Since the advent of America’s fledgling cannabis industry, licensed marijuana businesses have been unable to access banking services. Since federal law classifies cannabis as a Schedule I controlled substance, banking institutions avoid partnering with state-legal cannabis businesses. This has made such businesses prime targets for robberies and burglaries because they are forced to operate on a cash-only basis and tend to have thousands of dollars on site.

House representatives have tried to pass cannabis banking regulations that would finally allow businesses in the state-legal cannabis industry to access much-needed banking services. However, these protections have failed to advance past the Senate more than five times even though Senate Majority Leader Chuck Schumer is an ardent believer in cannabis reform. Now that the midterms are fast approaching, a bipartisan group of representatives is urging the Senate to pass the SAFE Banking Act.

Introduced by Rep. Ed Perlmutter, the SAFE Banking Act would allow financial institutions to serve the state-legal cannabis industry without fear of federal reprisal. Even though the legislation has been advanced by the House seven times as either a standalone bill or as an amendment to larger legislation, it has repeatedly failed to get past the Senate.

Lead sponsor of the act, Perlmutter says lawmakers have been frustrated for quite a while over the Senate’s refusal to pass cannabis banking. He says that Senate lawmakers have to figure out what they want from a cannabis banking bill and what they can actually pass, which will ultimately require bipartisan discussions between Senate Democrats and Republicans.

Perlmutter is now trying to advance cannabis banking on two fronts: he is working to include cannabis banking language in the National Defense Authorization Act (ACT), and he is waiting for Schumer to finally unveil his long-anticipated cannabis reform bill. Schumer’s Cannabis Administration & Opportunity Act (CAOA) would decriminalize cannabis at the federal level and also contains criminal justice elements, but it has been delayed several times.

Schumer, who stated in the past that he would advance comprehensive cannabis reform with or without President Joseph Biden’s support, has stated repeatedly that cannabis reform with social equity components should advance before cannabis banking. Last September, he even revealed that several key senators had agreed not to advance marijuana banking reform before comprehensive legalization.

Even so, lawmakers from the House of Representatives are now increasing the pressure on their Senate counterparts to pass cannabis banking. Perlmutter emphasizes that Senators must act on a standalone cannabis banking bill that is currently on the floor of the Senate Banking Committee. Senators also have the option of adding cannabis banking language to the NDAA, he says. In this way, the industry and its leading actors such as American Cannabis Partners would have access to banking services, as do other state-legal industries.

A few months after President Joseph Biden assumed office, his administration passed a major infrastructure bill that, among other things, provided billions of dollars for the development of a nationwide network of public electric vehicle chargers, fulfilling a promise he had made while on the campaign trail. However, the administration has been slow to pass the cannabis reforms President Biden had promised while campaigning, with Biden failing to make a definitive public statement about marijuana policy in the year and a half since he entered the Oval Office.

After more than a year of silence on cannabis reforms, the president has now revealed that his administration is “working on” plans to meet his pledge to pardon and free people who are currently in prison due to cannabis-related offenses. It is the first time he has made a public statement about his administration’s plans to enact cannabis reform since he became the president.

While speaking to journalists on the White House lawn after he stepped off Marine One, Biden said that he didn’t think anyone should be incarcerated for using cannabis. Although he didn’t provide any specifics, the president said that his administration was currently working on a crime bill; press staff from the White House did not respond to further queries for clarification.

Despite dozens of states legalizing cannabis and generating billions of dollars in tax revenue, around 40,000 Americans are currently in prison for marijuana offenses.

He said that many of these individuals are men and women of color who, despite serving their time, are still penalized once they enter society. Since he took office, Biden has received several requests from advocates and lawmakers to exercise his executive powers and issue mass pardons for people who were convicted for nonviolent, cannabis-related offenses. His administration has received nearly a dozen letters from advocateslawmakers and others who have been personally impacted by cannabis prohibition to pardon people who are still imprisoned for cannabis offenses,

The only action Biden has taken has been to grant clemency to dozens of people with nonviolent marijuana convictions on their records in April. Although his actions were lauded, they are still a far cry from the mass pardons advocates and lawmakers have been seeking.

Officials from several European countries recently met to discuss the factors involved in legalizing adult-use cannabis amid a wave of cannabis reform across the region. The historic meeting is expected to be the first of several multilateral discussions and could be expanded to include other countries. The joint meeting involved representatives from The Netherlands, Malta, Germany and Luxembourg.

Advocates have lauded the meeting, stating that it is critical to cannabis reform in Europe by allowing member states to coordinate their marijuana regulations and dealing with any pushback from the United Nations (UN). As it stands, the UN currently bans member states from legalizing recreational cannabis. A joint statement from the countries involved reveals that although the meeting did not result in any major decisions, officials from the countries are aware that the current prohibitionist stance against cannabis is not a “tenable option.”

Consequently, countries with prohibitionist policies will have to review the available data on the short- and long-term impacts of prohibition and find ways to regulate cannabis. The statement notes that such joint meetings are crucial to sharing knowledge, experiences and best practices, as well as finding appropriate solutions to the issues that could hold back cannabis reform.

More specifically, the statement says that this “first multilateral exchange” was geared toward discussions for regulating marijuana for nonscientific and nonmedical issues. The countries involved say that the discussions are needed for a variety of reasons, including addressing the public health risks exacerbated by the illicit cannabis market and providing efficient ways for law enforcement to identify different types of cannabis products.

The joint statement also emphasized the need to review existing cannabis policies, especially considering recent cannabis legislative changes in other countries. There is also an urgent need to develop and strengthen social and health programs such as treatment, harm-reduction and prevention programs.

Luxembourg Minister of Justice Sam Tanson said in a separate statement that more than 50 years after the country criminalized drug use, it still bases its drug policy on repression. He said that statistics show that this approach has not been successful, underscoring the need for a new approach to dealing with drug-related behavior based on discussions with territories that have also pursued similar repression-based approaches with little success.

According to Luxembourg Deputy Prime Minister Paulette Lenert, cannabis policy across the region is sorely in need of a paradigm shift that is based on prevention and the reduction of drugs harms and risks via regulation rather than prohibition.

420 with CNW — Consumption Lounges Could Change Trajectory of Marijuana Industry

Nearly 20 states have now legalized recreational cannabis use. In these states, consumers aged 21 and older are allowed to purchase and consume cannabis for recreational purposes. However, most of these states have outlawed the public consumption of adult-use marijuana, meaning people have to consume their cannabis in private residences.

Consequently, tourists face a unique challenge when it comes to recreational weed. While they are allowed to purchase cannabis in states with legal markets, they are rarely provided with a location to consume this cannabis, essentially making it impossible for them to consume cannabis unless they know a locale. Cannabis users in general lack public places where they can meet and interact with strangers while they partake.

Cannabis consumption lounges have the potential to not only fix this issue but completely revolutionize the cannabis industry. Reminiscent of weed cafes in Amsterdam, American consumption lounges would significantly open the cannabis industry and allow consumers to buy and consume their product in public locations similar to bars.

The first state to legalize consumption lounges was Alaska, with the city of Las Vegas following close behind; some Californian cities are seriously considering launching cannabis consumption lounges in the near future. Given that cannabis legalization is a fairly recent event, consumption lounges are a new idea that hasn’t been around for long, with Alaska legalizing the unique locations less than three years ago.

However, despite the increasing hype for consumption lounges, plenty of questions remain on how they will be run and regulated thanks to the myriad of different state cannabis regulations. In California, for instance, several jurisdictions are working on legalizing different types of consumption lounges despite the state outlawing indoor smoking.

There are also regulations meant to prevent employees from working in environments filled with smoke, which could prove a challenge to consumption lounges. In addition, the National Cannabis Industry Association has wondered if allowing public consumption of cannabis would lead to overconsumption.

In a recent article, the association asked if there would be limits on the amount of cannabis each person could consume during a single visit. Furthermore, the association mused about what a “single serving” of cannabis even was, raising a variety of important but still-unanswered questions about cannabis consumption lounges.

Despite these unknowns, several states are forging ahead with their plans to launch consumption sites. Alaska, which allows people to buy up to one gram of marijuana and edibles with up to 10mg of THC, may serve as the benchmark for the rest of the country.

As these lounges open their doors to the public, the sales of companies such as American Cannabis Partners could spike as more people benefit from the convenience of having a public place where they can indulge in recreational marijuana.

420 with CNW — NIDA Boss Says Decriminalization Can Help Address Drug Addiction Problem

For the past couple of decades, America’s solution to the drug crisis has been criminalization. Most pundits agree that this approach has failed spectacularly, ruining millions of lives and indirectly channeling billions of dollars to the criminal enterprises behind the drug trade. Millions of Americans who would have benefited from medical treatment were branded as criminals and forced to spend years of their lives in prison.

The result is a country that largely views drug addiction as a criminal rather than public health issue. According to a top federal health official, the United States will have to overhaul its approach to drugs if it has any chance of reducing the stigma of addiction and putting an end to the substance abuse crisis.

Speaking in a recent blog post, National Institute on Drug Abuse (NIDA) director Nora Volkow said addiction treatment is desperately in need of change, especially in regards to identifying “pre-addiction.” This change would provide people with the resources they need to seek help before they develop addictions.

However, the impact of decades of drug criminalization still rears its ugly head as there is plenty of stigma and fear surrounding misuse disorders and their treatment. Since personal drug use is still criminalized in most states, people who stand to benefit from drug misuse treatment avoid programs that offer such treatments.

Volkow wrote in the blog post that “rebranding mild to moderate substance abuse disorder” as a common pattern of behavior rather than a criminal one could destigmatize substance use while increasing awareness of the negative effects of using drugs. Furthermore, she stressed that interventions for people who meet pre-addiction conditions should be destigmatized to ensure these individuals seek treatment.

She mentioned providing legal protections for people who disclose past or current use of illicit drugs to their doctors. Ideally, such protections would allow patients to talk about drug use without fear of legal reprisals, thus increasing the number of people who seek substance misuse treatment.

Fear of disclosure will remain a significant hindrance to addressing substance misuse as long as drug use is criminalized, Volkow wrote. She has talked about the harms of drug decriminalization on numerous occasions in the past, stating in a 2021 interview that there was no justification for putting people who use illicit drugs in jail.

Volkow also sent a letter with the head of the National Institute of Mental Health to senators arguing that criminalization was making it hard for scientists to research the possible benefits of psychedelics.
