420 with CNW — Senate Committee Wants Hemp THC Rule Changed

Earlier this week, senate appropriators released various reports and spending bills for fiscal year 2021 that have incorporated various provisions related to hemp and marijuana. Hemp contains no more than 0.3% THC, as defined under federal law.

However, the USDA proposed a 0.5% negligence threshold, which means that farmers who have exceeded that limit would have to destroy their plants. The senate panel is calling for the agency to reconsider the policy, taking into account stakeholder feedback.

A few other marijuana-related provisions that had appeared in previous reports and appropriation bills were also incorporated in the bills. Those included measures that banned Washington, DC, from using the district’s taxes to execute a regulated cannabis market while also protecting medical marijuana programs in the state from government intervention. Legislators also continue to identify barriers to cannabis research brought about by federal prohibition.

In addition to this, a new section has been added that asks the National Institute on Drug Abuse (“NIDA”) to add more marijuana-related questions to its annual government survey of young people. Legislators would like to incorporate queries about the consumption of flavored cannabis edibles and vapes that appeal to young people.

The senators also demanded $5 million in funding for FDA research into marijuana and marijuana derivatives, protecting state hemp programs and enlarging cannabis studies in the U.S. Department of Health and Human Services.

On the other hand, the House advanced appropriation bills of its own during the summer that include wider marijuana reform policies, showing an overlap between the House and the Senate. In the House version, proposed legislation includes provisions aimed at the following:

  • Grant the state of Washington the ability to legalize recreational marijuana sales
  • Oversee the nation’s CBD and hemp industries
  • Enlarge research on marijuana
  • Ease access to basic banking services for marijuana businesses
  • Protect recreational cannabis legalization laws from government interference

To keep most agencies and programs funded, the government has been relying on continuing resolutions, seeing as the fiscal year for next year actually began Oct. 1, 2020.

The report for the measure to fund the Department of Health and Human Services has several passages that direct officials to widen the scope of cannabis research. The measure also includes a note that marijuana’s classification as a Schedule 1 drug only hinders research.

Over in the District of Columbia, the bill funding the state currently maintains a rider banning the city from using its own funds to legalize and regulate recreational marijuana sales. This is despite the House-passed version of the fiscal year 2021 legislation proposing that the policy be revoked.

420 with CNW — Texas Legislators Pre-File Bills to Legalize Marijuana

Slightly more than a week after five states voted to legalize marijuana in some way, legislators in Texas have started pre-filing bills aimed at enacting marijuana reforms in the conservative U.S. state.

In only two days, a total of 13 marijuana-related bills targeting the 2021 legislative session of Texas were pre-filed. One of those bills seeks to legalize the recreational use of cannabis by adults; another wants to decriminalize the possession of small amounts of marijuana and protect people who genuinely think they are in possession of hemp but are found with marijuana. Still a third is designed to put the issue of marijuana legalization before voters in the state.

While most of those bills seek to make massive reforms to marijuana policy in Texas, the most far-reaching is a legalization bill that has been sponsored by a newly elected state senator. Democrat Roland Gutierrez is currently a member of the state assembly and is waiting to join the senate in January. His bill, Senate Bill 140, intends to allow Texans who are at least 21 years of age to purchase, possess and consume marijuana within the state. The bill also has provisions establishing a regulated marijuana market in Texas.

The senator-elect has largely premised his bill on the potential financial benefits that the state is likely to enjoy once a regulated marijuana industry is established. For example, the lawmaker states that the marijuana industry has the potential to inject about $3.6 billion into the Texas economy in addition to bringing a minimum of 30,000 new jobs to the state.

His figures aren’t wishful thinking as estimates done by Vicente Sederberg LLC, a law firm, indicate that a legal marijuana industry can earn Texas at least $1.1 billion in taxes as well as millions extra from license and other fees.

These financial benefits come at just the right time as state officials say Texas will have a deficit of $4.6 billion as the legislature resumes business in January 2021.

Gutierrez jumps on this fact, noting that marijuana legalization provides a solution to raising the needed funds without burdening ordinary Texans with additional taxes. Ironically, the money the incoming state senator talks about receiving from a legal marijuana industry will come from excise and sales taxes levied on those products. However, this method of getting the needed resources may be more acceptable to Texans as they could see it as the price they have to pay to access cannabis legally within the state.

Research carried out by the School of Public Health and Social Policy at the University of Victoria along with the Canadian Institute for Substance Abuse Research revealed that people who used medical marijuana experienced a decline in their alcohol consumption.

The study involved 1,000 medical marijuana patients in Canada and examined them on their habits, which included questions on their alcohol consumption. The study’s findings revealed a decline in alcohol use.

The study asserted that marijuana can affect the use of other psychoactive substances, including illicit drugs, tobacco, alcohol and prescription medications. However, little research has been conducted that looks into the factors linked to these changes in substance use.

During the study, 18% of the individuals who were polled reported that they abstained from alcohol, 85% claimed that they decreased the drinks they consumed every week and 44% reported a decline in the frequency of their alcohol consumption as they used medical marijuana.

From the Canadian medical marijuana program, a sample of 2,102 individuals provided their data, with each individual giving answers based on their medical marijuana use throughout the study and how it affected their alcohol consumption. More than 970 respondents who used alcohol at least 10 times over a year before starting to use medical marijuana were also included in the study. The researchers then assessed retrospective data on amount of alcohol and the frequency of use before and after medical marijuana initiation.

It is estimated that about 107 million people around the globe suffer from alcohol use disorder. This is a physical and mental addiction that’s common. The use of marijuana/medical marijuana to help decrease alcohol use is good news for many. Additionally, the WHO reports that marijuana is 114 times safer than alcohol, with alcoholism killing 3 million individuals around the globe annually.

The study findings suggest that the use of medical marijuana may be linked to reductions in alcohol intake and cessation among medical marijuana patients. Liquor is the most common recreational substance in North America, and it has high rates of mortality, morbidity and criminality as a result of its use. The authors of the study claim that these findings may bring about better health outcomes for medical marijuana patients and improve general safety and public health as well.

While this is only one study that looks into the link between the use of alcohol and medical marijuana, it may be the key to more research that supports marijuana treatment as a way to keep off liquor.

Apart from understanding the plant’s botanical properties, the institute is also calling for the end of federal restrictions that may impede research in this area. The removal of a prohibitive designation, such as the classification of marijuana as a schedule 1 drug, would only open the door to more research. 420 with CNW — Federal Marijuana Legalization Bill to Get Floor Vote in December

Steny Hoyer, a U.S. representative from Maryland and the House Majority Leader, wrote a letter to his colleagues providing details about the upcoming legislative session, slated to run November to December. That letter indicated that the long-awaited floor vote on federal marijuana legalization will happen, though he didn’t mention exactly when that’s likely to be during the brief session.

In his letter, Hoyer explains that the House will vote on the MORE Act. This bill seeks not only to decriminalize marijuana but also to create a pathway for the expungement of nonviolent, marijuana-related convictions that have made it nearly impossible for scores of Americans to secure employment, access credit or even find appropriate housing. These bottlenecks have prevented the affected people from contributing positively to the economies of the states where they reside.

It should be remembered that this same bill had been scheduled for a floor vote back in September. However, a number of Congressmen and women who faced tight races to retain their seats felt uneasy about voting on marijuana legalization while the House had failed to pass a COVID-19 stimulus package. Last week’s elections saw massive wins for marijuana as five states passed marijuana measures either for medical or recreational cannabis. That approval means that now more than one-third of the country has some form of legalized marijuana, including jurisdictions such as South Dakota and Montana, which are seen as very conservative.

Public sentiment is also massively in favor of federal cannabis legalization as evidenced by a recent Gallup poll, which found that nearly seven in ten Americans support the legalization of marijuana.

It is therefore not surprising that the House wants to vote on the pending marijuana bills since this is in line with what the public wants. Reacting to Hoyer’s letter about the planned floor vote, Rep. Barbara Lee, who co-chairs the marijuana caucus in the House, said that the success registered in the legalization ballot measures voted upon last week showed that it was necessary for Congress to get up to speed with the needs of the public.

Chuck Schumer, the Senate Minority Leader, also expressed his agreement through a tweet regarding the planned floor vote. It now remains to be seen whether the bill will have sufficient support to pass.

420 with CNW — Connecticut Governor Says Legalizing Pot Good for Public Health Amid Pandemic

With several states legalizing cannabis use, marijuana tourism has been on the rise. Cannabis tourism, or traveling across state lines to purchase and consume the infamous plant, attracts millions of visitors and dollars to states that allow recreational cannabis. However, with the coronavirus pandemic raging, traveling across state lines for cannabis may not be safe, says Connecticut Gov. Ned Lamont.

In an interview with Yahoo Finance, Gov. Lamont said that legalizing cannabis amid the coronavirus crisis would be a big win for public health. With work-from-home and social-distancing measures in place to curb the spread of the virus, the last thing states need is people driving back and forth across state lines for marijuana. Connecticut doesn’t allow recreational cannabis yet but is surrounded by states that do, creating a situation where consumers are more likely to travel to neighboring states.

During his interview, Lamont stated that officials have “got to think regionally when it comes to how we deal with the pandemic, and I think we have to think regionally when it comes to marijuana as well.” When asked whether he would pursue cannabis legalization next year, Lamont said that he thinks he will.

Connecticut is facing a budget deficit of $2 billion, and the governor has shied away from increasing taxes or cutting government spending. Without stimulus funds, he says, Connecticut may very well slide into a mild recession and suffer even more job losses. The cannabis industry has proven to be quite resilient during the pandemic, and taxing cannabis sales would be a great way to close the deficit and boost revenues.

“Right now, I’m surrounded by states — New Jersey and Massachusetts — where marijuana is already legal,” said Lamont. “I don’t need a lot of people driving back and forth across the border. We’re trying to keep people close to home as best as we can right now. I think legalizing marijuana, doing that safely and making sure no poison is laced in, I think is one way to keep people closer to home.”

Although voters in neighboring New Jersey voted in favor of a referendum to legalize cannabis during last week’s election, marijuana possession, use and sales will still be prohibited until lawmakers pass enabling legislation for the program. In a separate appearance, Lamont stated that the passage of cannabis legislation in New Jersey as well as ongoing cannabis reform efforts throughout the Northeast underscores the need for Connecticut to enact cannabis policy change.
