420 with CNW — Mexico’s Chamber of Deputies Approves Marijuana Legalization Bill

Last week, the majority of the legislators in Mexico voted to legalize cannabis for recreational purposes, despite some of the legislators rejecting the legislation as they had health concerns. The Mexican Chamber of Deputies passed the bill with 23 abstentions, 129 votes of opposition and 316 votes in favor of the bill. This approval is a step forward by legislators to decriminalize cannabis, with senators having approved another version of the legislation in November last year. There were some changes that were made to the bill that senators voted on in this recent session.

Earlier in January, health authorities in Mexico had issued rules to secure pharmaceutical production and medical use of cannabis derivatives.

In last week’s move, lawmakers voted to publish the federal law for the regulation of marijuana, in addition to approving changes to the federal Penal Code and the General Health Law.

The legislation will decriminalize the possession of up to 28 grams of cannabis, with users being required to get a special permit to allow them to grow cannabis plants on their premises as well as a special permit to import, export, transform and research on cannabis. Presently, it is illegal to be in possession of more than five grams of cannabis.

Conadic, which is the National Commission Against Addictions, makes up part of the ministry of health. It will be in charge of the promotion and regulation of cannabis, which isn’t what the Senate had agreed on. Instead, the Senate had agreed to create a Mexican institute for the control and regulation of marijuana.

Additionally, the chamber of Deputies also voted to permit ownership of six plants in each household and eight if there were two consumers. This differs from what the senators had approved in November, which was four plants. The bill will be advanced to the Senate, where the changes will be reviewed before the final law is voted upon. The MORENA Party, which is  the ruling party, is confident that the bill will be approved, arguing that the legislation could help address drug cartels in the country.

For the longest time, the country has waged a war on powerful drug cartels, with thousands of lives being lost each year due to violence. If the new legislation is approved, it will make Mexico one of the biggest regulated markets for marijuana in the world. Additionally, Mexico would become the third country globally to legalize recreational use of marijuana nationwide after Canada and Uruguay.

However, some critics have concerns that the legislation would make cannabis more accessible to children.

420 with CNW — Michigan Rolls Back Key Recreational Cannabis Business License Restriction

After months of restricting access to its recreational cannabis industry, Michigan has loosened a key restriction that kept many from acquiring a recreational cannabis license. Beginning on March 1, 2021, applicants for five types of recreational cannabis licenses will not be required to have an active medical marijuana license to qualify. The state initially put this policy in place to allow the companies that first invested in cannabis to become established and recoup their costs before the industry was filled with sellers, says the director of the Michigan Cannabis Industry Association.

Although the requirement was supposed to remain active for two years after the state began issuing recreational cannabis licenses, cannabis legislation passed by voters in 2018 said the state could remove the prerequisite after a year to fight black market sales, address reduced supply and provide rural communities more access to cannabis. According to the Marijuana Regulatory Agency (“MRA”), the body in charge of regulating cannabis in the state, it is loosening licensing requirements earlier than planned to deal with an influx of unlicensed and untested cannabis from the black market.

Individuals will now be eligible for the following licenses even if they do not currently hold an active medical cannabis license: Class B marijuana grower, Class C marijuana grower, marijuana processor, marijuana secure transporter and marijuana retailer. The MRA first announced the change in license eligibility last October, saying that if it determined that more licenses would deal a blow to black-market sales, boost supply to meet rising demand or provide access to rural communities, it would remove the restriction.

Data from the Michigan State Police Marijuana Tobacco Investigation Section shows that 83% of illegal cannabis plant and product seizures happen in municipalities that do not have licensed cannabis establishments. In the city of Detroit, there has been a 36% increase in drug-related homicides and a 214% increase in nonfatal cannabis-related shootings, says the agency. The state had reduced supply to just the companies that held medical marijuana licenses, and since they couldn’t cater to demand, customers turned to the black market.

According to the MRA, greater participation by municipal authorities is a positive step towards curbing the growth of the illicit market. The agency will update the license applications and instructions on its website, and starting this month, it will not accept previous versions of recreational cannabis applications. Interested individuals should submit their applications via the Accela Citizen Access online portal.

Marijuana stocks are the latest stocks to experience the brief high driven by exposure on Reddit. This year, social media has demonstrated that it can be a powerful driver of retail, which has left analysts and investors wondering which company may be the next GameStop (NYSE: GME)

This hefty investment sent prices soaring — before they dropped again. Tilray, a Canadian marijuana producer listed in the United States, began the week at $25 per share before quickly rising to $67 on Wednesday then declining significantly back to $29 by market close on Friday. Tilray was the second most traded share on Thursday on Robinhood, which is a trading platform.

This isn’t the first time the company has been the subject of attention from retail investors. After its IPO launch in 2018, the company’s stock price briefly spiraled to $300 per share due to a short squeeze.

Another Canadian marijuana producer, Sundial, was also among the companies with the most traded stocks on Robinhood. The company’s stock price increased to more than $1 on Monday before growing to $4 on Thursday. By Friday, the share price has dropped back to $2.

Vanda Research senior strategist Viraj Patel explained that when some company names begin gaining traction on StockTwits, Twitter and Reddit’s r/WallStreetBets, the hype is developed, which then brings about a network effect. This is when the money starts flowing, and the price starts to shift. Patel further explained that this herd behavior was unusual in the way that investors moved from one asset category to another swiftly.

Marijuana bulls point to the favorable paths of American policy. Flows into marijuana stocks have increased significantly since the November 2020 U.S. elections, when legalization was approved in many states across the country. The day after the election, the top five shares traded on Robinhood were all CBD firms.

According to data provider TrackInsight, assets under management by marijuana-tracking ETFs are at record highs of $1.9 billion, with $527 million flows in January — triple the previous record, which was set in 2020 December.

420 with CNW — Legislators in South Dakota Remain Hopeful about Cannabis Legalization

A circuit judge’s decision to hinder a voter-approved initiative that legalized adult-use cannabis from progressing in South Dakota isn’t discouraging legislators from advancing with a series of marijuana related measures. While many doubt that cannabis prohibition will end soon in South Dakota after Judge Christina Klinger overturned Constitutional Amendment A, some lawmakers are working on legalizing cannabis through the statutes of the state.

Before heading into a strategy meeting with other legislators and lobbyists, Senator Brock Greenfield told reporters that legalizing was still a real possibility and that planning ahead for any situation was the best option.

Defendants legally challenging the judge’s decision to strike down Constitutional Amendment A are expected to appeal the decision to the state’s Supreme Court. Greenfield asserted that if the judge’s decision wasn’t revoked after the appeal, he would expect that South Dakotans for Better Marijuana Laws, which was responsible for placing the initiative on the voters’ ballot, would try to legalize cannabis again.

However, several legislators argue that trying to legalize cannabis again through the legislative way may give rise to better results. Senator Arthur Rusch stated that among the many flaws of the initiative was that it gave all its rule-making powers to the state’s Department of Revenue, which many lawmakers were not on board with.

Rusch said that if the Supreme Court decided to uphold the circuit judge’s ruling, then the state’s best option for legalizing cannabis would be to assemble all stakeholders and try to negotiate and draft a policy that would encompass the voters will but refrain from conflicting with other regulations in the state’s constitution. Rausch, who is  a former attorney and judge, stated that Amendment A contained some flaws, noting that advocates would be better off if they collaborated with advocacy groups that were working on cannabis, partnering together to draft a measure that was satisfactory to everyone.

The deadline for filing new measures for the legislative session in the state has already passed. However, Greenfield has come up with a vehicle bill that can be used to carry any cannabis-related bills that are yet to be recorded by the Legislative Research Council by the now expired deadline. The vehicle bill could, for instance, allow Constitutional Amendment A’s language to be added into Greenfield’s bill collectively before being proposed formally to his colleagues for consideration.

The good news is that Measure 26, which legalized medical cannabis in the state, has not been affected by the ruling and is set to go into effect on July 1, 2021.

Jazz Pharmaceuticals (NASDAQ: JAZZ), a global pharmaceutical company, has come to an agreement to acquire GW Pharmaceuticals (NASDAQ: GWPH) for $7.2 billion in stock and cash. GW Pharmaceuticals, which is based in the United Kingdom, is one of the biggest medical cannabinoid businesses globally.

This buy would be the biggest move made by a pharmaceutical firm into cannabis to date, which demonstrates that pharma companies recognize both the future and current potential of cannabinoid-based treatments.

This move into cannabis could also encourage more investments into the growing field. Additionally, the deal establishes the validity of GW Pharmaceuticals’ focus on developing new treatments through official regulatory pathways.

The proposed stock and cash transaction reads that every GW Pharmaceuticals shareholder will receive $20 in Jazz ordinary shares for every GW Pharma ADS (American Depositary Share) and $200 in cash. This will result in a total consideration of $7.2 billion.

During a conference call with analysts, GW Pharmaceuticals CEO Justin Gover stated that in the last two decades, the company had been able to show that the cannabinoid platform was a compelling and real science, adding that there’s a lot of potential for growth in the approved indications.

The company’s chief medical product is Epidiolex, which achieved nearly $510 million in yearly sales in two years of its introduction to the market. The drug has been approved in some countries as a treatment for seizure disorders.

Jazz Pharmaceuticals CEO Bruce Cozadd stated that he saw an opportunity to grow sales in Europe. He told analysts that while the GW Pharmaceuticals team had done a remarkable job, there was opportunity to expand.

The deal has been approved by the boards of the respective companies and is expected to close within 2021’s second quarter. Before entering the agreement with GW Pharmaceuticals, Jazz Pharmaceuticals, which is based in Dublin, Ireland, had announced that it expected to report earnings between $2.32 and $2.38 billion last year.

Unlike other marijuana companies that capitalize on medical marijuana products that may not have gone through successful clinical studies, GW Pharmaceuticals has developed products using regulatory approval pathways, which include conducting clinical trials.

In addition to this, GW Pharmaceuticals has spent the majority of its capital on development and research, which helped it become the biggest medical cannabinoid firm globally. The firm has employed more than 192 individuals in operations and manufacturing with an additional 278 in the development and research department.

Furthermore, the company exports its products to more than 30 countries, either for research or commercial purposes. The company’s shares are traded on NASDAQ as GWPH.

420 with CNW — Colorado Premium Cannabis Flower Causes Prices to Soar to Record Highs

For Colorado’s cannabis industry, 2020 was a boom year. While other sectors saw their operations severely cut down amid lockdown and self-distancing orders, Colorado categorized cannabis as essential, allowing marijuana businesses to continue selling with coronavirus-related measures in place. Even before transactions for November had been tallied, the state had hit $2 billion in medical and recreational cannabis sales.

These record-breaking sales can partly be attributed to record high, wholesale, cannabis-bud (flower) prices that in 2020 increased to levels unseen since 2016. According to the Colorado Department of Revenue, the average market price by wholesalers for a pound of marijuana flower reached $1,721 as of Jan. 1, a price last seen in July 2016. This hike in price has been fueled by increased demand for cannabis amid the coronavirus pandemic coupled with heightening consumer interest in costlier premium flower brands.

Prices for wholesale cannabis bud prices have increased by at least 30% since October, a welcome change for cannabis growers that were looking at an average price of $700 per pound just two years ago. As such, the increase in price has trickled down to manufacturers, retailers and consumers. And while one might think more expensive prices would turn consumers off, they have actually been gravitating towards these pricier, premium products.

Zachary York, inventory manager for Lightshade, a Denver-based vertically integrated cannabis company, says people have no problem paying more for higher-quality products. At the start of the pandemic, cannabis saw a hike in demand as consumers stocked up for the impending lockdown. Most of them went for lower-quality budget flower first, eventually working up to the higher-quality, pricier cannabis products. According to York, customers who sampled high-quality flower aren’t thinking of going back.

Several other cannabis executives concur, saying that consumers are willing to pay more for small-batch, premium flower brands such as Snaxland and Cookies. Knowing this, wholesalers have been able to command higher prices without much pushback from the rest of the supply chain or customers. With the growth in popularity of branded marijuana flower, certain wholesalers have been able to sell a pound of cannabis for as much as $4,000, York observed.

Tim Cullen, the CEO of Colorado Harvest CO, a vertically integrated marijuana operator based in Denver, says branded flower companies are increasing demand for top-shelf cannabis flower. They use advanced marketing techniques, are easy to recognize, and have devoted social-media followers.

Joe Spadafora, a partner and the head of marketing at Denver-based Veritas Fine Cannabis, attributes these new buying behaviors to the evolution in the tastes of consumers. “It reflects the market through its evolution,” he notes.

420 with CNW — Utah Begins Medical Marijuana Home Deliveries

When the coronavirus pandemic struck, the cannabis industry was left in a precarious position. Although most states that have legal cannabis markets declared the young industry essential, medical cannabis patients were at great risk every time they headed out to get their medicine. Plenty of them are either elderly, immunocompromised, or both, putting them at an even greater risk of infection and suffering severe symptoms. To help keep both patients and staff safe, some states began allowing cannabis home deliveries.

In Utah, medical marijuana couriers have started making deliveries of medical cannabis orders to patients’ homes. The state first allowed medical dispensaries to make home deliveries last May, as long as the dispensaries met strict requirements for delivering themselves or through a licensed medical marijuana courier. More than 10,000 Utah residents have applied for and received medical cannabis cards and, for plenty of them, going out to buy medical marijuana can be a matter of life and death.

WholesomeCo, a medical cannabis company based in Bountiful, Utah, is starting out small. The company has hired 10 couriers to cover Salt Lake, Tooele, Weber, Cache, Summit, Wasatch and Utah counties. According to CEO Chris Jeffery, the company’s goal is to start making statewide deliveries within six months to give patients who are medically fragile or have long distances to travel in order to access a dispensary a better option of getting their medicine.

The dispensary deals with patients who suffer from multiple sclerosis (“MS”), are terminally ill or suffer with conditions that make it nearly impossible for them to even get out of their bed. Such patients need to have medical cannabis delivered to them as they essentially cannot leave their homes. One Salt Lake patient says she is at such a high risk of contracting COVID-19 due to her health conditions that she hasn’t been to the grocery store since last April.

Jordan Bartholomew, another medical cannabis patient living in Salt Lake City’s Ballpark neighborhood, says he largely gets around using a bicycle. With that mode of transportation, visiting a cannabis dispensary to get medical marijuana for his chronic back pain can be quite challenging. Home deliveries have made things a “lot more comfortable,” stated Bartholomew.

Although Utah allowed cannabis home deliveries last year, WholesomeCo is the first medical dispensary to take advantage of the home-delivery framework. However, officials expect other cannabis companies to follow suit, with the director of the state health department’s Center for Medical Cannabis saying he hopes that couriers will make it easier for rural residents who live hours from cannabis dispensaries to access medical cannabis.
