Until a decade or so ago, America’s policy on cannabis had been outright prohibition. Marijuana was illegal to grow, produce or sell in nearly every state, and individuals who participated in any of these activities were subject to intense policing and harsh sentencing. Now more than 30 states allow some form of cannabis, and the industry has employed hundreds of thousands and provided states with millions of dollars in tax revenue.

However, federal law still classifies marijuana as a Schedule I controlled substance, similar to hard drugs such as cocaine and heroin. Additionally, most states have different cannabis regulations, and what is allowed in one state may be illegal in another. Consequently, this has led to a mismatch between federal law and a patchwork of state law, with state-legal businesses being forced to navigate an extremely tricky legal environment.

This week a conservative U.S. Supreme Court Justice slammed America’s federal policy on cannabis, calling it unstable and contradictory and suggesting that outright federal prohibition of the controversial drug may even be unconstitutional. Justice Clarence Thomas specifically talked about the 2005 Gonzales v. Raich ruling, which determined that since the federal government had the authority to regulate interstate commerce, it could enforce prohibition policies against cannabis cultivation in California.

However, he says, federal policies have undermined this ruling in the 16 years since it was passed. The federal government’s approach to cannabis has since been a “half-in, half-out regime,” he says, with the federal government seeming to both allow and forbid local cannabis use. Not only does this strain the credibility of federal law, but it also hides traps for unwary cannabis businesses that might think they are acting lawfully based on the federal government’s previous actions, only to find themselves facing repercussions.

Since the Gonzales v. Raich ruling, the government has sent mixed signals regarding cannabis. For instance, a spending bill rider that has been approved repeatedly forbids the Justice Department from using its funds to interfere with state-legal medical marijuana programs. Additionally, Obama-era memorandums by the Justice Department state that the government would “tolerate” certain cannabis-related activities as long as they are lawful in the state in which they occur. Federal prosecutors were also instructed not to pursue low-level cannabis offenders, contrary to federal law.

Thus, he says, these actions may lead the ordinary person to believe that the federal government has reversed its prohibitionist policies when it hasn’t. The mismatch between federal and state law has also prevented cannabis businesses from accessing financial services, despite being legal entities that pay tax. Most of them are forced to operate on a cash-only basis, which puts them at risk of burglaries and robberies. In conclusion, Thomas said that outright prohibition may no longer be a proper approach.

420 with CNW — Fibromyalgia Patients Ditching Opioids for CBD to Manage Pain

Fibromyalgia is a disorder that presents as musculoskeletal pain accompanied by mood, memory, sleep and fatigue issues. This disorder has no cure, and while there are drugs that can help manage its symptoms, most don’t do the job perfectly. However, a new study conducted by researchers from the School of Medicine at the University of Michigan has found that patients with fibromyalgia may benefit from the use of products that contain CBD to manage pain.

CBD, or cannabidiol, is a cannabinoid that is extracted from the marijuana plant that doesn’t induce the intoxicating effects of THC. This cannabinoid has been marketed for different uses, ranging from pain relief to mood stabilization. THC, or delta-9-tetrahydrocannabinol, is another cannabinoid that is also extracted from the marijuana plant. It causes individuals to feel high.

The legalization of recreational and medical cannabis in different states across the United States and the removal of CBD derived from hemp from its Schedule 1 classification have boosted the marijuana industry’s growth tremendously.

Prior studies have demonstrated that some individuals substitute medical marijuana, which has high THC concentration, for pain medications such as opioids, with many reporting that the former induces fewer side effects and offers better pain relief. However, studies on the use of CBD for the same indications is still limited at best.

This is why researchers from the Chronic Pain and Fatigue Research Center conducted their research, with Kevin Boehnke, a member of the research team, noting that CBD was less harmful in comparison with THC and presented a beneficial harm reduction strategy. The researchers conducted a survey with more than 800 individuals who suffer from fibromyalgia and claimed to use CBD to manage chronic pain.

In the study, the research investigators explained that the disease wasn’t easy to treat and involved different medications that provide modest benefits and many side effects, noting that alternative therapies such as massages and acupuncture weren’t covered by insurance, which made those options less accessible to most individuals. The researchers discovered that more than 70% of the individuals who used CBD had substituted it for other pain medications, including opioids. Of this number, the majority reported that they had either stopped taking or reduced their use of opioids due to the use of CBD.

The researchers note that for most of the patients, the use of CBD was taking place without the guidance of a physician, adding that despite the lack of evidence, individuals who were using the cannabinoid as a substitute for other pain medications had found it to be more efficacious and less harmful.

420 with CNW — Congressional Committee Authors Report Urging Feds to Rethink Firing Employees Who Use Marijuana

Although federal law still classifies cannabis as a Schedule I controlled substance, more than 30 states have legalized it for either medical or recreational use. This classification has been a constant thorn in the industry’s side, preventing businesses in the cannabis space from accessing crucial banking and financial services. Cannabis consumers have also been caught in the middle, with many of them being penalized by the federal government for actions that are considered legal in their home states.

As such, a powerful Congressional committee has released a report urging federal agencies to reconsider firing employees for using state-legal marijuana. Alongside the report, the annual Financial Services and General Government (“FSGG”) spending bill approved by the House Appropriations Committee also includes a provision that would provide protections for banks that work with state-licensed cannabis businesses.

The committee stated its support for a recent memo sent to federal agencies by the Office of Personnel Management (“OPM”), saying in the report that admission of last cannabis use should not automatically disqualify people from employment. Additionally, a longstanding rider that blocks Washington DC from allowing cannabis sales was conspicuously absent from the spending legislation.

The report, which was attached to the FSGG spending bill, states that the committee supports the updated guidance by the OPM regarding whether past marijuana use affects an individual’s fitness or suitability for a federal position. The report also urged the federal government to reconsider and reevaluate policies that penalize workers for consuming cannabis products when they are legally allowed to do so in their home states. The report concluded that the employment policies should be updated to reflect changes to the laws regarding cannabis usage and how using state-legal cannabis can impact federal employment.

Although the House Appropriations Committee hasn’t made an explicit endorsement for loosening employment restrictions on cannabis use, it is asking the federal government to stop punishing employees for the inconsistencies between state and federal law. Reevaluating strict policies that penalize employees or applicants who admit to consuming cannabis in legal states to make them more lenient would be the first step.

Employees have been the most affected by the differing cannabis policies on the state and federal level, especially those working for federal agencies required to abide by federal law. Just a few months ago, stories emerged about how staffers in the Biden administration who had admitted to past cannabis use were being penalized in some form or other. Although press secretary Jeb Psaki said that no White House staffers had been fired for prior marijuana use, she hasn’t commented on whether they were suspended or placed in remote work programs.

When Congressional committees start voicing their concerns about the contradictions between federal and state marijuana laws, it goes a long way towards helping the cannabis industry, including companies working in the space, such as Hero Technologies Inc. 420 with CNW — Stuff You Should Know About Legal Cannabis in Michigan

In 2018, the state of Michigan became the first state in the Midwest to legalize recreational cannabis. The legislation, which went into effect in December of the same year, is known as the Michigan Regulation and Taxation of Marijuana Act.

This move came a decade after voters in the state approved the Michigan Medical Marijuana Program. The program, which operates as a division in the state’s cannabis regulatory agency, is governed by different legislation and is detached from the agency’s medical and adult-use cannabis licensing division.

While this isn’t a prescription, the law requires that only a physician of osteopathic medicine and surgery or a medical doctor who has a current practice license in the state can sign the physician certification for a patient to qualify for the program. Additionally, the law governing the state’s medical cannabis program lists medical conditions that are eligible for the use of medical cannabis. The National Academy of Sciences’ Institute of Medicine has found that the plant is beneficial in treating and reducing nausea and pain as well as other symptoms linked to various debilitating medical conditions.

The main differences between recreational and medical marijuana can be observed in the amount and taxes paid, as taxes for recreational cannabis are higher. Either way, if users are planning to or are using either recreational or medical cannabis, there are a few things to keep in mind with regard to state law.

The law states that individuals aged 21 and above are allowed to process, store and possess no more than 10 ounces of cannabis and should not grow more than 12 cannabis plants for personal use. This is in addition to stipulating that individuals aged 21 and above are allowed to process, transport, purchase, consume, use and/or possess no more than 15 grams of cannabis concentrate and 2.5 cannabis flower ounces.

Additionally, drivers are not allowed to have more than 15 grams of cannabis concentrate or 2.5 cannabis ounces on their person. Drivers are also not allowed to consume cannabis while operating any motor vehicle and are also barred, along with their passengers, from smoking cannabis in the passenger area of a vehicle. In addition to this, passengers and drivers cannot transport cannabis into Canada.

The penalties for operating under the influence of cannabis are similar to those of operating under the influence of alcohol. Penalties include six points on an individual’s driving record, a license suspension, a $500 fine and three months in jail, among others.

420 with CNW — UN Calls for Worldwide Ban on Cannabis Advertising

Every year, the United Nations’ (“UN”) drug division releases a drug report, offering policy recommendations regarding drug and drug use for its member nations. The 2021 World Drug Report, released by the UN Office on Drugs and Crime (“UNODC”), has urged a global ban on cannabis advertising, promoting and sponsoring. According to the report, as more territories have legalized marijuana and THC potency has continually increased, the perception of the drug’s risks has reduced, especially among the youth.

A comprehensive ban on all forms of marijuana advertising is in the best interest of public health, the report states, and a ban would ensure that business interests follow guidelines to protect public health interests. Although such a proclamation would seem like a major blow to the young but swiftly growing cannabis industry, pundits say it is tacit recognition of the inevitability of legal cannabis by the prohibitionist body. Before the 2021 report, the UN Office on Drugs and Crime’s standard policy on cannabis was that it should be prohibited, not regulated.

By giving its member nations tips on how to regulate the industry, which is one of the fastest-growing sectors in America, the UN is unofficially recognizing the popularity of cannabis reform and preparing for a future where legal cannabis markets will be the norm rather than the exception. As such, some players in the cannabis market feel that the UN’s recommendation to ban cannabis advertising is a positive development. According to UNODC, this ban would have to apply across “all jurisdictions,” and member nations would need to invest more in cannabis research.

Specifically, these funds would be used to research the negative effects of recreational cannabis use as well as the various medical conditions that are said to be treatable by cannabis. However, since the UN doesn’t have the authority to enforce a ban on cannabis advertising, the report’s recommendation is one that member nations are free to take up or ignore. The report compares such a ban to the provisions placed on tobacco by the WHO Framework Convention on Tobacco Control.

Steve Rolies, a senior policy analyst at Transforma Drug Policy Foundation, says the UN’s recommendation is an acknowledgement of the fact that cannabis legalization is inevitable. Comparing it to the ban on tobacco advertising shows that, although the division may not approve of the industry, it has accepted that there is no stopping the forward momentum and has decided to protect vulnerable individuals, especially the youth, from cannabis promotion.
