420 with CNW — Federal Agency Publishes Maiden THC, CBD Testing Variability Report

Despite being one of the youngest sectors in America, cannabis is one of the country’s fastest-growing spaces. Cannabis and hemp products have become extremely popular, with the sector being one of the few spaces emerging from the coronavirus pandemic relatively unscathed and actually seeing increasing sales. However, one issue that has plagued America’s state-legal cannabis industry has been cannabinoid testing.

The 2018 Farm Bill, which legalized the cultivation and sale of industrial hemp and its cannabinoids, placed a 0.3% THC limit for legal hemp. But most laboratories that test for THC, CBD and other cannabinoids often come back with different results. Consequently, a federal science agency has launched a program to push for standardized testing and analysis of the more than 100 cannabinoids in hemp and cannabis. In that vein, the National Institute of Standards and Technology (“NIST”), which is part of the U.S. Department of Commerce, has recently published a THC and CBD testing variability report.

The agency’s Cannabis Quality Assurance Program (CannaQAP) is meant to help laboratories measure key chemical compounds in hemp and cannabis products. According to NIST, the fact that cannabis was prohibited until recently means most labs are venturing into untested waters, which often leads to unreliable results.

To help create a standardized system of cannabis and hemp testing, NIST sent two hemp oil samples with known concentrations of CBD, THC and 15 other cannabinoids to 116 testing laboratories across the country. The laboratories were required to test the samples and send the results to NIST along with an explanation of the testing methods used.

The report, which was published on July 27, 2021, showed how much variance existed between the labs and their testing methods. The testing results, published in an anonymized form, were meant to be educational and to demonstrate how testing methods used by testing labs and their subsequent results varied. Brent Wilson, a research chemist at NIST, says the results compared favorably with the target values. The program is meant to provide a judgment-free platform for laboratories to display their cannabinoid testing methods to improve and standardize their measurement capabilities.

There was a wide range of variability on the CBD results, says Wilson, although the labs that missed the accurate result often fell far below the intended value. For THC, the labs were generally close to the accurate THC value, but some of them returned values that were significantly below or above the intended value. As the program progresses, Wilson expects to see the range of variability in results shrink.

The removal of any inconsistencies in the testing of THC and CBD levels in cannabis products is especially important for people who consume cannabis products for medicinal purposes, and more accurate testing coupled with the use of precision dose-measuring devices such as those made by RYAH Group Inc. 420 with CNW — Senate Appropriations Committee Urges Federal Agencies to Reconsider THC Cap for Hemp Products

Last week, the U.S. Senate Appropriations committee voted to approve a bill urging federal authorities to create a regulatory mechanism for cannabidiol products and rethink THC restrictions on hemp. These provisions were among others passed by the Senate committee while working on a bill to fund the U.S. Department of Agriculture as well as other federal departments and agencies for next year’s fiscal year. The bill would also maintain a rider, which protects state-level hemp programs from interference by federal authorities.

Below are some of the marijuana-linked provisions supported by the committee, many of which are akin to the resolutions that were advanced through the House in July.

On the subject of the 0.3% THC limit for hemp products established in 2018, senators directed the U.S. Department of Agriculture to conduct a study on whether there was scientific evidence to support the cap. That study should be done by partnering with federal agencies such as the DEA and the Department of Health and Human Services. In the report, the senators noted that the level of allowable THC content in hemp places a heavy burden on producers of hemp.

The senators added that the FDA should continue to develop regulations that allowed the use of cannabidiol products and also issue a policy guiding the enforcement discretion with regard to these products. In this particular provision, the panel noted that the FDA should continue performing its regulatory responsibilities, which include reviewing product applications, enforcement, inspections and conducting research on cannabis-derived compounds such as CBD.

This was in addition to encouraging the federal agency to consider ongoing and existing medical research associated with cannabidiol as well as partner with academic institutions to expand CBD product sampling studies for products already on the U.S. market.

To ensure that hemp businesses and farmers were eligible to take part in loan and insurance programs that are available to participants in various sectors of the economy, the Senate Appropriations Committee also directed that the Secretary create a dual categorization for industrial hemp as a specialty plant based off of the purpose and manner of cultivating it; that categorization should be created within 90 days of the legislation being enacted.

The draft Senate legislation also has a provision that prevents federally availed money from being used to obstruct state-level hemp programs. This is in addition to extending the terms of a pilot program that has allowed some states in the country to begin growing hemp for CBD and other uses. The 2014 pilot program enabled some states to begin growing hemp before its cultivation was legalized federally by the 2018 Farm Bill.

Increasing the THC limit in the definition of hemp would probably reduce some of the losses that cannabis/hemp growers and processors such as Sonoma Biologics Corp. face due to hemp exceeding the tight THC limits currently in existence.

Cannabidiol, or CBD for short, is one of the chemical compounds found in the cannabis plant. This cannabinoid is all the rage these days and can be found in a huge variety of products including water, sweets, snacks and even your morning cup of coffee. It is also now being included in body care products such as face masks, moisturizers, body lotions and even lip care products. But should you spend your hard-earned money on these products?

While scientific evidence of their benefit is still scant, a number of studies suggest CBD beauty products may offer some benefits. For example, a 2019 study on CBD ointments used to manage the symptoms of individuals that suffered from atopic dermatitis and psoriasis concluded that CBD could be a safe and efficacious remedy for inflammatory skin ailments. This study had 20 participants.

Another clinical trial done in 2020 focusing on people suffering from peripheral neuropathy indicated that there was symptom relief for those who used CBD when compared to the group that got a placebo. This study had 29 subjects.

While those two studies show promise, their sample size was small, and there is no telling what the results may be if the studies are replicated using large-scale samples. Nevertheless, the preliminary studies suggest that some benefits can be obtained by using CBD in body care products.

The next question may have to do with where to buy the best CBD body-care products. The internet is awash with sites selling these products, but caution has to be taken to select a reputable retailer who is selective about the products they sell.

If there is no particular brand of beauty-care product seller that immediately comes to mind with regard to having a reputation for selling quality products, follow the following tips to select a quality CBD beauty product.

First, read the certificate of analysis (“COA”). This is a lab test report provided by an independent firm. The report details the ingredients and their quantities in a given product. The report also shows what contaminants, if any, are present in the product. Contaminants worth noting include pesticides, heavy metals and mold.

Take note of the potency. The potency of CBD is normally indicated in milligrams. The higher the number, the more potent the product. More isn’t necessarily better as product use requirements differ.

Pay attention to the CBD type. Some products will be made from CBD isolate (pure CBD without any other cannabis compound), full-spectrum CBD (CBD containing other cannabis compounds such as flavonoids, terpenes and THC within the legal limit of 0.3%) and broad-spectrum CBD, which has all other cannabis compounds except THC. Full-spectrum products are said to offer an entourage effect and better results, but you can buy broad-spectrum or isolate CBD products if you have concerns about being tested for drugs.

420 with CNW — How Congress Can Make Hemp Easier to Cultivate

Hemp’s close relation to marijuana nearly doomed the versatile plant to obscurity. For those who don’t know, industrial hemp is a member of the cannabis family, and it produces minimal amounts of THC, the cannabinoid that makes marijuana intoxicating. The nonpsychoactive plant has a plethora of applications ranging from textiles and construction to health and wellness, and it played a significant role in America’s economy while the colonies were under British rule and after gaining independence.

However, as the 1900s ended and the prohibitionist movement gained steam, hemp was lumped together with cannabis and eventually outlawed in the 1930s. It remained illegal until the 2014 Farm Bill allowed universities and state agriculture departments to launch pilot hemp programs. The 2018 Farm Bill finally removed industrial hemp from the list of Controlled Substances ending decades of prohibition, and an industry soon developed in earnest. Bolstered by hemp’s diverse applications as well as the alleged medicinal properties of cannabinoids, such as cannabidiol (“CBD”) and cannabigerol (“CBG”), hemp has now become a space worth billions of dollars.

However, despite the significant success hemp has achieved after just a few years of legality, it is still held back by regulations. The 2018 Farm Bill categorized hemp as cannabis with less than 0.3% THC, and therefore, farmers have to ensure their crop doesn’t surpass this limit. Keeping THC levels below 0.3% is a tough prospect, with an increasing number of hemp farmers discovering that their crop has more THC than legally allowed. “Hot hemp” tends to have around 1% THC, at least for the farmers who tried to keep THC levels low, but this level of THC is not intoxicating as psychoactive cannabis usually has at least 15% THC.

A lot of stakeholders have argued that the 0.3% THC limit is arbitrary and is not based on science; therefore, it doesn’t serve any purpose. If Congress were to raise this limit to 1%, farmers wouldn’t have to invest so much time and money in ensuring their crop’s THC levels remain low since most factors that contribute to THC levels are out of their control. Farmers would also be spared from suffering loses should regulators destroy hemp with more than 0.3% THC. Additionally, they would not be at risk of facing serious criminal charges, which the United States Department of Agriculture (“USDA”) claims is a consequence of defying hemp regulations.

In fact, several countries have already adopted the 1% THC limit including Switzerland, Thailand and Ecuador. The current THC cap makes it extremely hard for farmers to cultivate a lucrative cash crop. Furthermore, the factors responsible for THC levels are out of the farmers’ control, and farmers often suffer major loses when regulators destroy their hot hemp.

A number of campaigns have been initiated to draw the attention of lawmakers to the need to adjust these retrogressive requirements. As the push to make reforms continues, cannabis industry players such as Golden Triangle Ventures Inc.
