420 with CNW — Trump Releases a Dozen Marijuana-Related Convicts Using Presidential Clemency Powers

As former President Donald Trump’s tenure came to a close on Jan. 20, 2021, he issued a flurry of executive pardons and commutations with just hours left in office. While the batch of 73 pardons and 70 commutations contained a few controversial names, the majority of those who received the 11th-hour pardons and commutations had been championed by criminal justice reform advocates. Of the more than 140 individuals who received clemency from the former president, 12 of them had been incarcerated due to marijuana-related offenses.

The final batch of pardons came after several White House officials and criminal justice reform advocates scrambled for days to finalize the list and convince Trump to approve it. The president’s power of clemency allowed him to issue pardons, amnesties, reprieves and  remissions as well as commutations for federally prosecuted crimes. With five more states legalizing marijuana on the November ballot and the House of Representatives passing legislation that would decriminalize cannabis at the federal level, the pardons and commutations for marijuana-related offenses were inevitable.

Most of the defendants, including some who were serving life sentences, had their sentence commuted rather than pardoned. This means their sentences were either reduced or ended while their initial convictions remained. The only individual who received a full pardon was Utah’s Lynn Barney who had served a custodial sentence of 35 months for firearms possession and had been released. Prior to that, he had been convicted on charges of distributing marijuana. A statement from the White House describes him as a “model citizen” who is devoted to his work and children.

Other marijuana offenders who received the last-minute clemency include the following:

  • Craig Cesal (61) was serving a life sentence for conspiring to distribute marijuana from Mexico, across the Texas border, and into Georgia back in 2002. His home state Illinois now allows both medical and recreational cannabis.
  • James Romans (42) from Indiana who was sentenced to life in prison without parole for conspiracy to distribute marijuana. His sentence was commuted after he served 10 years.
  • Jonathan Braun (36) who was sentenced to 10 years in prison for conspiracy to import marijuana and to commit money laundering.
  • Noah Kleinman (45) was sentenced to nearly 20 years in California for illegally distributing marijuana.
  • Ferell Damon Scott (56) was sentenced to life for possession with intent to distribute marijuana
  • John Knock (73), a first time, nonviolent cannabis offender who was handed two life sentences plus 20 years for conspiracy to import marijuana into Canada and Europe.
  • Anthony DeJohn was sentenced to life for conspiracy to distribute marijuana.
  • Corvain Cooper (41) was sentenced to life for nonviolent participation in a conspiracy to distribute cannabis.
  • Way Quoe Long (58) was sentenced to 50 years for nonviolent participation in a conspiracy to manufacture and distribute marijuana.
  • Michael Pelletier (64) was sentenced to 30 years for conspiracy to distribute marijuana.
  • Brain Simmons was sentenced to 15 years for a nonviolent, marijuana-related offense.

420 with CNW — NJ Cannabis Legalization Still in Legal Limbo After New Year Begins

On November 3 last year, voters in New Jersey overwhelmingly approved a ballot question asking whether the state should allow adults aged 21 and over to sell, possess and use cannabis. The Legislature and Cannabis Regulatory Commission was tasked with creating a regulatory framework for recreational cannabis, with a constitutional amendment that would officially legalize cannabis kicking in on Jan. 1, 2021. However, with lawmakers still negotiating key sections of the legislation, the state still hasn’t passed legislation that would launch the recreational market.

Robert Williams, a retired constitutional law professor at Rutgers Law School, says that nearly two months after voters approved cannabis legalization, the commission hasn’t created any regulations or implemented any laws, a situation he calls “odd.” Although state lawmakers have already crafted and passed enabling legislation consisting of two bills to set the ball rolling, Gov. Phil Murphy hasn’t signed any legislation into law.

The governor, who had cannabis legalization as one of his campaign platforms, is holding off on signing the legislation until lawmakers add a provision to levy fines on underage marijuana users. According to a proposed change his office sent to legislators, anyone younger than 21 found with one ounce or less of cannabis would be fined $250 while the possession of one to six ounces of cannabis would carry a $500 fine. Along with decriminalizing cannabis, the goal was also to ensure that minors were protected, Murphy says.

Activists also argue the bills don’t do enough for the communities that were disproportionately affected by marijuana laws. Police in New Jersey are particularly tough on marijuana crimes, with Black people being three and a half times more likely to be arrested for possession than white people, despite relatively similar usage rates. Other issues holding back the legislation include the capping of the number of available licenses for the first two years and giving employers the right to test their employees for THC.

Levying fines on underage people who use cannabis goes against the legislation’s objective, which is to limit interactions with police, especially among Black youth. ACLU of New Jersey executive director Amol Sinha asks why minors should be burdened with criminal records if the state is passing laws to clear criminal records of people with cannabis-related offenses.

With the cannabis legislation hanging in limbo, Attorney General Gurbir Grewal has asked state prosecutors at all levels to dismiss or, at the very least, delay any marijuana charges that would otherwise be considered legal under the pending legislation.

420 with CNW – South Dakota Marijuana Legalization Measure Cleared for 2020 Ballot

On Monday, the secretary of state’s office in South Dakota announced that a measure seeking to legalize recreational marijuana has qualified for the state’s November ballot.

In September, the former federal prosecutor, Brenda Johnson, submitted the legislation which would permit people who are 21 years and above to possess and distribute a maximum of one ounce of cannabis. The measure also allows people to grow a maximum of three marijuana plants.

The residents of South Dakota will be deciding on two separate measures during the November elections because last month, the secretary of state said that the campaign seeking to legalize medical marijuana in South Dakota had gathered more than 30,000 signatures, which is the required number for the measure to qualify for the 2020 ballot.

Under the adult-use marijuana legalization measure, the Department of Revenue in South Dakota would be tasked with the responsibility of issuing permits to the manufacturers, testing laboratories, and retailers. A tax of 15% would be imposed on all marijuana products sold, and the revenue would be used to cover the implementation of marijuana programs and public education. Some of it would be added to the state general fund.

The measure seeking to legalize medical marijuana has provisions that require the lawmakers to approve the legislation allowing patients to access medical cannabis and the sale of hemp by April 1, 2022.

The signatures required for medical marijuana to enter the ballot were 16,962, which is lower than that of recreational marijuana, which is a proposed constitutional amendment, which were 33,921 signatures.

In a press release, the Secretary of State, Steven Barnett, said that his office conducted a random sample of the submitted petition signatures and found 68.745% (36,707) of them to be valid.

Marijuana Policy Project (MPP) and New Approach PAC are both in favor of the recreational and medical marijuana measures.

Speaking to an online industry publication, the deputy director of the Marijuana Policy Project, Matthew Shweich, said that South Dakota would be the first state to legalize both medical and recreational marijuana on the same ballot in the history of America. The legalization of recreational marijuana would be of benefit to the residents of South Dakota as it would mark the end of unlawful arrests of law-abiding citizens for marijuana offenses. Instead, law enforcement will use its resources to combat severe crimes. Recreational marijuana sales will generate revenue for the state and create new jobs.

There is less likelihood of Congress passing a marijuana legalization measure this year, said Schweish, who played a significant role in the campaigns for collecting the signatures for the two initiatives.

Marijuana advocates are hopeful that the voters will approve both measures; however, they are also expecting pushback from Gov. Kristi Noem, who opposed hemp legalization legislation in 2019, as well as the state Republican Party, which urged the voters not to sign the ballot petition in September.

In the U.S., other states, such as New Jersey and Mississippi, are also going to enter their measures in the ballot for the voters to decide in November’s elections.

It is widely believed that the entire cannabis industry, including entities like Dama Financial and Green Hygienics Holdings Inc. 420 with CNW – Top Vermont Health Official Endorses Recreational Cannabis Legalization in the State

During a radio interview on Monday, Cynthia Seivwright, the director of the Department of Health’s Alcohol and Drug Abuse Program in Vermont, said that compared to the current policy, public health would be better protected by regulating marijuana commerce in the state.

She made the remarks on WDEV’s Dave Gram Show while discussing the relationship between cannabis-related health issues and Vermont’s failure to regulate marijuana. Vermont goes down in the U.S. history books as the first to legalize marijuana by an act of lawmakers. The bill was then signed into law by Governor Phil Scott. The legislation permits low-level possession and household cultivation of marijuana but prohibits the sale of weed.

When asked if a regulatory model similar to that of alcohol would apply for marijuana, Seivwright said that without proper regulation, it would be impossible to know what it contains, nor would they be able to control the potency. She further added they would not be able to control accessibility.

Seivwright further said that marijuana should be tested in an independent lab. The packaging should not be appealing to kids and should be fitted with childproof caps.

Dave Silberman welcomed the marijuana legalization support exhibited by the Department of Health. Silberman is an attorney and pro bono drug reform advocate from Middlebury.

Speaking to a online marijuana industry publication, Silberman said that Vermont residents from all political parties are eager to pass a reliable system of regulation that prioritizes consumer safety and generates revenue. The revenues can be used by the Health Department to establish broader addiction prevention and treatment efforts. He further said that a robust regulatory system is better than just sitting pretty and wishing for a drug-free country. Silberman also noted that the Health Department is embracing a fact-based approach to marijuana, which aims at minimizing harm instead of stigmatizing the drug.

The state Senate passed the legislation legalizing marijuana sales, but the measure did not reach the House floor despite having passed at the committee level.

VT Digger reported that the House Speaker Mitzi Johnson (D) said that there is no guarantee that the legalization bill will pass in 2020 despite the Democratic leaders’ optimism of its advancement.

Johnson also noted that for the bill to be approved in the House, it would have to garner a minimum of 76 votes, and this shows that she has no intention of rounding up support. She further said that before approving the bill, issues such as youth consumption, roadside safety, and impact on the environment should be addressed.

Johnson’s stand on the bill is in contrast with the state’s Democratic Party, because it included marijuana marketplace legalization on its campaign platform in 2018.

When the bill failed to advance to the House, the Majority Leader Jill Krowinski assured the bill’s supporters that her party is committed to the legislation and that they would pursue it in 2020.

Industry watchers are strongly convinced that the words of the House Majority Leader don’t carry any weight before the cannabis industry, including entities like Green Hygienics Holdings Inc. 420 with CNW – US Virgin Islands Governor Asks Legislators to Hold Special Marijuana Legalization Session

The U.S Virgin Islands Governor Albert Bryan Jr. is calling on the lawmakers to consider recreational marijuana legalization in a special session, which would be held later this month.

If the proposed measure is approved, the U.S. Virgin Islands (USVI) will be the third territory in the U.S. to legalize adult-use marijuana, following in the footsteps of Guam and the Commonwealth of the Northern Mariana Islands.

In a press conference, Bryan said that the new measure would create a regulated system and enable tourists to visit the U.S.Virgin Islands. It would also increase the tax fees collected by the Virgin Islands government. He further called marijuana a new revolution that has taken the U.S. by storm.

Bryan also said that the legislature would add the measure to the territory’s current medical marijuana program on Dec. 18. Earlier this year, Governor Bryan signed the bill legalizing medical marijuana; however, it has not been implemented because the legislature has been delaying to make nominations to the regulatory body.

As reported by Vibe High, the new proposal stipulates that people who are 21 years and above would have to acquire a permit from the USVI to purchase and cultivate weed. The term recreational marijuana was not used when the governor was discussing the bill; instead, he used “non-prescribed” or “non-medicinal” when referring to the licenses. The governor also noted that the medical marijuana program would stay intact.

The USVI government revealed that marijuana recreational sales would be eligible for up to thirty percent tax. The government would use this tax as follows: 75% would be allocated to the government retirement scheme, 20% would be assigned to the territory’s senior citizen’s programs, and 5% to the USVI Office of Marijuana Regulations.

Bryan further said that it is time for taking action by having a dependable funding system.

According to Bryan, tourism is supposed to contribute to the Islands’ tax revenue. Day passes for recreational marijuana will be issued to tourists as most of them come to the USVI for a vacation and to relax. He also noted that tourists would be required to pay $10 per day to utilize the legal status of the territory’s marijuana system.

In a year, when tourism is at the peak, USVI receives 2.1 million visitors. They are issued with a $10 per day pass, and if 10% of them smoke weed, that will equate to $2 million in day passes alone.

According to Vibe High, the measure’s language aims to help farmers as it states that retail marijuana outlets must source 70% of their products locally.

Bryan further said one of the key policies in the legislation is to call for the expungement of past marijuana convictions and to exonerate those convicted and serving marijuana felony sentences.
