In September, California Governor Gavin Newsom signed into law four bills affecting the state’s cannabis industry. One of those bills, dubbed Senate Bill 67, allows outdoor cannabis growers to brand and market their products by highlighting where and how those products are produced. As long as the cannabis products come from cannabis plants cultivated in the ground, or were grown without the use of a structure and without the use of artificial lighting in the canopy area, they can claim an “appellation of origin.”

This means that if cannabis farmers in California grow cannabis in the ground without any artificial light or shelter, they will be allowed to brand and market their products as coming from a specific region, similar to wineries in Napa and Sonoma. This will go a long way in helping small growers distinguish their crops. “Having the ability to show people the fingerprints of the place is helpful for us,” says Drew Barber, owner of East Mill Creek Farms in Humboldt County.

Such sellers are hoping that customers will be willing to pay a little extra for craft-grown marijuana produced organically in the state. Barber, for instance, is quite proud of the smaller carbon footprint his cannabis operation leaves. He grows his crops in the sun with no additional structures, and uses compost from the sheep and cattle on the farm to fertilize the soil. “We think it’s really important for people to experience the cannabis we grow out in that nature,” he says.

His farm, East Mills Creek, is a 10,000-square-foot grow that lies in a remote valley along the Pacific Coast. Situated on the edge of the marine layer, the farm gets windy in the summer. Barber says the wind causes secondary lant compounds to produce terpenes and other cannabinoids. His hope is that environmentally conscious customers choose his products over those grown in a less sustainable manner.

“If you like to drink wine, we can think about the actions we take in our lives to create a climate to grow grapes,” he says. “The same is true of cannabis.”

Hanna Wyte, co-owner of Emerald Queen Farms in Humboldt County, agrees. She sees appellations as a way for the young cannabis industry to cause less harm to a planet that’s already in the grip of human-led climate change. “Ten years ago, we had weather where you would really be able to time your harvest and crop to produce sun-grown cannabis,” she says.

But things are different now, and the weather is much more unpredictable than it used to be. Like Barber, Whyte hopes that customers will be willing to fork out for a product that, despite such conditions, has been grown organically and has a smaller carbon footprint.

420 with CNW — Massachusetts Regulators Make Bold Decision on New Delivery Businesses

Although the state of Massachusetts allows the delivery of both medical and recreational marijuana, creating a system for delivering adult-use marijuana has proven to be quite a challenge. Recently, state marijuana regulators announced that they will be moving forward with plans to allow a new class of cannabis delivery business. The move has been met with both praise and criticism from stakeholders.

On Oct. 20, the state’s Cannabis Control Commission (“CCC”) approved some changes to its draft regulations, allowing standalone cannabis retailers without storefronts to deliver products to customers’ homes. This comes a year after the state allowed the delivery of recreational marijuana but failed to create a regulatory framework to make that delivery work.

Over the months after delivery of recreational cannabis was allowed, advocates have argued that permitting delivery would help licensed businesses compete with the black market, which essentially offers free delivery, on top of reducing the barriers to entry for social equity candidates. The CCC ultimately agreed, creating a new business class that would allow licensed operators to act as a standalone company as well as buy inventory from wholesale suppliers and store it in their own warehouses.

Only applicants in the Cannabis Control Commission’s equity program will be eligible for the courier and delivery license, available for a minimum of three years, a move designed to help communities that were disproportionately affected by the decades-long war on drugs gain a foothold in the industry. According to CCC Chairman Steve Hoffman, however, not everyone is cheering the changes.

For instance, Commonwealth Dispensary Association president David Torrisi has stated that his group is “very disappointed” with the decision. “I don’t think the commission has done enough analysis to determine the impact on the supply chain and the marketplace,” he said. The new direct-to-consumer model has also been criticized by the Massachusetts Municipal Association, which represents city and town governments, raising the same concerns as a bipartisan group of 19 lawmakers.

“The draft regulations create a shadow direct to the consumer marketplace not governed by the licensing requirements and regulations of marijuana retailers,” the lawmakers wrote in a letter to the Cannabis Control Commission. “These draft regulations also significantly change the landscape for cities and towns after many had already engaged in intensive, community-wide conversations about the number and types of marijuana establishments their communities wished to host.”

According to the CCC commissioner, the new model may involve some “unknowns,” but it is crucial as it puts a “dent” in the illicit cannabis market and uplifts the communities that were affected most by the drug war. “We still have a lot of work to do on equity, but I would say this is a giant step forward,” said Hoffman.

420 with CNW — Study Discovers Cannabis Use Disorder Has Biological, Genetic Foundation

A global study that investigated the predisposition of individuals to cannabis use disorder has determined a link between a region of DNA near the FOXP2 gene and cannabis use disorder (“CUD”), previously associated with risk-taking behavior.

A press release notes that researchers from the Washington University School of Medicine studied DNA and other data from about 360,000 individuals who did not have a CUD diagnosis and 21,000 individuals who were diagnosed with CUD.

The research team determined two regions in human DNA — the CHRNA2 gene, which has previously been associated with nicotine addiction and CUD, and the FOXP2 gene. Researchers discovered that both these genes contributed to the risk of becoming dependent on marijuana.

Arpana Agrawal, a professor of psychiatry and the senior study investigator, noted that in roughly 50% of individuals who used marijuana, genetics played a role in those who developed problems with marijuana use. He pointed out that genetic pathways could be used to develop better treatments for marijuana addiction in the future.

The research findings, which were published in “Lancet Psychiatry,” show that some individuals may be vulnerable to CUD before they even smoke their first joints. The reason for this, the researchers note, is because children who had higher genetic susceptibility for severe problems with marijuana were found to have, on average, a marginally lower volume of white matter in their brains. Researchers mentioned behavioral factors such as educational attainment, schizophrenia and risk-taking to be of interest.

In the statement, the first author, Emma Johnson, states that while susceptibility to using marijuana is correlated with higher educational attainment, genetic liability for problematic cannabis use is associated with less education. She adds that it’s also possible that those who use marijuana on occasion but develop no addiction may be genetically predisposed to other protective influences, such as more years of education.

Agrawal observed that many individuals may consider marijuana to be less addictive in comparison to other drugs. However, research findings clearly show that individuals can become dependent on marijuana and that CUD has biological and genetic foundations.

The research study notes that the possibility of genetic liability to cannabis use disorder in individuals who were unexposed has major implications for the public health sector. Another study published in “Lancet Psychiatry” noted that CBD could be used as a new treatment to help treat cannabis use disorder. However, it is unclear what doses might be safe or effective.

420 with CNW — Senators Say DEA Rule on THC Content of Hemp Contravenes Congressional Intent

In August, the Drug Enforcement Administration (“DEA”) unveiled proposed rules that would officially put the agency in line with the 2018 farm bill. The legislation legalized the cultivation and sale of industrial hemp and its extracts, allowing farmers across the country to grow hemp under state and tribal programs. However, the federal agency’s interim final rule on hemp has been met with resistance from activists who argue it contradicts the 2018 farm bill and will hamper the growth of the nascent hemp industry.

Last week, a pair of Oregon senators sent a letter to the DEA demanding changes to its proposed hemp regulations. Senators Ron Wyden and Jeff Merkley say that despite the DEA’s claim that its interim final rule (IFR) is only about compliance, the proposal “does significantly more.”

“The IFR treats hemp as a Schedule I controlled substance at any point its THC content exceeds 0.3% THC,” they write. Delta-9 THC is the main component responsible for cannabis’s psychoactive effects, and the 2018 farm bill requires that legal hemp has less than 0.3% delta-9 THC. “However, when Congress passed the 2018 farm bill, we understood that the intermediate stages of hemp processing can cause hemp extracts to temporarily exceed 0.3% THC, which is why we defined hemp based on its delta-9 THC level.

“In effect, the IFR criminalizes the intermediate steps of hemp processing, which is wholly inconsistent with Congress’s clearly stated purpose and text of the 2018 Farm Bill,” the letter continued.

According to the DEA’s proposed rules, businesses that produce hemp products may find themselves breaking the law, and they could be subject to enforcement actions if THC levels increase beyond 0.3%, even temporarily. Additionally, the DEA’s regulation states that all “synthetically derived tetrahydrocannabinols remain schedule I controlled substances,” locking out delta-8 THC. Delta-8 THC is converted from CBD through the use of a catalyst, a process that could be interpreted as a synthetic production process, making delta-8 THC illegal.

This is the second time the DEA has received a congressional request concerning its interim final rule on hemp. On October 20, nine members of Congress also sent a letter to the agency urging it to revise its proposed hemp regulations. Led by Reps David Joyce and Denver Riggleman, the members of Congress argued that the DEA’s provision which stated that “any such material that contains greater than 0.3% of delta-9 THC on a dry weight basis remains controlled in Schedule I.

“Our offices have received countless calls from constituents involved in the hemp industry who are extremely fearful that simply following the provisions of the Farm Bill will result in criminal liability under the IFR,” the letter continues. “The IFR will likely have the effect of inhibiting these nascent state hemp programs, thereby harming those American companies and workers who chose to pursue careers in the hemp industry and made significant investments to effectuate those aspirations.”

420 with CNW — Possible Voting Outcomes on November Marijuana Measures

In less than a week, Americans across the country will mail in their ballots or visit local voting stations to determine the direction the United States will head in the near future. Apart from focusing on the presidential race and senate runs, you should also pay attention to the cannabis legalization votes, which will be happen in five states.

Polls may not be accurate, and reality tends to escape theory sometimes, but we’ve laid out a few predictions for the marijuana legalization votes in the five states.

Arizona

This will be the second time voters from the state will vote on a recreational cannabis measure. The measure, Proposition 207, will allow the use of marijuana recreationally as well for possession to persons who are 21 years of age or older. The proposition would also impose a 16% tax on cannabis sales.

Interestingly enough, states that failed in the adult-use cannabis legalization in the first attempt, such as Oregon and California, have been successful on the second try. Proposition 205 may have flopped during the 2016 election, but Proposition 207 may yet be the winner. We predict that the measure will pass with about 55% of the vote. After all, the second time’s a charm.

New Jersey

Voters from New Jersey will be deciding on whether to allow adult-use cannabis. The initiative, Public Question 1, would legalize adult-use cannabis cultivation as well as its processing and sale to individuals who are 21 years of age and older. It would also impose a state sales tax on retail cannabis sales but will not impose any additional excise tax.

Survey results released earlier this month show that 65% of state residents favor legislation. This is more than half of residents in the state, so the measure is likely to pass with ease.

South Dakota

Residents of the Mt. Rushmore State will be voting on separate medical cannabis and recreational measures. Measure 26 would develop medical cannabis programs for patients with severe medical conditions. On the other hand, Constitutional Amendment A would legalize recreational cannabis and impose a 15% tax on retail marijuana sales.

The No Way on A Committee released survey results gathered in June indicating that more than 70% of the respondents were pro Measure 26 and roughly 60% of the respondents were in favor of Amendment A. This could go both ways seeing as marijuana in the state is completely illegal at the moment; Amendment A may not pass by a small margin while Measure 26 will pass triumphantly.

Mississippi

Magnolia state residents will be choosing between Alternative 65A, which restricts marijuana smoking to terminally ill patients, and Initiative 65, which allows marijuana to be prescribed for more than 20 qualifying medical conditions. Survey results show 81% are in favor of both medical marijuana legalization and Initiative 65A, so it’s safe to say both laws should pass in a landslide.

Montana

Montana residents will vote on two initiatives: I-190 and CI-118. The former would allow those who are serving prison sentences for marijuana-related offenses to request resentencing and expunge cannabis-related convictions while also legalizing adult-use marijuana and establishing a 20% tax on its retail sales. The latter initiative is a constitutional amendment that would allow the state legislature to institute age 21 as the legal age for marijuana consumption.

Recent poll data shows that 49% of the those polled in the state were pro I-190 and 39% against it. I-190 may be passed by a slim margin of 52% to 48% or 51% to 49%.

420 with CNW — Montana Supreme Court Throws Out Case Against Marijuana Legalization Measure

On Wednesday, Oct. 21, the Montana Supreme Court rejected a lawsuit against a marijuana legalization initiative appearing on the state’s November ballot. Sponsored by the New Montana approach, the initiative would establish a legal cannabis market for adults in the state. But as the elections drew closer, the initiative was challenged by Wrong for Montana, an organization arguing that, because the initiative involves appropriating funds, it violates state statute on citizen initiatives.

“We have prepared this lawsuit, and we are in the process of filing it,” said Steve Zabawa of Wrong for Montana (WFM). He cited article III, section IV of Montana’s constitution, which says that citizens “may enact laws by initiative on all matters except appropriations of money and local or special laws.” If the legalization initiative was passed, half of the public revenue collected from marijuana sales would go towards environmental conservation programs.

Although the court didn’t state whether or not the challenge was valid, it said that the group behind the lawsuit did not demonstrate “urgency or emergency factors” that would justify moving the case into its jurisdiction instead of going through trials and appeals courts first. “We express no opinion on the merits of WFM’s constitutional challenge, nor its rights to pursue this challenge in district court,” the court justices wrote.

“However, WFM’s claim does not present an appropriate basis on which to invoke this Court’s original jurisdiction,” the justices continued. “Even if it did, WFM has wholly failed to establish that urgency or emergency factors make litigation in the trial courts and the normal appeal process inadequate.” The court has left the door open for Wrong for Montana to take its challenge through the traditional process.

According to Brian Thompson, the attorney representing the plaintiffs, the plaintiffs intend to file the suit in a district court “soon.” The initiative in question is on the ballot, and voting has already started. If the lawsuit had been successful, the votes simply wouldn’t have counted or the initiative would not have been implemented.

“This was an easy decision for the Montana Supreme Court,” says Dave Lewis, policy advisor to the pro-legalization New Approach. “At best, this lawsuit was a frivolous long shot. At worst, it was an intentional effort to create confusion right before the election. Lewis, who is a former Republican state senator and former budget director for three Montana governors, says the initiative has been receiving strong support from voters across the state.

“Instead of making a coherent argument against the initiative, our opponents tried to deprive Montanans of their constitutional right to a citizen initiative process,” Lewis continued. “Our opponents are desperately throwing everything at the wall in the hope that something sticks.”

420 with CNW — Research Finds No Link Between Recreational Cannabis Legalization and Teen Use

Since 2012, eleven states have legalized cannabis use for adults, with many voters across the country considering the same measures on 2020 ballots in numerous states. The first states to legalize the drug were Washington and Colorado; California followed suit.

Most concerns about legalization center on whether making the drug legal would cause more young people to use it or whether accidents caused by impaired drivers would increase. Data collected since then shows little change in usage or impaired driving accidents.

For example, a survey carried out in Colorado after legalization showed a slight decrease in the percentage of high school and middle school students who used cannabis. In Washington, the rates of use have largely remained stagnant.

However, opponents of cannabis legalization still claim that the risk of young people being given the impression that cannabis isn’t harmful is too high.

With regard to impaired driving, states with legalized cannabis have discovered more drivers impaired by the drug. Many believe, however, the numbers are going up because the states are putting more effort into identifying those specific statistics. For example, Colorado started tracking cannabis impairment of drivers in 2016.

In California, data collected indicated an increase in the number of impaired drivers involved in deadly accidents. Washington state recorded a growth in drugged driving both before and after cannabis was legalized, showing no significant change that might be attributed to legalization of the specific drug.

Officials also aren’t convinced that these increases are a result of legalization. Researchers have also not indicated a growth in the total number of traffic fatalities linked to legalization. For instance, when compared to the number of traffic fatalities in 2017, California recorded 8.3% fewer traffic fatalities in 2018, the same year that retail cannabis sales were launched in the state.

According to the CDC, Washington and Colorado recorded among the highest rates of cannabis use by youth in the country between 2011–2015. State data shows that those figures did not increase after the drug was legalized for adults.

Also in Washington, a survey carried out in collaboration with the Office of the Superintendent of Public Instruction indicated no growth in the numbers of sixth, eighth, tenth and twelfth graders using cannabis after legalized sales started in 2014. Surveys conducted in Colorado showed similar results; in fact, numbers actually indicate that the number of high school and middle school students who used cannabis decreased after legalization.

While California is yet to make public its youth biennial survey results since recreational sales started in 2018 in the state, a previous survey indicated a 3.4% decrease in the number of young people who used the drug.

From the above, it appears that there’s no significant increase in adolescent use of the drug after it is legalized. While more should be done to combat impaired driving, benefits may be gained from legalization. Furthermore, states such as Arizona, Montana, New Jersey and South Dakota are proposing recreational legalization of the drug in their jurisdictions, which provides additional evidence that cannabis legalization is a good move.
