420 with CNW – Virginia Governor Wants Marijuana Decriminalized in the State in 2020

On Friday, Virginia’s Gov. Ralph Northam announced that on top of his agenda for the 2020 General Assembly session is criminal justice reform and marijuana decriminalization. While listing his legislative priorities, the governor featured a decriminalization measure. Northam intends to make low-level marijuana possession punishable by a fine of $50 without additional jail time; however, his proposal does not specify the exact amount of marijuana that falls in this classification.

His proposal also includes a provision seeking for expungement for people previously convicted of marijuana possession.

In a press release, Northam said that residents of Virginia deserve to have access to a criminal justice system that is fair and equitable. He further said that his proposed legislation and the budget measure would help in fighting mass incarceration, increase support for former convicts and make sure that they are given a second chance after serving their time.

The governor further said that the criminal justice reform agenda is a daring move towards a just and an all-encompassing commonwealth. He also said that he is looking forward to working with the General Assembly to pass the legislation into law. In 2017, Northam made marijuana decriminalization the centerpiece for his gubernatorial campaigns.

It is yet to be specified if the governor is urging the legislature to approve a decriminalization bill that is yet-to-be introduced or if he is supporting one that has already been filed because in November of 2019 after the Democrats regained control of both chambers of the General Assembly, the lawmakers pre-filed a measure seeking to make simple marijuana possession punishable by a fine of $50.

Some legislators in Virginia said that decriminalization and expungement would serve as a gateway to broader marijuana legalization. Last month, Attorney General Mark Herring (D) hosted the marijuana summit whose purpose was to provide information on future marijuana legislation. Herring is vying for the position of governor in 2021, and he plans on supporting total marijuana legalization.

In a press conference, the governor said that although Virginia is not ready for recreational marijuana legalization, he noted that decriminalization is a step in the right direction. He further said that even though his criminal justice plan does not feature broader marijuana legalization, there is a filed legislation seeking to legalize the adult-use cannabis market during the 2020 legislative sessions in Virginia.

The state prosecutors are also considering marijuana reforms, and on Thursday, the Fairfax County Commonwealth’s attorney, Steve Descano, announced that his office would not be pursuing simple cannabis possession cases.

During a phone interview with an online publication, Descano said that it is the duty and responsibility of the prosecutors to ensure that justice is served. He also added that he does not plan on participating in passing the decriminalization bill.

On Thursday, Arlington County Commonwealth attorney Parisa Dehghani-Tafti said that her office would not be pursuing cases based on marijuana possession from that moment onwards.

In his reform agenda, Northam is seeking to cease the policy of suspending a driver’s license once he or she is convicted of drug offenses or failure to pay jail fees. Experts think that these proposed actions in Virginia are a welcome development in the eyes of marijuana industry players like Green Growth Brands Inc. On Thursday, the Governor of Kansas, Laura Kelly, said that if the state lawmakers sent a bill seeking to legalize marijuana to her desk, there is a possibility that she would sign it into law.

Speaking about the legislative priorities for 2020 in several interviews, Gov. Kelly said that the lawmakers should legalize medical marijuana as it would help Kansas families whose children are suffering from serious ailments. Medical marijuana would also help in fighting the opioid crisis by reducing the use of prescription pain medication.

Although Gov. Kelly said that she is not in favor of legalizing adult-use marijuana, she also noted that if the legislation were to advance in the state, she would enact it.

Speaking to WIBW, Kelly said that she has not made a decision on what she would do, but her decision would rely on the wants of her people; if the residents of Kansas want it, and the legislature approves it, then she would most likely sign it.

The governor further stressed that her agenda for the 2020 legislative sessions is the legalization of marijuana for medical purposes.

Kelly further said that she wants medical marijuana to be well regulated and controlled so that it does not become the gateway for the legalization of marijuana. She also said that her wish is for medical marijuana to be viewed as a pharmaceutical and controlled product.

She added and said that medical marijuana should be legalized and because of its medicinal potential, families with kids suffering from Dravet syndrome could use it. Children with Dravet syndrome experience severe and frequent epileptic seizures, which could be managed using medical cannabis.

Gov. Kelly has been outspoken about her support for medical marijuana, as it was also part of her 2018 election campaign; however, it is essential to note that she is not at all enthusiastic about recreational marijuana legalization. Kelly said that she does not think the state of Kansas is ready for adult-use marijuana, but a recent survey shows that the majority of Kansas residents are in favor of the marijuana reform.

The survey, which was released in December 2019, showed that 63 percent of the state’s residents are in support of recreational marijuana legalization. This indicates that the task remains on the legislature to approve the legislation and forward it to the Governor’s desk.

The likelihood of legalizing medical marijuana in Kansas is looking up. Last year, a special legislative commission issued recommendations in support of developing a limited medical cannabis program. The program would give patients a chance to access medical marijuana products that are neither smoked nor vaped. The commission also recommended providing patients visiting from out of state with some form of legal protection.

In an interview with KSNT, Gov. Kelly said that she is aware that people have a desire for medical marijuana legalization and that she fully supports it and hopes that the legislature would approve it.

420 with CNW – Illinois Residents Buy Recreational Marijuana Worth $3.2 Million on the First Day of Legal Sales

On Thursday, it was announced that the first day of legal adult-use marijuana sales in Illinois attracted more than 77,000 transactions, which generated approximately $3.2 million in sales. One of the transactions was made by the second-most powerful official in the state, Lieutenant Governor, Juliana Straton, who bought edible gummies. Stratton said that she was there to celebrate the big day in Illinois.

According to Toi Hutchinson, the sale of legal recreational marijuana took effect on New Year’s Day, and the state-licensed dispensaries made 77,128 transactions. Hutchinson is the senior advisor to Governor J.B. Pritzker on marijuana control.

The retail outlets reported long lines of customers during the first day of legal sales, and they expect the lines to persist through the weekend.

Speaking to a reporter on Thursday in Chicago, Hutchinson said that the long lines show that there is a massive opportunity for the cannabis industry to grow.

When compared to other states such as the bordering Michigan, which generated $3.1 million in its first two weeks of legal adult-use sales after the launch on December 1,  it shows that Illinois has a potential for growth since it exceeded that amount within just the first day of sales.

Colorado was the first state in the U.S. to legalize adult-use cannabis. The state launched the sale of marijuana on January 1, 2014 and generated over $1million in sales.

Hutchinson further said that Thursday was the deadline for those who wished to apply for business licenses under the social equity provisions. The day also marked phase two of the Illinois legalization law.

Phase two of the legalization law is meant to help minority applicants who were severely affected by the fight against drugs. The social equity provisions require qualified applicants to pay lower licensing fees. It also provides them with business loans and any other technical assistance.

The legalization laws also stipulate that some of the marijuana revenues would be used for neighborhood development grants. It also had a provision for expungement of low-level marijuana convictions.

On Tuesday last week, Pritzker granted more than 11,000 pardons to people with low-level marijuana convictions.

On the day of legal sales launch, Wednesday, people began streaming in at the dispensaries as early as 6 a.m. Medical marijuana is already legal in Illinois, and now, Illinois is the 11th state to legalize the consumption and sale of adult-use cannabis.

In Illinois, people who are 21 years and above can possess up to 1.06 ounces of marijuana buds and up to 0.17 ounces of marijuana concentrate.

The executive director of the Cannabis Business Association of Illinois, which is based in Springfield, Pamela Althoff, said that most of her Wednesday morning was spent in Chicago and Northwestern suburbs, where customers had to wait for about three hours to be served as the day progressed. She also noted that people were courteous and civil, and the police were present at most dispensaries to control traffic.

Althoff advised consumers not to use marijuana in public and also noted that, like any other new product, marijuana products might be a little costly. Althoff further that they hope that the prices will go down as the market matures.

About 36 licensed dispensaries are selling recreational marijuana, and by May 2020, the state officials said that they would have issued 75 more permits. State officials further estimate that by the end of 2020, Illinois could generate $250million from marijuana sales.

That promise was put to the test and a row over how much control municipalities and cities have over the marijuana industry came to a head when state regulators insisted that marijuana businesses could deliver weed anywhere within the state while the local authorities say such deliveries should only happen in places that permitted marijuana businesses to set up shop.

In a twist of irony, the Fresno County Superior Court is set to start hearing a case pitting 24 cities against the California Bureau of Cannabis Control on April 20 (the unofficial marijuana holiday). The outcome of this case could either give weed companies some needed respite or hamper their activities even further.

  1. Legislative Changes

On January 1, Senate Bill 34 took effect and licensed businesses can now donate medical marijuana products to patients that are needy and cannot afford them.

More importantly for marijuana businesses, Assembly Bill 37 seeks to allow companies to deduct their operational costs before their tax liability is computed. This is a major piece of legislation because it effectively sweeps aside federal laws that have denied marijuana businesses the same tax benefits that other businesses enjoy.

A legislative change that is likely to rub weed businesses and consumers the wrong way is Assembly Bill 1810. This bill seeks to ban passengers in taxis, limos and other commercial vehicles from consuming marijuana. This means that the idea of weed party buses has gone up in smoke.

Marijuana businesses insist that California needs to make many more legal reforms if the industry is to survive or even thrive given the challenges that it has faced in the first three years of legal recreational cannabis sales.

  1. Expunging Criminal Records

Prop 64 set out a process through which people with marijuana convictions could apply to have their records expunged or charges amended. However, records show that only a tiny fraction of potential beneficiaries has applied for expungement, partly due to the costs and complications of the process.

Assembly Bill 1793 passed in 2018 gave a July 2020 deadline in which local prosecutors have to track down and process the expungement or retroactive downgrading of cannabis convictions. As this deadline looms, thousands are likely to be eligible for housing, employment and other benefits they were denied as a result of their convictions.

  1. Cleaning Up Weedmaps

Weedmaps was started to provide marijuana consumers with information about the places where they could buy weed legally in California. However, state regulators warned the directory about having listings of unlicensed marijuana sellers and Gov. Newsom enacted a law that imposed fines of up to $30,000 for each day that an unlicensed marijuana seller remains operational.

Weedmaps is likely to make good on its promise to remove illicit sellers from its directory and the outcome of this action could reveal how much damage delisting those unlicensed businesses does to the cannabis black market.

It is widely believed that the entire marijuana industry, including companies like No Borders Inc. (OTC: NBDR) and Sugarmade Inc. (OTCQB: SGMD), could be keeping a close eye on events in California since they can reveal what may happen elsewhere over time.

420 with CNW – Alabama Legislative Panel Recommends the Legalization of Medical Marijuana

When a state Senate bill to legalize medical marijuana in Alabama was met with stiff resistance in the state Assembly, a compromise was reached to create a panel to study the matter further and recommend a way forward for the state. That legislative panel voted last week to proceed with legalization in a move that has been lauded by marijuana advocates.

The Medical Cannabis Study Commission is made up of 18 members and 12 of them voted in favor of medical marijuana legalization. Three abstained and the other three members voted against legalization.

The report of the panel indicates that the members of the Commission presented and debated various issues connected to the use of medical marijuana. While some medical research on the therapeutic use of marijuana was inclusive, the members found strong evidence that the substance was helpful to people suffering from a number of health challenges.

In their draft legalization bill, the panel recommends that the state forms an 11-member Alabama Medical Cannabis Commission to license cannabis businesses and track the industry “from seed to sale.”

The panel also recommends that the state supports research into the medical benefits of cannabis and also puts resources towards finding ways to make the legal medical marijuana industry as inclusive as possible.

Sen. Tim Melson (R), a long-time marijuana advocate who was the chair of the study commission, revealed that the Friday vote shows that the draft bill formulated is a well-thought out document that addresses the crucial issues connected to a regulated medical marijuana industry.

Melson is an anesthesiologist and medical researcher who spearheaded the Senate bill that was passed in May last year. He admitted that at one time, he was strongly opposed to the legalization of marijuana for any purpose. However, when he took a rational look at the available research, he changed his mind and became a strong advocate of medical marijuana.

For that reason, he appealed to other legislators to set their biases aside and evaluate the existing literature before forming an opinion on marijuana.

While advocates are happy with the findings of the commission, they are concerned that the draft bill is too restrictive in its current form. For example, it bans smokable forms of marijuana and gives employers the liberty to fire or refuse to hire an employee based on that employee’s use of medical marijuana.

The list of qualifying conditions is also shorter than what is typical in other states where medical marijuana is legal.

Alabama’s legislature will resume business on April 4 and the bill will come up for discussion. Experts believe that marijuana companies like VPR Brands LP (OTCQB: VPRB) and Plus Products Inc. (CSE: PLUS) (OTCQX: PLPRF) will be hoping that the lawmakers modify the bill and customize it to the needs of the people of Alabama.
