420 with CNW – Connecticut Lawmakers Approve More Medical Marijuana Qualifying Conditions

The lawmakers in Connecticut have allowed more medical marijuana qualifying conditions. On Tuesday, the General Assembly Regulations Review Committee added five qualifying conditions for adults. Two of the five conditions are intractable neuropathic pain and Tourette syndrome. Patients under the age of 18 with the two ailments were are also approved to use medical marijuana.

In a written statement, Michelle H. Seagull, the Consumer Protection Commissioner, thanked the members of the Regulations Review Committee and the Board of Physicians for the addition of the qualifying conditions. She further said that it is good to know that medical marijuana will be available to more patients who are suffering from debilitating diseases. Seagull is also looking forward to working on the program.

The regulations will be submitted to the Secretary of State’s office to be finalized, and then posted online.

In addition to the two approved conditions, the General Assembly Regulations Review Committee also approved interstitial cystitis, median arcuate ligament syndrome and vulvodynia, and vulva burning. Chronic pain was approved by the Medical Marijuana Program Board as a qualifying condition last month; however, the Regulations Review Committee did not vote for it on Tuesday.

In Connecticut, 37,080 patients are participating in the medical marijuana program. Currently, there 36 qualifying conditions for adult patients and ten qualifying conditions for patients under the age of 18.

There are 15 medical marijuana dispensaries and four producers licensed to operate within the state. Three more dispensaries are in the process of being opened after they were issued with licenses.

The medical marijuana program was launched in 2012. At that time, there were only 11 qualifying conditions. These included cancer, glaucoma, and PTSD (post-traumatic stress disorder). The program has expanded over the years to include other conditions such as cystic fibrosis, cerebral palsy, muscular dystrophy, and other terminal illnesses that require end of life care.

The legislators approved Medical marijuana for minors in 2016, and their qualifying conditions included severe epilepsy and uncontrolled intractable seizure disorder.

The state approval process is still ongoing for the additional qualifying conditions so it is expected that as more information becomes available regarding other conditions which can be managed using medical marijuana, the responsible body will receive testimony on the same and add those conditions without having to involve the lawmakers.

This approach of modifying the list of qualifying conditions without the seeking approval from lawmakers I a good one because it saves a lot of time and sidesteps partisan politics which can at times derail otherwise good programs.

420 with CNW – Marijuana Legalization Support Undiminished by Vaping Injuries, Gallup Poll Finds

According to a survey released by Gallop on Wednesday, two-thirds (66%) of all Americans are in favor of legalizing marijuana. This shows that the support for marijuana policy reforms has not dwindled in the face of the vaping-related injuries outbreak despite the opponents investing their efforts to pin this on marijuana legalization.

Gallup has been polling on marijuana legalization since 1969, and in 2005 the support was at 36%.

In the analysis of the latest figures, Gallup’s Jeffrey M. Jones wrote that the states’ and public opinion have increasing become pro-marijuana.

In the U.S, 11 states have legalized marijuana for recreational use while others plans on doing it during the 2020 legislative sessions. Others are opting to refer the matter to voters during the coming elections.

Jones further wrote that when supporters of marijuana legalization are based on gender, education, income, region, urban or rural, the difference is insignificant because 60% to 70% of them are in favor of legalization. However, the difference is significant across party lines with 51% of Republicans and 76% of Democrats in favor, while 68% of independents also favor the reforms.

All key Democrats except former Vice President Joe Biden are in support of marijuana legalization.

Although it is still unclear if President Donald Trump prefers federal legalization laws, he seems to be for the states to set their own marijuana policies, said Gallup.

Trump has openly said that if a bill is introduced paving way for states to be allowed to enact their cannabis laws without federal interference, he will sign it into law.

According to the new survey by Gallup, the majority of Americans irrespective of the age (as long as you are under 65) support legalization while 49% are opposed.

The overwhelming support of 81% for marijuana legalization is by Americans under the age of 30.

Gallup found that the majority of racial and ethnic groups are in favor of legalization; however, less support is noticed in the Hispanics.

Gallup’s recent survey, which included 1,526 adults, was conducted amidst daily news and health bulletins of hundreds of people suffering from a lung-related injuries linked to vaping cannabis products.

Rep. Andy Harris and Smart Approach to Marijuana, which is a prohibitionist organization, argue that the states and the advocates for legalization should slow down on the push for the reforms in the face of the recent outbreaks.

Only a handful of people affected got the vaping products from licensed dispensaries; most of those affected purchased from the illegal market.

Despite the several warnings and the negative press, the majority of the Americans are still in support of legalization and regulated sales of marijuana, said Justin Strekal, the NORML Political Director. He further added that it is imperative to end prohibition and adopt best practices for the regulatory authorities to oversee a thriving consumer marketplace.

In conclusion, Gallup wrote that there is a probability that the support for legalization will continue to expand in the years ahead due to generational differences.

420 with CNW – Michigan Jittery About Availability of Recreational Marijuana

After adult-use recreational marijuana was legalized in Michigan last year, people went to the stores licensed to sell only to realize that they needed medical certification from the state to be able to purchase pot.

One year later and Michigan residents still cannot walk into a store and buy weed.

However, this may soon be possible in the first quarter of 2020. That is if the  Marijuana Regulatory Agency accepts applications from businesses possessing medical marijuana licenses this fall. Since medical marijuana businesses have passed the rigorous licensing process, it will be quicker and easier to issue recreational selling licenses to them.

It may be a long wait before the sale of any adult-use marijuana begins because owners of the medical marijuana dispensaries are complaining about lacking enough quality products to stock their shelves, which begs the question of where the sellers will get enough recreational marijuana supplies whose market is almost ten times that of medical marijuana.

Currently, all the licensed marijuana growers are growing medical cannabis, and this includes the caregivers who are allowed to grow weed for their patients. Before, the caregivers used to sell their excess stock to dispensaries, but the MRA prohibited the act in June. Medical cannabis cannot be sold as a recreational weed.

According to Robin Schneider, the executive director of the Michigan Cannabis Industry Association, the MRA rules allow for surplus medical marijuana to be used for recreational purposes if the department approves it. However, this is not possible if there is a shortage of medical marijuana, as it would entail denying the patients medication.

Currently, there is no surplus, and it is not possible to grow recreational marijuana as licenses are yet to be approved. No one has an accurate answer regarding when residents of Michigan will be able to walk into a store and buy legal cannabis.

According to the CEO of GROW Cannabis Marketing in Royal Oak, Mort Meisner, medical marijuana shortages are still a big challenge, and the MRA, together with the growers, should take action to increase availability.

Since licenses for recreational marijuana are yet to be issued, the market will still be in shortage, and the adult-use consumers will continue procuring their weed from the black market. Meisner says the shortage and lack of licensing are due to poor leadership since the agency was created last spring by Governor Gretchen Whitmer.

One is left wondering what suggestions industry actors like Neutra Corp. (OTCQB: NTRR) and Sugarmade Inc. (OTCQB: SGMD) would have for fixing this needless shortage once and for all.

420 with CNW – Judge Upholds Massachusetts Vaping Product Sales Ban

On Monday, a Massachusetts judge, Douglas Wilkins, refused to reverse the ban on the sale of vaping products, which was adopted after the outbreak of lung illnesses associated with e-cigarettes. However, he instructed the state of Michigan to modify the ban and solicit public comments.

Judge Douglas Wilkins from Suffolk County Superior Court’s ruling was a partial win for Charlie Baker, a Republican Governor who, in response to the outbreak of the lung illnesses, adopted the strictest sales ban. However, Judge Wilkins said that by issuing the ban, Baker overexerted his powers. The judge issued an order that would stop the state from enforcing a ban on the sale of nicotine-vaping products unless defects were detected in the products.

The judge said that by October 28, through an emergency regulation, Baker should reissue the ban and give the vape shops as well as the members of the public a chance to comment.

Products containing THC, which is the psychoactive compound of marijuana, are legal in the state; therefore, they will not be affected by the ban.

Baker’s administration was responsible for ensuring that the order was issued correctly as they prepared for the next steps, said Lizzy Guyton, Baker’s spokeswoman.

The business association was not happy about the ban and said they are working to block it. The group said the ban is a threat to the state’s $331 million nicotine vaping industry, said Tony Abboud, VTAs executive director.

According to the United States Centers for Disease Control and Prevention, the number of e-cigarette lung-related illnesses reported nationally are about 1,479. The Centers for Disease Control and Prevention links most of the diseases to products containing compounds of THC, especially those bought from the illicit market.

Washington-based VTA filed the lawsuit against Baker’s emergency order citing that the mandate was unconstitutional, overreaching, and arbitrary because it was meant to target the youth engaging in vaping activities and the outbreak but ended up banning the sale of vaping products to everyone irrespective of their age.

Other states such as Oregon, Michigan, New York, Rhode Island, and Washington joined in on the ban of e-cigarettes sales, asserting that they are harmful to public health, especially to teenagers.

The ban of e-cigarettes in Michigan, New York, and Oregon has been put on hold by the courts following similar lawsuits.

It is expected that marijuana industry players, such as Green Hygienics Holdings Inc. (OTCQB: GRYN) and Canopy Rivers Inc. (TSX: RIV) (OTC: CNPOF) may be happy with this ruling since it puts a halt to the arbitrary and farreaching bans that would have been imposed elsewhere.
