Good ideas are cast aside, and bad ideas become law in lame-duck legislative sessions. The New Jersey Senate President Steve Sweeney announced that the Senate would attempt to legalize the possession and use of recreational marijuana. This will be a test of whether this good idea will go to waste or be brought to life.

Despite the overwhelming support for the decriminalization of the possession of small amounts of marijuana, legalization supporters have been unable to get a majority vote in the legislature. The legalization issue was scheduled for discussion in March, but it has been dormant from the time a headcount revealed that it would be short with a few votes and so voting was abruptly called off at the time.

Since then, it is unlikely that the quest for the required majority has produced any fruit because the opposers of the legislation were joined by others who were objecting to other marijuana provisions such as oversight, licensing, sales outlet locations, tax rate, and revenue allocation.

He wanted the legislation to address some of these issues, but the opposition objected to the proposed changes. The members of the clergy oppose the legalization of marijuana, terming it as a means of profiting the investors at the expense of the weak while inflicting harm to the communities that are greatly affected by the war against drugs.

The leader of opposition in the Senate, Newark Senator Ron Rice, said that the people who will benefit most from legalization are outside investors. He also predicted that the legalization of recreational marijuana would destroy urban communities’ quality of life while severely damaging the health and welfare of the youth.

The supporters and the opposers of marijuana legalization will present evidence to support their positions during the fresh debates. They will present evidence that shows if marijuana contributes or does not contribute to road accidents, if the functioning of the brain is impaired or not or if using marijuana for prolonged periods affects or does not affect cognition.

Urban mayors whose cities have been affected by the war against drugs made compelling cases insisting that their cities should get the larger share of tax revenue due to the suffering inflicted on their communities. They also demand to be given priority in sales licenses and retail outlets.  The legislative supporters are faced with the challenge of giving in to their demands because it is unlikely they will change or lessen these requirements.

If the Senate does not approve the legislation, Sweeney’s fall back plan is placing the bill in the 2020 ballot box for voters. The ballot would pass the bill due to the increased turnout since it is a presidential election year.

During his campaign the now Governor Murphy said that he would ensure marijuana would be legalized within the first 100 days of his term, but now it is two years since the election and weed is still illegal.

The most challenging issue Governor Murphy has handled during his term is marijuana legalization, but he is still positive that the legislators will come around and approve the proposal. One would be justified to believe that marijuana companies like The Supreme Cannabis Company Inc. (TSX.V: FIRE) (OTCQX: SPRWF) and SinglePoint Inc. (OTCQB: SING) are a bit skeptical about the chances that New Jersey will legalize recreational marijuana legislatively this year.

420 with CNW – University of Texas Scientists Develop Rapid Marijuana Test

In the U.S., marijuana is one of the most used federally illegal drugs. There are no federal regulations governing marijuana use, leaving law enforcement with the challenge of identifying impaired driving.

A team of researchers at the University of Texas in Dallas has developed a biosensor that uses saliva to detect the levels of THC on a subject in one minute.

Their study was published in Nature Scientific Reports in September. The biosensor device will help in the roadside assessment of THC consumption. It works the same way as those testing for alcohol-impaired driving.

Dr. Shalini Prasad, who is one of the researchers and an interim department head of bioengineering in the Erik Johnson School of Engineering and Computer Science, said that even though marijuana is not legal in Texas, there are conversations geared towards that end. She furthers says that there are no devices that can accurately determine the levels of THC in a subject.

THC is the active component of marijuana that has the potential to affect memory, mobility, focus, coordination, decision-making, sensory and time perception of the consumers.

According to Dr. Prasad, marijuana effects vary from person to person and determining how it affects the population as a whole is much more complicated than it is for alcohol. However, there are several studies on the metabolism of marijuana.

Previously the team had developed a biosensor that uses sweat to determine the level of glucose in the body. But, it takes too long for marijuana to leave the body through sweat, thus, testing sweat for marijuana is not suitable for ensuring road safety. Testing impaired driving through blood tests is also time-consuming, invasive, and requires medical expertise, which not all law enforcement members are equipped with.

Prasad further said that time is crucial when developing technology meant for public-assessment. The team set out to develop the device after noticing a gap when they reviewed the existing technology. She also explained that the faster the test is conducted, the better and the easier it is to ensure public safety.

Using saliva is the best alternative as it is not invasive, and it does not require much time to get accurate results. Just get a swab on the cheek, and you have your testing sample. Some kits can even be used at home, but they require more caution when handling them, said Prasad.

The biosensor uses the electrochemical activities of the molecules to determine THC concentration. However, the method still has its complications, such as the presence of other molecules in saliva, which makes it difficult for the biosensor to pick THC metabolites. Another complication is acidic saliva, as it tends to camouflage electrochemical signals, but they overcame this hurdle by designing a lubricant that amplifies the metabolite signal.

The team worked for a period of three years, on and off to develop the saliva biosensor, which has a 95% accuracy. The team has hopes of partnering with researchers working closely with marijuana metabolism to perfect their device.

Experts suggest that the marijuana industry, including actors like Green Growth Brands Inc. (CSE: GGB) (OTCQB: GGBXF) and HTC Extraction Systems (TSX.V: HTC), may still have strong reservations about marijuana impairment test kits since there is no agreement regarding the standards upon which someone can be regarded as impaired.

420 with CNW – Congressional Committee Votes to Repeal Law Denying Students Aid Due to Drug Convictions

On Thursday, a Congressional committee approved legislation repealing the federal law that punishes college students who are ex-convicts of marijuana charges by denying or stripping them of their financial aid. The rule was enacted in 1998, by the Higher Education Act Aid Elimination Penalty. It has denied thousands of students’ access to means of paying tuition because of minor marijuana offenses.

Marijuana critics said that denying students access to financial aid is a counterproductive way of responding to drug use and misuse. According to the executive director of Students for Sensible Drug Policy, Betty Aldworth, the best intervention amongst the youth is providing them with quality education. She further noted that denying them access to means of furthering their education harms the students and the communities.

Apart from removing the penalty, the drug conviction question on the Free Application for Federal Student Aid (FAFSA) is also to be removed by the House Education and Labor Committee.

In 2006, the rule was amended from all past offenses to those convicted while on financial aid programs. Marijuana advocates said that the FAFSA question is unclear, and this has caused many eligible students not to apply.

The deputy director of national affairs for the Drug Policy Alliance, Grant Smith, said that they are aware that the question confuses students whereby those who have had an interaction with the police may not complete the FAFSA application process after deeming themselves unqualified.

The HEA legislation reform is to be eventually voted upon by the Senate, and it is uncertain if the Republican-controlled chamber will approve the drug penalty repeal.

Several advocacy groups are working to delete the drug conviction penalty and reinstate the financial aid accessibility to incarcerated college students. These include the SSDP, DPA and other stakeholders associated with Unlock Higher Ed Coalition.

According to Aldworth, young people’s opinions are crucial for the success of movements geared towards social change because they are the ones who are directly affected by injustice. He went ahead and said that SSDP has been working for the last 20 years to make education accessible to all Americans, particularly those who are caught using drugs.

The coalition brought those affected by the federal law to Capitol Hill to meet with the legislators and staffers to show how the rule affects criminally convicted students, and to show that only those who need the financial aid are affected, said Smith.

The advocates also noted that people from families that are financially stable do not have to worry about losing their financial aid over marijuana or any other drug conviction. They further argued that the law to be repealed is discriminatory because it is enforced more strictly on people of color, even though almost all people, irrespective of color, use drugs.

According to Aldworth, black youths are affected by the federal rules just as the black people are the main targets of war against drugs.

Earlier this year, Senator Cory Booker filed a legislation calling for the removal of drug conviction question from the FAFSA. Analysts are uncertain as to what marijuana companies like Willow Biosciences Inc. 420 with CNW – Mexican Supreme Court Extends Marijuana Legalization Deadline

The Mexican Supreme Court has extended the deadline for marijuana legalization, which it made last year when lawmakers were given up to  October 31 to change the policy on prohibition of personal use or cultivation of marijuana by terming it unconstitutional.

The previous ruling had stipulated that the policy be changed by  October 31, but it has now been extended to April 30, 2020.

The Mexican Supreme Court granted the extension on Tuesday but publicized it on Friday. Last week, the committee submitted a comprehensive marijuana legalization bill to the Senate. Due to the additional time granted by the Supreme Court, the Senate is going to break down the legalization bill and begin debates on it this week.

The lawmakers requested the extension on Tuesday last week after seeing that it would be impossible to conclude the debate and vote before October 31. Their motion of deadline extension was approved by the court, which noted the complexity of the process. They also observed that the circumstances for the request were unique and exceptional.

Some of the concerns to be discussed by the lawmakers include the monopolization of the marijuana industry by multinational marijuana corporations once they join the legal market. Marijuana advocates have also complained about the strict policies regarding the number of marijuana plants to be cultivated at home.

The legislation which was approved last week by the committees stipulated that 20% of the licenses be awarded to economically disadvantaged persons. The bill also stated that people who are 18 years and above could possess, purchase, and consume marijuana. It also allowed people to cultivate up to four marijuana plants.

Since the Supreme Court ruling, the legislators have been submitting various bills that were used to make the legislative reforms. The policies were also developed from the input gathered from the solicited public information on reform proposals.

The Senate might add several policies to the legislation since they have six months to act on the legislative reform. The Senate Health committee also filed a new bill this week. The bill might be added to the proposed changes because the advocates feel that it is an improvement to the last proposal, which was to be voted on. For instance, the new legislation allows people to grow a maximum of 6 plants and possess a maximum of 30 grams of marijuana; however, the new bill prohibits edibles and THC-infused beverages.

The Mexican Senate has not reached a consensus about marijuana legalization in the country and how it should look. But, the leaders still insist that they are close to finalizing the comprehensive marijuana legalization plan. The Senate leader of the MORENA Party, Senator Monreal, said that the Senate would vote on the bill in the first weeks of November. However, after the Supreme Court extended the deadline by several months, it is not yet clear if he will also extend further.

After approval by the Senate, the legislation will be forwarded to the Chamber of Deputies and, finally, the president’s desk.

It would be interesting to learn what established cannabis companies like Neutra Corp. (OTC: NTRR) and Organigram Holdings Inc. (TSX: OGI) (NASDAQ: OGI) have to say about the possible regional implications of marijuana legalization in Mexico.
