420 with CNW — How Marijuana Drinks Are Finally Coming to Maturity

When the first cannabis drinks hit the market a few years ago, they weren’t the smooth, high-quality beverages we see today. The cannabis industry itself was still in its infancy, cannabis technology was sorely lacking, and the results from these first attempts at infusing cannabis into beverages were not elegant. For instance, Lyden Henderson’s first run-in with a nonalcoholic, marijuana-infused beer last year left him with a bad taste in the mouth, literally.

It was chunky, he says, with soggy bits of marijuana floating throughout the beverage, creating what he refers to as “unpleasant consistency.” The texture was terrible as well, and he compares the taste to drinking milk that had been lying in a refrigerator for a couple of months. All in all, he recalls, it was the “most gross” drink he had ever had the misfortune of tasting in his life.

An entrepreneur at heart, however, Henderson saw the ordeal as a learning experience and vowed to create a much more superior cannabis beverage. For more than a year and a half, he and his workmates at Outbound Brewing, a nonalcoholic CBD and THC-infused beer firm he co-founded back in 2018, worked on developing a cannabis-infused beverage that was neither lumpy nor chunky. The company finally launched the line of cannabis beverages this year, with each 12 oz. bottle containing a smooth beverage infused with either 20 mg. of CBD or 10 mg. of THC.

Why was it so hard to infuse cannabis effectively into beverages until recently? Well, cannabinoids such as THC and CBD, which are responsible for marijuana’s effects, are naturally fat soluble. This means that while they will readily mix with fats and oils, they do not mix easily with water. Tinctures, which are a liquid product, use an alcohol base, but since it is illegal to mix cannabis and alcohol, this technique cannot be transferred to cannabis beverages.

Edibles, which have recently been seeing increasing sales, take advantage of cannabinoids’ fat solubility by mixing them with oils and fatty butters. Again, this cannot be used to make cannabis-infused beverages. But as the industry has matured, cannabis beverage companies have perfected a procedure referred to as nano-emulsification. Here, marijuana oil is broken into microscopic particles and mixed into an emulsifier that has two parts: one that bonds with oil and another that binds with water. Thus, one end of the emulsifier takes the cannabis oil while the other binds with water, suspending the cannabis in water and producing a very consistent product.

Jake Bullock, co-founder of THC- and CBD-infused sparkling water maker Cann, works with SōRSE Technology, a Seattle-based lab, to perfect the emulsification process without impacting the taste. The result was a beverage that doesn’t taste like cannabis at all, has the consistency of seltzer and has a standardized amount of cannabis in each can.

420 with CNW — State Cannabis Regulators Discuss Effects of Legalization with Members of Congress

Last week, a group of state cannabis regulators met with members of Congress and federal officials to discuss the possible effects that national legalization of the plant and other changes in marijuana policy could have on the programs they manage.

The meeting was organized by the Cannabis Regulators Association. The coalition is made up of members whose states have put an end to marijuana prohibition and would be impacted by any federal cannabis actions.

In attendance were the co-chairs of the Congressional Cannabis Caucus Reps. Dave Joyce and Earl Blumenauer, who spoke with staffers from various congressional offices as well as the state regulators. Representatives from the Alcohol and Tobacco Tax and Trade Bureau, the Food and Drug Administration and the National Institute on Drug Abuse were also in attendance.

In an interview, the Michigan Marijuana Regulatory Agency’s executive director Andrew Brisbo stated that federal officials were open-minded during the discussion, adding that their main objective for the meeting was to highlight how important it was that state regulators have a position to share their perspectives.

Brisbo also observed that promoting economic and social equity, product testing and labeling were among the issues that they discussed during the meeting. In addition, they also talked about laws to protect banks that cater to state-legal cannabis businesses from incurring penalties from federal regulators. Regulators from the states of Utah, Oregon, Nevada, Minnesota, Massachusetts, Illinois, Hawaii, Colorado and California among others also took part in the discussion.

In addition to this, Brisbo stated that they also wanted to make sure that there was consideration for already existing frameworks when federal policies were enacted. He also explained that while some initiatives honored the people’s will and established structures that functioned on the state level, it was important to make sure that the progress made by different states wasn’t overrun by federal policies.

Earlier in the year, the regulators association had penned a letter to congressional leaders who had provided assistance and outlined marijuana policy priorities as legislators consider various reform initiatives that may be advanced during this session.

The priorities included supporting public health initiatives, making certain that there was economic and social equity in legal markets, advancing research on cannabis, offering banking access to state-legal marijuana businesses, and offering protection to states that have legalized cannabis in some form.

At present, the sponsors of a Senate legislation to offer marijuana banking protections are calling for the chairman to put the measure to a vote in Congress.

420 with CNW — Could Amazon’s Warming Up to Cannabis Signal a Federal Policy Change?

Since the emergence of the state-legal cannabis industry, there has been a pointed effort to keep “big business” out of the nascent sector. Most cannabis legislations have prioritized small businesses and equity applicants who were victims of cannabis prohibition in a bid to keep large corporations from coming in and taking over. But these established market players may just be what the industry needs, especially when it comes to federal legalization, and a recent announcement by e-commerce giant Amazon may spark the federal change cannabis players have been anxiously waiting for.

At the start of the month, the American-based retailer made a twofold announcement: it would stop testing its employees for cannabis use, and more importantly, its public policy support team would throw its support behind the Marijuana Opportunity Reinvestment and Expungement (“MORE”) Act. While halting marijuana drug tests will go a long way in reducing the social stigma cannabis users face, especially for medical marijuana patients, it is the second announcement that may have major ramifications for the cannabis industry moving forward.

The MORE Act, which was sponsored by Rep. Jerrod Nadler, would remove cannabis containing more than 0.3% THC (the main psychoactive compound) from the list of Controlled Substances. Additionally, it would expunge the records of individuals with prior nonviolent, cannabis-related charges as well as create social equity programs to give communities that were disproportionately affected by the war on drugs a leg up in the sector.

So how exactly will Amazon’s declaration aid the young but lucrative marijuana industry?

By lobbying, that’s how. Like it or not, big business packs quite a wallop, and Amazon is one of the largest corporations not only in America but also in the world. By throwing its weight around cannabis bills, whether it’s the MORE Act or a banking bill, and lobbying for their passage, the retailer can do more for cannabis at the federal level than nearly all cannabis players combined ever could. When companies such as Amazon and Uber state their support for federal cannabis legislation, it legitimizes the economic potential of what is still a controversial industry in the eyes of the policymakers in Washington, DC.

Not only do these large players in the space have the ability to sit down with these individuals and make their cases, unlike the small to moderately sized businesses that currently make up a large portion of the industry, but they will also show lawmakers that the entities growing, producing and distributing marijuana are known and trusted. That’s not to say that these corporations don’t have their fair share of questionable practices. Additionally, it doesn’t mean that smaller businesses will be completely edged out of the market.

Large-scale commercial producers could coexist side by side with smaller craft producers like they have in the beer scene. However, lawmakers must first pass federal legislation, and corporations such Amazon can help that happen.

Whatever the force that triggers a marijuana policy change at the federal level, sector players including Sonoma Biologics Corp. would get some relief from having to navigate the complexities associated with the variance between state and federal laws.

420 with CNW — Legislative Failure Prompts Mexican Supreme Court to Take Steps

The Supreme Court of Mexico is taking steps towards putting an end to cannabis prohibition on a national scale after the legislature failed to enact the change in policy. This comes almost three years after the same court declared that the prohibition of personal cannabis cultivation and possession was unconstitutional and ordered legislators to enact a change. While legislators did advance legalization measures after this, no bill was approved.

In a press release issued earlier last week, #RegulationPorLaPas, a body that advocates for an end to marijuana prohibition, stated that the steps taken by the Supreme Court grew the responsibility of the legislature in this matter, noting that it was mandatory for the legislative process to be continued so that the work that had been put into the effort to date could help guarantee the rights of citizenship. Justice Norma Lucía Piña Hernández of the High Court also filed a declaration of unconstitutionality with regard to the country’s marijuana laws.

For marijuana prohibition to be overthrown, the ministers on the Supreme Court will have to vote in favor of approving the declaration of unconstitutionality. While some may view this move from the court as abrupt, it has been a long time coming.

The Supreme Court ruled that cannabis criminalization unconstitutionally infringed adults’ rights in October 2018 and set a preliminary deadline for legislators to change policies in a year. Thereafter, it extended the deadlines several more times, moving it from April 2020 to December 2020 then again to April 30 of this year.

Many had hoped that the measure would have been approved during this final session, as the Senate had already given its approval before the Chamber of Deputies also made some amendments then gave its approval, after which Senate committees also approved the revised measure.

Under the measure, individuals ages 18 and above would have been permitted to grow up to six plants for personal use; in addition, adult-aged individuals can also buy and possess no more than 28 grams of cannabis. Changes made to the regulations by the deputies included adjustments that govern licensing and commercial market policies and the cannabis market’s regulatory structure. Additionally, the deputies amended the measure so that, instead of establishing an independent regulatory body that would oversee implementation of the cannabis program and its licensing, that authority was given to the National Commission Against Addictions, which is already in existence.

Furthermore, changes also increased penalties for unauthorized possession of huge amounts of marijuana and added clauses that prevented forest land from being converted to cannabis growing areas.
