Cannabis is an interesting crop to cultivate. The crop is part of a group of plants that use photoperiodism to determine their biological calendar, which means they rely on the length of days and nights to initiate physiological changes. Simply put, a certain number of daylight hours will induce a specific developmental stage, with most cannabis growers applying more than 18 hours of light every day to keep their plants in the vegetative stage and 12 hours of light to induce flowering.

When you mention supplementary lighting, most growers think of indoor grows that have no access to sunlight. However, did you know that you could also apply supplemental lights to an outdoor cannabis farm? Efficient use of outdoor lights can allow growers to take advantage of their real estate for larger yields without having to resort to greenhouses and blackout clothes. To understand how, let’s take a quick look at cannabis history.

Since cannabis has been illegal for decades, we don’t know a lot about it. This isn’t just restricted to its effects but regarding genetics as well. Most of the cannabis genetics currently on the market were bred for the states that first allowed cannabis cultivation. Including Colorado, Washington and Oregon, these Northern states have longer summer days that allow for a longer vegetative state (as much as seven weeks) and large yields. In Southern states with shorter summer days, these cannabis breeds with the same genetics would have a short vegetative stage (around one to two weeks), leading to stunted growth and smaller yields.

That’s where supplemental outdoor lights come in. If you are growing cannabis that is dependent on longer days to vegetate in a region with shorter days, say fourteen hours per day, you will have to trick the plants into thinking the days are longer. Called “night interruption,” this process involves shining low lighting to plants during the night to make the days longer, at least from the plants’ perspective. This can be done from 10 p.m. to 2 a.m. using stadium lights or floodlights. Ensure you use several lights on multiple sides of your farm to ensure all the plants receive sufficient light. If any of them are shaded, they can still begin flowering.

Some farmers use string lights, which can be pricey when applied to an outdoor grow. LEDs will also work, and they are easier on the pocket. You may also want to look into different cannabis genetics to find the ones bred for your latitude. If you cannot find a variety that’s suited for your location, strategic use of night interruption could ensure your cannabis stays in the vegetative stage for longer and produces a large yield.

420 with CNW — Wyoming Supreme Court Admonishes Prosecutor for Allowing False Testimony to Be Presented in Court

The Supreme Court in the state of Wyoming has admonished an attorney in Cheyenne for permitting a DCI agent to make a false testimony in a case against hemp growers.

Last year during a hearing of the case, Special Agent Jon Briggs of the Division of Criminal Investigation gave a false testimony about an exchange he had with one of the defendants when officers conducted a raid on the operation. The defendant, a contract farmer by the name of Brock Dyke, presented to the agent test results that showed that the hemp crop was legal during the raid, which took place in 2019. However, during preliminary hearings, Briggs asserted that the tests possibly showed that the hemp was above the legal limit of THC, which was false. The case sought to prosecute hemp growers as cannabis traffickers.

Hemp has been legal in Wyoming since 2017. However, under the state’s law, hemp plants shouldn’t have a concentration of more than 0.3% THC.

David Singleton, the senior assistant district attorney in Laramie County, was the presiding prosecutor in the case.

After the hearing, Tom Jubin, who was the defendant’s attorney, asked Singleton and Briggs to correct the record. However, the two tried to reinforce the false testimony once more in a court hearing a few months later.

The order of public censure released by the Supreme Court shows that during this hearing, which was held in August, Briggs not only reiterated his false testimony but also stated that he was not aware of the request by the defendant’s attorney. For his part, Singleton acknowledged that he violated the state’s judiciary rules of professional conduct and agreed to pay administrative fees to the Wyoming State Bar.

Brock Dyke revealed in an interview that during the raid, which occurred in November 2019, the DCI seized more than 600 pounds of hemp, noting that law enforcement officers armed with rifles and in tactical gear carried out the operation.

Singleton was trying to charge the hemp farmers whose operations were raided with drug trafficking charges. However, the attempt was thwarted after Antoinette Williams, the circuit court judge in Laramie County, dismissed the charges during the hearing in August.

It is yet to be confirmed whether Briggs will be charged for giving a false testimony. Additionally, Forrest Williams, director of the DCI, hasn’t responded to a request for a comment.

This Wyoming case highlights some of the challenges that cannabis sector players face as they conduct lawful activities and shows how much additional reforms are needed before cannabis entities such as Chalice Brands Ltd. 420 with CNW — Missouri Court Rules That Medical Cannabis License Applications Aren’t Secret

Medical marijuana license applicants in Missouri were offered a much-needed reprieve after an appeals court ruled that state regulators cannot keep information from medical cannabis applications secret. In 2018, voters approved a constitutional amendment that legalized medical marijuana, making Missouri the 33rd state to legalize medical cannabis. Soon after, hundreds of business owners who saw a solid business opportunity applied for business licenses for everything from growing and distributing to selling cannabis, and chaos soon ensued.

More than 820 companies were denied licenses. Those companies asked an administrative hearing commission to look into the scoring system used to score candidates, claiming that it was flawed and unfair. Health and Senior Services (“DHSS”), which was tasked with overseeing the license application process, scored more than 1,700 candidates, ultimately awarding state licenses to 60 cultivators, 86 infused manufacturers, 11 testing facilities, 192 dispensaries and 22 transporters.

Consequently, Kings Garden Midwest, a California-based company that had sought and failed to acquire a cannabis cultivation license, filed a lawsuit against the state claiming that the scoring process used to grade applicants was “arbitrary and capricious.” Applicants would be awarded different points for the same or similar answers, and Kings Garden wanted to go over the information on other applications to see if the scoring was actually fair. The court agreed with Kings Garden, stating in a precedent-setting ruling that the information on application licenses could not be kept secret.

Since applications are ranked competitively against each other rather than solely on their own merits, the court wrote, comparing the information in these applications was the only way to find out if the Kings Garden’s application was scored in an “arbitrary or capricious manner.” According to the court, keeping this information from companies seeking to prove whether or not the scoring system was flawed is “unreasonable and absurd.” However, the DHSS, which outsourced the application scoring process to a private company, argued that the constitutional amendment that legalized medical marijuana in the state requires that such information remains confidential.

Lisa Cox, a DHSS spokesperson, says that the department is planning on appealing the ruling at the Supreme Court. Missouri’s licensing process has been upheld by numerous legal challenges, and Greg Wu, co-chair of cannabis law practice group Hardy & Bacon law states that the state will see quite a number of lawsuits regarding medical marijuana applications. Lyndall Frankel, the DHSS’ top cannabis regulator, says that the health department expects to spend at least $12.4 million fighting these suits.

The campaign to accord the cannabis industry equal treatment is likely to notch a win if the DHSS loses its planned appeal to the state Supreme Court. If that happens, the entire sector, including companies such as Chalice Brands Ltd., formerly Golden Leaf Holdings Ltd. 420 with CNW — Mississippi Supreme Court Nullifies Voter-Approved Medical Cannabis Ballot Measure

The Supreme Court in Mississippi has overturned an initiative passed by state voters to legalize medical cannabis. This ruling was made on Friday after a mayor challenged the legalization initiative in court.

While the complaint against the amendment didn’t raise any objections against the contents of the voter initiative, the plaintiffs took issue with the procedure under which the measure was certified by the state secretary of state.

In its ruling, the Supreme Court observed that it noticed that an overwhelming number of voters supported the proposed constitutional amendment. However, the court was left with no choice but to uphold the suit filed by the mayor of the city of Madison on the ground that statutory requirements were not adhered to before the measure was certified for inclusion on the 2020 ballot.

The petition was premised on a law that stipulated that for any initiative to qualify for inclusion on the ballot, it should be supported by Congressional district voter signatures, which are no more than one-fifth of all signatures required to get the measure certified. That particular law was passed at a time when Mississippi had five Congressional districts; however, currently, the state only has four such districts. In short, it is currently impossible to abide by that law if any initiative that seeks to amend the state constitution is to stand a chance of being certified.

State officials, including the secretary of state, strongly argued that the spirit of the law cited was to make sure that support for any constitutional amendment was spread out throughout the state, and that the support for initiative 65 met that requirement.

Nevertheless, the majority of the justices of the Supreme Court (six out of nine) ruled that their hands were tied as the law had to be followed when passing the amendment. They advised that while the Supreme Court couldn’t fix that procedural issue, the administration or the legislature had the power to assess the practicality of that law and then make the necessary changes.

Marijuana advocates expressed regret that the case ended the way it did, and the Medical Marijuana Association of Mississippi said it was sad that patients who had hoped to access medical cannabis soon would have to continue suffering since the will of voters had been thwarted.

Many other cannabis initiatives have suffered defeat before state Supreme Courts. For example, a proposed 2022 Florida initiative was annulled by the Supreme Court while a 2020 initiative in Nebraska was also voided by the highest court in the state before the November ballot.

420 with CNW — Colorado Governor Enacts Bill Allowing Students Access to Medical Cannabis

Last week, Colorado Governor Jared Polis signed a bill to expand access to medical cannabis for students in schools. The state’s current law allows principals the discretion to establish policies that prevent or allow schools to administer and store marijuana-based medicines. Under the new legislation, this discretion is eliminated, which means that school boards will establish policies on how to store marijuana medicines while also allowing their personnel to volunteer to administer it to students who need it as well as possess it.

The governor’s office stated that Polis is also planning to sign another legislation that was recently advanced to his desk. This legislation would increase the recreational marijuana possession limit in Colorado from one ounce to two ounces.

Victoria Graham, who is the governor’s spokesperson, noted in an email that Polis intended to sign the legislation. Earlier, Polis stated that he was pleased to sign SB 21-056, which would allow marijuana to be treated in the same way prescribed medicines were treated. He added that the legislation would make it harder to discriminate against volunteers such as teachers and school nurses who had come forward to administer medical marijuana.

NORML state policies manager Carly Wolf stated that students who depend on medical marijuana shouldn’t be denied access simply because the marijuana needed to be administered in a school setting.

Cannabis advocates note that while this legislation is a step in the right direction, they look forward to the governor signing the bill to double the cannabis possession threshold for individuals aged 21 and above in the state. This legislation would also need courts to grant requests to seal previous records of marijuana possession if the proper documentation has been provided. This would eliminate the need to consult with a district attorney.

Wolf explained that passing this law would prompt law enforcement to direct their resources toward fighting other crimes instead of expending resources to arrest individuals for minor, nonviolent offenses. The law would also make sure that low-level offenders don’t have to pay fines they couldn’t afford.

This change in policy may significantly influence future pardons. In October 2020, the governor issued an executive order that gave clemency to nearly 3,000 individuals who had been convicted of possession. However, his office decided not to pardon individuals who had been convicted of possessing more than an ounce of marijuana because that amount was in violation of the present state law.
