420 with CNW — Former Attorney General Says US on the Path to Federally Decriminalizing Cannabis

Recently, Eric Holder spoke on a drug policy panel stating that the United States was on the path to decriminalizing cannabis federally as more states advance reform measures. Holder, the former U.S. attorney general who served under the President Barak Obama administration, stated that he was encouraged that the country was moving toward more tolerant laws on drugs that saw addiction as a public health issue.

Holder explained that the drug war had cost lots of taxpayer dollars and shattered livelihoods, noting that the society had begun to move in a different direction. Holder added that he was conflicted by efforts to decriminalize other illicit substances, including cocaine and heroin. The former attorney general revealed that he had a difficult time thinking about the decriminalization of these substances, which one could see had had a negative effect on individuals as well as the society at large. He also argued that the penalties for drug-related offenses could be lower, noting that judges should exercise more discretion when dealing with drug cases on a case-by-case basis, adding that mandatory minimum sentences for these offenses should be abolished.

The former attorney general has received credit from advocates for calling for deprioritizing the enforcement of cannabis federally. In 2013, the Justice Department issued the Cole memo, whichi discouraged federal prosecutors from going after individuals who were in compliance with state-legal marijuana laws.

However, activists also call attention to the fact that while Holder suggested that cannabis be federally rescheduled after he left office, he didn’t begin the process to enact the change in policy while he was still in office.

The panel, which was hosted by the Moritz College of Law at the Ohio State University, also centered on racial inequities in drug enforcement. The conversation was moderated by Douglas Berman from the institution. Other members of the panel included U.S. District Chief Judge Algenon Marbley, Ohio Supreme Court Chief Justice Maureen O’Connor and activist Piper Kerman. All the members of the panel agreed that the disparities illuminated the need for reform.

Marbley also stated that the federal government needed to align themselves with the states in regard to cannabis laws. He explained that most states in the country permitted the use of medical cannabis and those that were yet to allow for recreational cannabis use were headed in that direction, which meant that it was time for the federal government to get on board.

Cannabis is one of the most interesting industries in the country. However, beneath this veneer of success is a young industry that is buckling under a ton of issues, including the lack of access to financial and credit services.

Despite being allowed in more than two dozen states for medical and recreational use, cannabis is still illegal at the federal level, a situation this has had wide-ranging consequences. One of the most damaging is the fact that marijuana-related businesses (“MRBs”) lack access to financial services because banks and credit institutions shy away from working with them due to fear of federal repercussions.

Since federal authorities still haven’t updated banking laws to accommodate the cannabis space, MRBs cannot access electronic payment systems or secure commercial loans on reasonable terms. This means that they must operate on cash-only payment systems, which increases the risk of robbery and burglary, and they cannot pursue opportunities and grow, thanks to a lack of capital. With the federal government poised to discuss a bill that would federally decriminalize cannabis and provide provisions for legal sales, a financial regulator says that passing cannabis banking laws could not be more urgent.

Guidance from the Treasury Department’s Financial Crimes Enforcement Network (FINCEN) for financial institutions keen on working with licensed MRBs was last issued in 2014, underscoring the need for fresh, standardized banking policies for America’s cannabis industry. Rodney E. Hood, a member of the National Credit Union Administration, has requested the formation of a working group under the Federal Financial Institutions Examination Council (“FFIEC”) to develop uniform principles and standards for federal financial institution examinations. This would help create a government entity tasked with developing a preliminary regulatory framework that regulators could use to create the eventual system that would oversee cannabis banking.

The cannabis industry’s most pressing financial needs would be gaining access to deposit accounts, commercial loans at competitive interest rates and electronic payment systems to reduce reliance on cash payment systems. Once these obstacles are eliminated, tax-paying cannabis businesses will be able to operate just like any other legal, tax-paying establishments. But the caveat is that these policies have to be standardized and from the federal government; if not, states will pass their own cannabis banking policies, leading to a patchwork of banking regulations across the country that would take a significant amount of time and effort to detangle.

420 with CNW — Researcher Finds Alternative Use for CBD By-Product

Similar to the cannabis industry, the CBD industry is growing at a rapid rate, with forecasts showing that in less than a decade, the market will have a value in the billions.

CBD, or cannabidiol in full, is produced by extracting oils from hemp. It has different uses and is becoming popular as an alternative treatment to various health challenges. Researchers from Virginia Tech may have found a new use for these nonpsychoactive hemp oils: making plywood stronger.

College of Natural Resources and Environment undergraduate Emilie Kohler studied the possibility of using a by-product of the CBD extraction process as an agent in the production of materials such as structural composite lumber and plywood. Kohler found that pectin, which is a jelly-like substance that can be found in most plant cell walls, could be used as a modifier in adhesives for wood. The undergraduate, who is majoring in sustainable biomaterials science, conducted an analysis of pectin’s flow properties.

Currently, pectin is used in jams and jellies because of its tendency to form a gel that doesn’t flow easily. Director of the Wood-Based Composites Center at the institution, Professor Chip Frazier, stated that the hemp industry was providing new avenues for scientists looking for alternative biological materials.

Frazier, who supervised Kohler’s study, explained that presently the industry generated huge quantities of solvent-extracted hemp flower and, given that biomass is viewed as waste, it was a bit on the higher side to use it as a raw material. The study’s results are yet to be determined, but Kohler notes that pectin shows promise. She explained that pectin could be classified as low-methoxyl or high-methoxyl pectin.

Low-methoxyl pectin typically gels with calcium ions, which are commonly found in adhesives, while high-methoxyl pectin is used in jams and jellies because its sugar content enables it to gel.

Kohler is the institution’s Victor Clay Barringer Endowed Scholarship recipient. She explained that she discovered the field of biomaterials unintentionally, noting that she was excited to have contributed to research in an emerging area. She added that isolating pectin was a chance to gain a greater appreciation for the sustainable biomaterials field.

Frazier is Kohler’s mentor as well as the Thomas M. Brooks Professor of Sustainable Biomaterials at the institution. He notes that Kohler is qualified to take on this study.

420 with CNW — Study Shows Lung Injuries Linked to Tainted Vapes Were Low in Legalized Cannabis Markets

In late 2019, the United States was rocked by an outbreak of severe lung illness that took 68 lives and left an estimated3,000 individuals with ill health. Authorities soon found out that the cause of this lung disease breakout was illegal black market cannabis vaping products containing vitamin E acetate, a synthetic form of vitamin E that was used as a thickening agent. Dubbed e-cigarette and vaping-associated lung injury (“EVALI”), the outbreak led to the pull-out of several cannabis products with artificial thickening agents such as vitamin E acetate. In addition, regulators are thinking of banning the use of such additives in cannabis products.

Now, a new federally funded study looking at the relationship between the prevalence of EVALI and state cannabis policies has revealed that the outbreak was significantly less severe in states with legal cannabis markets. Published in the “Drug and Alcohol Dependence” journal, the study found that EVALI was less prevalent in states where adult-use cannabis was legal or where medical marijuana patients were allowed to grow their own cannabis. States with recreational cannabis markets had 42% fewer EVALI cases, the National Institute on Drug Abuse-funded study revealed, while those that had medical marijuana markets where home cultivation was allowed had 60% lower EVALI incidence compared to medical marijuana states that didn’t allow home cultivation.

The report concluded that while there was a relationship between recreational marijuana laws and reduced EVALI incidence, the incidence of lung disease in medical marijuana states depended on “their policy attributes.” The states that had the highest EVALI incidence had either banned cannabis use outright or had medical cannabis industries that didn’t allow for home cultivation.

Penned by Abigail Friedman, a professor at Yale School of Public Health, and Megan Morean, a psychiatry research student at the Yale School of Medicine, the report is further proof of what cannabis reform activists have been saying: a legal cannabis market where products are regulated and tested for safety is much better than outright prohibition.

Outlawing cannabis will not reduce the demand; it will rather provide an avenue for black-market players to step in and provide products that are neither regulated nor tested for safety. And as we saw from the EVALI outbreak, it is the public that pays the ultimate price when there are no legal, registered sellers. As the report states, public demand for illicit products will decrease if consumers can obtain the substance legally from reputable sellers.
