof caps.

Dave Silberman welcomed the marijuana legalization support exhibited by the Department of Health. Silberman is an attorney and pro bono drug reform advocate from Middlebury.

Speaking to a online marijuana industry publication, Silberman said that Vermont residents from all political parties are eager to pass a reliable system of regulation that prioritizes consumer safety and generates revenue. The revenues can be used by the Health Department to establish broader addiction prevention and treatment efforts. He further said that a robust regulatory system is better than just sitting pretty and wishing for a drug-free country. Silberman also noted that the Health Department is embracing a fact-based approach to marijuana, which aims at minimizing harm instead of stigmatizing the drug.

The state Senate passed the legislation legalizing marijuana sales, but the measure did not reach the House floor despite having passed at the committee level.

VT Digger reported that the House Speaker Mitzi Johnson (D) said that there is no guarantee that the legalization bill will pass in 2020 despite the Democratic leaders’ optimism of its advancement.

Johnson also noted that for the bill to be approved in the House, it would have to garner a minimum of 76 votes, and this shows that she has no intention of rounding up support. She further said that before approving the bill, issues such as youth consumption, roadside safety, and impact on the environment should be addressed.

Johnson’s stand on the bill is in contrast with the state’s Democratic Party, because it included marijuana marketplace legalization on its campaign platform in 2018.

When the bill failed to advance to the House, the Majority Leader Jill Krowinski assured the bill’s supporters that her party is committed to the legislation and that they would pursue it in 2020.

Industry watchers are strongly convinced that the words of the House Majority Leader don’t carry any weight before the cannabis industry, including entities like Green Hygienics Holdings Inc. (OTCQB: GRYN) and Plus Products Inc. (CSE: PLUS) (OTCQB: PLPRF), that would rather see concrete action instead of promises and speeches.

Major League Baseball (MLB) is making a brave move by removing marijuana from the list of banned substances for minor league players. The agreement has not been finalized, but the MLB and MLB players’ unions are discussing the terms of the new policy.

In a tweet, The Athletic’s Ken Rosenthal said that as part of the new agreement on opioid negotiations between MLB and the players’ union, MLB would remove marijuana from the list of banned substances for the minor leagues. Rosenthal also noted that Major leagues are not subjected to marijuana tests.

The agreement is for minor league players who are not on the 40-man roster and are eligible to be included in the active roster.

In 2019 alone, 13 players have been suspended for ‘drugs of abuse,’ which is a term used to refer to weed. Currently, penalties for positive drug tests are stringent. If the first test is positive, the player is suspended for 25 games, 50 matches if the second test is positive, 100 games for a third, and lifetime suspension if a fourth test is positive.

Since 2002, players in the major league 40-man roster have not been regularly subjected to marijuana tests. They are only tested if there is a possible cause. A positive THC test results in a $35,000 fine and a treatment plan, but the players are not suspended.

The list of abused substances on the ban list for the MLB players includes cannabinoids, THC, human-made THC, and cannabimimetic (K2 and Spice), cocaine, LSD, opiates (such as heroin, codeine, oxycodone, and morphine), MDNA, and PCP.

MLB players’ union chief, Tony Clark, is positive that the two will agree at the end of 2019. The deal being negotiated also includes testing of opioids and the establishment of a recovery plan. The CBD Sports reported that the players in the Minor League who test positive for opiates would be enrolled in a treatment program instead of being suspended.

In October, the Los Angeles Times reported that very soon, changes will take place in the MLB at the directive of the players union. The agreement being negotiated is in response to the opioid crisis and the Angeles pitcher Tyler Skaggs, who passed on earlier this year due to a drug overdose. Skaggs overdosed on Oxycodone, Fentanyl, and alcohol. The drugs were found in his system after his death.

When it comes to marijuana usage, the MLB is known to be progressive; however, other league sports are slow to adopt marijuana reforms.

Although hemp and its derivatives are legal in the U.S, the PGA issued a directive stating that its golfers are not allowed to use CBD. The NFL reduced the penalty on marijuana usage, but since then, no further step has been made on the marijuana policy.

In 2017, the World Anti-Doping Agency cleared CBD use by athletes. It remains a permitted substance to date. Experts are of the view that cannabis companies, such as ChineseInvestors.com Inc. (OTCQB: CIIX) and Canopy Rivers Inc. (TSX: RIV) (OTC: CNPOF), long for the day when all athletes will have no fear about using cannabis for medical purposes.
