420 with CNW – Mexican Government Drafts Law to Legalize Marijuana

The incoming government of Andres Manuel Lopez Obrador in Mexico has drafted a bill which is likely to see medical and recreational cannabis legalized once Congress passes it.

The bill is intended to change the approach that Mexico has been taking to fight crime. The past 12 years have seen escalations in violence and poverty as the country fought to bring down the organized crime networks built around the illicit cultivation and sale of cannabis within and beyond the borders of Mexico, especially to the U.S.

Olga Sanchez, the Interior Minister-nominee, said that it was now time to bring peace to the country and end the war on drugs. She was alluding to the thousands of lives that have been lost due to drug-related crime, such as the wars between rival gangs over drug trafficking routes and cultivation areas.

The proposed bill will allow companies to cultivate and commercialize marijuana. Individuals would also be permitted to grow cannabis for their own use, as long as they didn’t harvest more than the maximum amount (480 grams) permitted each year for such privately grown plants.

Furthermore, individual growers will be required to register with the state so that they can be monitored to ensure that they aren’t growing more than is permitted for personal use. Smoking marijuana in public is also likely to be permitted.

The bill seeks to make it illegal for cannabis companies to employ children. Child labor has been the hallmark of the illegal cannabis industry in the past, so the law wants to make it clear that children should have no part in the legal cannabis industry.

Three key factors may have prompted Mexico to consider a change of policy with regards to marijuana.

First, individual states in the U.S. have legalized not just medical marijuana but recreational use as well. The U.S. has for long supported efforts to stamp out drug trafficking gangs in Mexico.

Secondly, the Supreme Court made five rulings in favor of individuals who were protesting against being restricted from consuming recreational cannabis. Those five rulings effectively made it a must for all other courts to permit anyone who wanted to consume recreational marijuana.

Third, the violence and deaths associated with the war on drugs in Mexico have reached alarming levels of late. For example, not less than 31,000 murders were recorded in the country in 2017. Violent crime had never reached such a level before.

The incoming government doesn’t think legalizing marijuana will magically end all that violence. It plans to offer amnesty and negotiate with many of the armed groups that have been having running battles with the armed forces.

Mexico will join Uruguay and Canada in case cannabis legalization takes place. The U.S. will therefore become isolated among its neighbors if it still insists that marijuana shouldn’t be legalized federally. Youngevity International, Inc. The head of the federal prosecutors in Oregon has been selected to lead the U.S. Attorney General’s Marijuana Working Group. This group is made up of all the federal prosecutors in the states where cannabis is legal in some form (recreational and, or medical).

Billy Williams of Oregon will lead this 16-member panel. The panel examines how the different states are handling matters of law enforcement, policy and practices with regards to marijuana. The committee isn’t a new creation. It existed long before Donald Trump took office.

The panel is part of the sub-committee which advises the U.S. Attorney General on issues regarding controlled substances, such as cannabis and heroine.

The selection of Williams is significant since he has been very vocal in expressing his displeasure regarding the way the state of Oregon handled marijuana legalization. He has always pushed for stronger measures to cut off the supplies of marijuana into the black market.

Early this year, Williams revealed his priorities for the federal prosecutors under his leadership in Oregon. He wanted enforcement efforts to be focused on stamping out the illegal cannabis market in the state as well as ending the illegal cultivation of marijuana.

Recently, he again stated that overproduction and the black market have become major law enforcement issues on the west coast where cannabis is legal for both recreational and medical use.

His zeal for “greater regulation” seems to have now received a bigger platform upon which he can promote his desire to see multi-district efforts to control the burgeoning cannabis industry.

Interestingly, the press release announcing the selection of Billy J. Williams was released on the very day that Jeff Sessions resigned as U.S. Attorney General.

It would have been worth following how Jeff Sessions, known for his strong opposition to any form of cannabis legalization, would have acted if he had Williams (a man known for his zeal to see tougher marijuana legislation) as his de facto chief advisor on matters of marijuana. Industry players could be sighing with relief that those two men never got to work closely together.

Medical marijuana became legal in Oregon in 1998 while a ballot measure legalized recreational cannabis in 2014. This means that Oregon was one of the pioneer states to allow adult-use cannabis. The zeal of Attorney Williams can therefore be seen in some quarters as an attempt to roll back the tolerance of cannabis in that state.

This year has seen huge developments for the cannabis industry in North America. In Canada, recreational cannabis became legal in the middle of October, after a year of political debate and commercial preparation. South of the border, pressure mounted for reform of federal laws to support states making their own choices, with 64 percent of Americans now saying that they favor legalization. While political maneuvering ahead of the midterm elections delayed efforts to legalize industrial hemp through the 2018 Farm Bill, voters supported the legalization of medical cannabis in Missouri and Utah and of recreational cannabis in Michigan. With cannabis now legal for medical use in 33 states and for recreational use in 10, prohibition is clearly on its last legs.

This wave of change is leading to staggering growth in the cannabis industry. Companies are seeing dramatic rises in revenue as new markets open up, new products are created and new customers cast off tradition to give cannabis a go. This is creating a new space for cannabis companies to work in, where new strategies are being tested alongside new products.

Cannabis Market Keeps Growing

420 with CNW – Stanford Research Shows Marijuana Improves the Sex Life of Women

Researchers at Stanford University were intrigued by the numerous reports on the internet claiming that cannabis was beneficial to the sex lives of women. The researchers therefore decided to put that anecdotal evidence to the test. The results, published in the Journal of Sexual Medicine, confirmed that women had better sexual experiences if they consumed cannabis before indulging in sex.

Don’t imagine that bespectacled old scientists stood by with their microscopes and other instruments in order to measure what was happening as the study’s subjects had sex. No, nothing of the sort happened.

Instead, an Obstetrics/Gynecology (ObGyn) clinical practice was used to recruit nearly 200 adult women who were sexually active. The participants were given questionnaires eliciting their assessment of how cannabis affected their sex lives.

Of those who said that they consumed cannabis before having sex, 68 percent admitted that sex was more enjoyable for them. 72 percent of those who said cannabis makes sex more pleasurable added that those beneficial effects happened each time they had sex after consuming cannabis.

Interestingly, 62 percent of the respondents who consumed cannabis before having sex revealed that cannabis made their orgasms more intense and pleasurable. None reported that her sex drive reduced as a result of consuming cannabis before having sex.

27 percent of the respondents also admitted that marijuana helped to increase vaginal lubrication during sex. However, 37 percent said they didn’t observe any change in the level of lubrication whether they consumed cannabis before sex or not.

16 percent of the women in the study admitted that they took cannabis before having sex in order to reduce the pain they normally felt during intercourse. 83 percent in this category of women said pain during intercourse was reduced each time they consumed marijuana prior to having sex.

While releasing their findings, the researchers said that the results above were their preliminary findings since they intended to continue the study over a longer time and include more respondents.

However, the researchers were convinced that it was indeed true that the consumption of cannabis resulted in an overall improved sex life for women.  Only 10 percent of the respondents claimed that their sex lives weren’t improved by cannabis consumption prior to sex. The degree of that improvement (or lack thereof) seems to be impacted by other factors which are yet to be identified. The first weekend of November witnessed the first ever cannabis grow workshop in Cape Town, South Africa. Event tickets were sold out in two days flat after the organizer, Grant Taylor, went to social media to announce the event.

He said that the idea of organizing a workshop on how to grow marijuana was motivated by two things. First, the Constitutional Court ruled recently that adults were free to grow and consume cannabis in South Africa as long as it wasn’t sold or consumed in public.

Secondly, Grant had previously tried to grow something and he had failed miserably. He had also recently heard many people who live in apartments saying that it was impossible for them to grow anything in such an environment.

The workshop was therefore organized to teach people the complexities involved in growing cannabis organically. To that end, organic soil and pots were also on sale so that event attendees could go and start cultivating their own marijuana or any other plant they wished to grow.

Grant and his team of organizers didn’t have any cannabis seeds or plants on sale during the workshop. This omission was deliberate since the court ruling allowing citizens to grow and consume marijuana didn’t permit the sale of marijuana or its products.

Grant Taylor admitted that putting the event together wasn’t a smooth task. He was denied the venue he preferred because the management at that venue wasn’t comfortable about hosting a cannabis workshop in their premises.

Grant had used that same venue in the past to host trainings in hydroponics, but that history wasn’t enough to secure the venue for a workshop on cannabis.

Grant isn’t deterred by such setbacks and he plans to host similar events in future.

For now, one of the co-organizers of the cannabis workshop is going to set up and run a vlog (video blog) on cannabis while Grant will set up a Facebook group and manage it in addition to operating a website on cannabis cultivation.

Contrary to what some people may have thought, the Grow Cannabis Workshop wasn’t attended by drug addicts. Ordinary people like florists, nurses and dentists were in attendance to learn how to grow this plant.

Those interviewed at the workshop said that they wanted to learn how to grow cannabis so that they could have a supply for medicinal use.

Over the coming months and years, more and more U.S. cannabis companies are likely to move north in order to list on stock exchanges in Canada. Many short term and long-term interests are driving this move.

First, Canada recently legalized recreational cannabis years after medical cannabis was permitted in that country. This means that the uniform laws in Canada make that country more attractive (for now) than the U.S. where marijuana companies operating in legal states must constantly look over their shoulders in fear because the federal authorities can take action against them for violating federal laws.

Legitimate cannabis companies in the U.S. constantly feel hunted and moving to Canada can provide some reprieve from the legal issues back home.

The legal issues in the U.S. also make it nearly impossible for cannabis companies to access banking services. Companies conduct all their transactions using cash, and it is hard to find where to keep all that money.

The Canadian environment allows marijuana companies to access some measure of banking services although the bigger banks that have an international presence still keep cannabis businesses at arm’s length due to fears about possible complications in the U.S. and other countries where marijuana is illegal.

Another reason that is driving U.S. marijuana companies across the border to the north is the friendlier listing requirements in Canada when compared to the conditions in the U.S.

For example, only companies that are valued at more than $100 million in publicly held securities can apply to list on the New York Stock Exchange (NYSE). NASDAQ accepts companies whose pre-tax income has been at least $11 million for three years in a row.

Those strict conditions make it hard for marijuana companies to list as soon as they would want in order to access financing to grow and consolidate their positions in the market.

In contrast, the TSX exchange requires a company to have books of accounts that show that the company had at least $300,000 as their pre-tax income the year before they apply to list. Of course there are other conditions, but the income/company valuation differences show how friendlier the stock exchanges in Canada are.

Furthermore, the stock exchanges in the U.S., such as the NYSE, don’t have many purely cannabis businesses listed (partly because of federal laws). Biopharmaceutical companies like GW Pharmaceuticals are the ones one is likely to find on those exchanges. This limits the opportunities for serious market activity for the industry.

Canada has numerous cannabis businesses traded publicly. This provides a vibrant market for companies which want to benefit from the capital that can be got when companies are listed.

As you can see from the factors above, the exodus of U.S. cannabis companies into Canada is likely to continue until conditions back home improve and open that potentially bigger market. 420 with CNW – Colorado Jury Rejects RICO Act Claim Against Marijuana Company

A few days ago, we reported about a landmark case in Colorado that had the potential to set a precedent that could have huge implications for the cannabis industry across the US. In that lawsuit, a couple sued a marijuana grow facility for making the plaintiffs’ property “lose value” due to the smell coming from the indoor cultivation facility.

That case was the very first of its nature to reach a jury and the entire cannabis industry watched with bated breath to see what decision will be made once the hearings end and the jury retires to make its verdict.

The defendant had planned to use property rate valuations as proof that the claim was unfounded since the state kept collecting higher taxes from that neighbor’s property due to the property’s increase in value despite the presence of the indoor grow in the area.

The case was heard and the jury withdrew to consider the evidence and arrive at a decision. In less than half a day, the verdict was ready and the plaintiffs’ claim was dismissed.

It is unlikely that the couple will appeal the federal court’s decision in a higher court since they stand a minimal chance of succeeding after this decision.

Industry watchers and the legal fraternity have said that the Colorado decision may have poured water on any other individuals or groups that were planning to target cannabis companies using the anti-racketeering laws of the mafia era.

In fact, three other lawsuits of the same nature are still pending in Oregon, Massachusetts and California. It isn’t known how many other copycat lawsuits would have been filed if the events in Denver had gone against Parker Walton’s cannabis grow facility, but chances are high that opportunistic law firms would have egged on many property owners to file cases.

The jury’s verdict has therefore put a dampener on all those who were harboring thoughts of shifting their attack against the cannabis industry to another front.

However, the risk of lawsuits still remains since there is a mismatch between the laws in states where marijuana is legal and federal laws that regard cannabis as a Schedule 1 substance (no medical use but a high likelihood of being abused). It is also very expensive to defend against such lawsuits, and Walton may have ended up losing his business if the jury had ruled against him.

Other companies in the industry, such as Marijuana Company of America Inc. (OTC: MCOA) and Medical Cannabis Payment Solutions (OTC: REFG) may be celebrating the verdict from Denver, but other threats to the industry still remain.
